Icahn Enterprises wins dismissal of investor lawsuit

Carl Icahn's investment company Icahn Enterprises won the dismissal of a lawsuit claiming it artificially inflated its share price by issuing unsustainably high dividends to help the billionaire investor obtain large amounts of personal loans. A spokesman for Icahn Enterprises did not immediately respond to a similar request. The shareholders said Icahn Enterprises' true health became evident as its Auto Parts Plus business went bankrupt, the company slashed its dividend and Icahn renegotiated his loans. He also said Icahn Enterprises' 2021 annual report disclosed Carl Icahn's share pledges, and that there were no allegations that any defendant conducted insider trading. It also was the capstone of her highly scrutinized handling of the historic Trump case, in which she was known to drag out the pretrial proceedings, entertain long-shot legal theories offered by the former president and issue cumbersome orders that flummoxed lawyers on both sides of the case. Well before Monday’s ruling, outside cheerleaders of the special counsel, including many Trump critics, were calling on Smith to seek Cannon’s removal from the case. None of Thomas’ eight colleagues signed on to his solo concurring opinion, as Smith noted in court filings last week arguing to Cannon that the concurrence should not bear on the classified documents case. The way she has managed her docket has kept the case at a snail’s pace, playing into Trump’s strategy of delay. Or it has happened when the judge has “repeatedly” refused to comply with the appeals court’s instructions on a particular issue in a case, he said.

She said Smith was unconstitutionally appointed as special counsel and that the funding of his office also violated the law. “It’s not just that this is an extreme argument about the Appointments Clause of the Constitution, it’s that it’s one that exactly one Supreme Court justice has endorsed and lots of precedent refutes,” said Steve Vladeck, a CNN Supreme Court analyst and professor at Georgetown University of Law. And Cannon’s opinion left open the possibility that the charges could be revived if brought by the Justice Department in a way not reliant on the current special counsel infrastructure. In other special counsel cases, defendants have not even bothered to bring the long-shot claims. The special counsel office has not yet weighed in on Cannon’s decision.

With Monday’s Supreme Court presidential immunity ruling likely preventing a trial in the federal election subversion case before the election, Trump is poised to avoid pre-election trials in the three most significant criminal prosecutions he faces. It will determine Trump’s legal fate. A Supreme Court ruling that hamstrings the DC federal subversion caseThe charges by special counsel Jack Smith alleging Trump subverted the 2020 election was the second to last of the four cases brought. “You can’t charge a former president for a crime for the first time in history without going to Supreme Court,” Cobb said. But the new Supreme Court immunity standard jeopardizes the use of much of that conduct in the case.

Blanche took Cohen through a long list of the insults he’s unleashed at Trump since becoming estranged from his former mentor, highlighting his penchant for serial lying. He drew jurors’ attention to a social media post in which Cohen wore a T-shirt that depicted Trump in jail, as he spun a narrative of bias and obsession. A key legal conundrum is whether prosecutors have so far succeeded in validating the legal theory behind the case. That foreboding realization was exacerbated by a new posse of Trump supporters at the courthouse on Tuesday, including House Speaker Mike Johnson. While Cohen’s reluctance to offer yes-and-no answers came across at times as flippant and confrontational, he did not appear to say or do anything to torpedo the prosecution case.

CNN —The presiding judge in the Georgia criminal case against Donald Trump and his allies has thrown out some of the charges against the former president and several of his co-defendants. The partial dismissal by Georgia Superior Court Judge Scott McAfee leaves most of the sprawling racketeering indictment intact. Trump was named in three of the counts specifically, meaning the former president is now facing 88 charges over the four criminal indictments in Georgia, New York, Washington, DC, and Florida. Prosecutors alleged that Trump and some of his co-defendants violated the law by pressuring members of the Georgia legislature to unlawfully appoint presidential electors. “It was interesting that the judge made room for the possibility of an appeal by the state.

The text messages raise questions about Bradley’s credibility, and the degree to which Merchant appeared to rely on his claims that she was then unable to substantiate elsewhere. Wade and Willis have admitted to being romantically involved, but both have testified their relationship started after Willis appointed Wade lead prosecutor in the Trump case. Merchant had said that he would contradict testimony from Willis and Wade once he took the stand. “Why would you speculate when she was asking you a direct question about when the relationship started?” Sadow pushed. The additional text messages show Bradley calling Merchant his “friend,” offering unsolicited advice, and also bashing Willis and Wade, Bradley’s former law partner.

The high-stakes hearings nearly 900 miles apart speak to the extraordinary entanglement of the 2024 election and Trump’s legal quagmire that now spans multiple presidential elections. Thursday will not even be the first time this week that the ex-president’s legal plight is playing out in two separate cities. The ruling could remove Trump’s capacity to do business in New York — the city where he made his name. As the expected first criminal trial, the New York case could still have important political implications. But the impact of Trump’s legal problems on a wider electorate is still to be tested.

