CNN —The Supreme Court declined Tuesday to let Mark Meadows move his Georgia election subversion case to federal court, effectively barring the former chief of staff during Donald Trump’s first term from claiming immunity from those charges. Meadows wanted to have his case heard in federal – rather than state – court, where he would be able to raise immunity claims. The Atlanta-based 11th US Circuit Court of Appeals ruled last year that the Georgia prosecution against Meadows should continue in state court, concluding that former federal officials are not covered by that statute “removing” state cases against government officials to federal court. The Georgia case has been at a standstill while an appeals court considers ethics allegations against Fulton County District Attorney Fani Willis. Meadows has also sought to move his criminal case related to the 2020 election in Arizona to federal court but failed to convince a judge in September.

But the court’s opinion also makes clear that this ruling is not a death knell for Smith’s case. Smith charged Trump with engaging in a “criminal scheme” to subvert the 2020 election; Trump has pleaded not guilty to four counts. In Nixon v. Fitzgerald, the Supreme Court held that a president enjoyed civil immunity for all “official acts.” Now, in Trump v. United States, the court grappled with which “official” acts should also receive criminal immunity. In order to settle the extent of Trump’s immunity, Chutkan should expeditiously schedule the mini-trial to hear witness testimony and receive other relevant evidence from both parties. In response to Trump’s assertion of civil immunity there, the DC Circuit put in place a lengthy discovery schedule for the lower court to determine the extent of Trump’s civil immunity.

CNN —The Supreme Court will likely produce thousands of words when it decides this year whether former President Donald Trump may claim immunity from special counsel Jack Smith’s election subversion charges. Every time the Supreme Court grants an appeal it settles on a specific legal question to resolve. In the immunity matter, the court didn’t embrace Trump’s framing – nor the question Smith posed when he sought review on the same issue in December. “The question implicitly rejects Trump’s position of absolute immunity because of that language ‘whether…and to what extent,’” Eisen said. By taking the appeal, the Supreme Court has effectively pushed back the start of a trial in the federal election subversion case by weeks, at least.

Earlier this year, Mr. Trump failed in his attempt to move a New York State criminal case against him to federal court; his argument in that case was seen as particularly tenuous. CNN —Former Trump White House chief of staff Mark Meadows is seeking to move the Fulton County, Georgia, prosecution against him to federal court so that he can try to get the case dismissed under federal law. Meadows’ request would not move the entirety of District Attorney Fani Willis’ case to federal court. Trump, who faces 13 charges, is also expected to try to move the case to federal court, according to multiple sources familiar with the legal team’s thinking. The law says that criminal actions brought in state court may be “removed” to federal court if the prosecution relates to conduct performed “under color” of a US office or agency. But in the meantime, Meadows argued that the federal court should move the charges out of state court, and into federal court, effectively halting the state-level proceedings against him.