Here are takeaways from Wednesday’s hearing:Judge skeptical of a quick and joint trialMcAfee expressed skepticism about Fulton County District Attorney Fani Willis’ desire to hold a joint trial for all 19 defendants in October. “It just seems a bit unrealistic that we can handle all 19 (defendants) in 40-something days,” McAfee said. Trump is at the center of the Fulton County prosecutors’ alleged conspiracy, even as they charged 18 other co-defendants for taking part in efforts to overturn the 2020 election result. Special counsel Jack Smith took a different approach in his federal election subversion case, charging Trump alone and including six unindicted co-conspirators – several of whom are now Trump’s co-defendants in Fulton County. Scott Grubman, an attorney for Chesebro, suggested Trump’s presence in the Fulton County case could cloud how a jury views the other defendants.

A lawsuit claims Rudy Giuliani was paid $300,000 while pitching investors on an anti-Biden film. Giuliani allegedly said it would be a "kill shot" that would sink Joe Biden's campaign. By then, Giuliani was hard at work trying to dig up election-year dirt on Joe Biden in his capacity as President Trump's personal attorney. Giuliani, the lawsuit alleges, asked for the farmers' help finance efforts to make sure Trump was elected to a second term. The aborted Giuliani film project also forms part of a whistleblower disclosure from Johnathan Buma, an FBI special agent whose allegations were first reported by Insider.

Shortly after the shooting, Colleen Murphy, executive director and general counsel of Connecticut’s Freedom of Information Commission, received a call from a state legislator convinced that the filmmaker Michael Moore was seeking crime scene photos of the children. But Ms. Murphy told the lawmaker that her office, which fields all public records requests, had received no such inquiry. Some Sandy Hook families interpreted Mr. Moore’s remarks as “a horrific campaign to make the crime scene photos public,” Jennifer Hensel, whose 6-year-old daughter Avielle Richman died, wrote in The New Haven Register. “We cannot stand the thought of seeing the graphic depiction of our child’s death promoted to serve anyone’s political purposes.”Mr. Moore publicly clarified his view that no one should release photos without the families’ permission. Yet even today those requesting Connecticut homicide-related records must demonstrate that the release does not constitute an “unwarranted invasion of privacy.”

That is a large number, given there are fewer than 350 North Atlantic Right Whales remaining, including just 70 breeding females, say regulators, researchers and conservationists. North Atlantic Right Whales who live off the eastern North American coast stretching from Florida to the Canadian Maritimes provinces are now on the verge of extinction. Traditional lobster fishing uses traps that sink to the ocean floor and are connected by a rope to a buoy floating at the surface. Ropeless gear, by contrast, only deploys a rope and buoy to the surface when its owner activates a release trigger by remote control. When the 2,100 square-kilometer zones are shut, only harvesters with ropeless gear are allowed to fish there, Gilchrist said.

Judicial Panel on Multidistrict Litigation, that the judge overseeing their Miami cases, U.S. District Judge Michael Moore, has already proven in their brand ambassador cases that he can steer FTX cases quickly and efficiently. Not everyone pursuing claims on behalf of FTX customers agrees with Boies and Moskowitz. (To be clear, these private cases are different from cases that could be brought by a court-appointed receiver or trustee in FTX’s Chapter 11 bankruptcy.) If the cases go to California, the California slate is a likelier candidate. It will be a few months before any ruling on the Boies and Moskowitz consolidation petition.
The incident happened on Jan. 3 and involved Los Angeles resident Keenan Darnell Anderson, the cousin of Black Lives Matter co-founder Patrisse Cullors. The body-camera video shows Anderson in the middle of the street. The officer tells Anderson to "get off to the side," the video shows. Anderson tells the officer that he lost his key and had someone fix his car. The body-camera video shows Anderson lying on his back in the middle of the street in front of a car.
That was apparently not what the Boies and Moskowitz firms were hoping. In mid-November, the firms filed the first of their three FTX lawsuits in federal court. On Nov. 21, the Boies and Moskowitz firms filed a second FTX class action, this time on behalf of non-U.S. FTX customers. The day after Bloom’s assignment to the case, the Moskowitz and Boies firms voluntarily dismissed the two previously-filed FTX class actions before Moore and Gayles. “As we got more cases, we filed more cases,” Moskowitz said.
Here’s a look at how different financing instruments fared in 2022 and what’s ahead for 2023. Activity in the convertible debt market has picked up in recent weeks. Still, there could be financing opportunities for deals in 2023 in the form of syndicated loans, bankers said. “CFOs have to be aware of that and focus on cash conversion and margins,” he said, pointing to the increase in financing costs. “We expect deals will continue to get done,” he said, adding that those could however come with more oversight from lenders.
[1/3] Eliza Luna, a ballot designer with the Maricopa County Elections Department, counts ballots for the Arizona Presidential Preference Election at the Maricopa County Tabulation and Election Center in Phoenix, Arizona, U.S., March 17, 2020. Between July 11 and Aug. 22, the county election office documented at least 140 threats and other hostile communications, the records show. Maricopa officials appeared at times overwhelmed by threatening posts on social media and right-wing message boards calling for workers to be executed or hung. Eight people face federal charges for threats, including two who targeted Maricopa County officials. The county election director had instructed him to shut down the server for delivery to the Arizona State Senate in response to a subpoena.
