A Georgia appeals court on Monday canceled until further notice oral arguments on an effort by President-elect Donald Trump and other co-defendants to remove Fulton County District Attorney Fani Willis from the criminal election interference prosecution against them. The Georgia Court of Appeals acted on its own in canceling the arguments scheduled for Dec. 5. Trump and other defendants had appealed that ruling, and the Court of Appeals in June halted proceedings in the case pending the outcome of that effort. Circuit Court of Appeals to suspend proceedings in that case, citing Trump's election victory. That federal appeals court granted Smith's request.

Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. The three solicitation counts against Trump included accusations that he solicited Georgia House Speaker David Ralston and twice solicited Georgia Secretary of State Brad Raffensperger. Four of the original 19 co-defendants in the case have pleaded guilty, while Trump, Meadows, Giuliani and the others have pleaded not guilty.

CNN —Fulton County District Attorney Fani Willis has asked the state’s Court of Appeals to reinstate six counts in the election subversion case against Donald Trump and his co-defendants, including three specifically against the former president. The court filing brings the aftermath of the 2020 presidential election, and the effort to overturn Trump’s election defeat, back into the spotlight as early voting begins in Georgia in the 2024 election. The counts relate to Trump and his co-defendants’ alleged efforts to have state officials appoint a fake slate of electors for the state following his loss in the 2020 election. In his March decision, McAfee wrote that Willis failed to give the defendants “enough information” to prepare their defenses. “As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying felony solicited,” McAfee wrote at the time.

In a separate ruling, Fulton County Judge Scott McAfee also upheld the marquee racketeering charge in the case, which Trump is also facing. In the ruling, McAfee also threw out a separate count of filing false documents, which Trump was charged with. Trump was only named in two of the three charges that McAfee threw out Thursday. The awkward ruling from McAfee comes as he has only partial jurisdiction over the 2020 election meddling case.

A judge on Thursday dismissed two criminal counts against Donald Trump in his Georgia election interference case, but kept intact the top racketeering charge and other counts against the former president and other defendants. Fulton County Superior Judge Scott McAfee also tossed out a third count that had been lodged against a number of Trump allies. The third count the judge tossed — numbered as Count 14 in the indictment — was criminal attempt to commit filing false documents. In March, judge tossed out three counts of solicitation of violation of oath by a public officer that had been lodged against Trump. Trump's appeal is set to be heard in oral arguments at the Georgia Court of Appeals in December.

CrowdStrike shares slipped as much as 13% on Monday morning, as the cybersecurity software company continued to help clients across industries recover from an outage that took millions of Microsoft Windows devices offline last week. The incident ensnared 8.5 million Windows devices, less than 1% of the global total, Microsoft said. CrowdStrike shares fell 11% on Friday, but the fallout was not over yet. Guggenheim Securities downgraded its rating on CrowdStrike shares to neutral from buy on Sunday. Goldman Sachs maintained their buy rating on CrowdStrike shares in a note issued early Monday.

Security experts said CrowdStrike's routine update of its widely used cybersecurity software, which caused clients' computer systems to crash globally on Friday, apparently did not undergo adequate quality checks before it was deployed. The latest version of its Falcon Sensor software was meant make CrowdStrike clients' systems more secure against hacking by updating the threats it defends against. Patrick Wardle, a security researcher who specializes in studying threats against operating systems, said his analysis identified the code responsible for the outage. It's unclear how that faulty code got into the update and why it wasn't detected before being released to customers. Other security companies have had similar episodes in the past.

CNN —Russian cybersecurity company Kaspersky Lab will “gradually wind down” its US operations and lay off its US-based employees after the Department of Commerce announced a ban on the firm selling its products in the United States, Kaspersky said Monday. The Commerce Department last month announced the ban of the sale and provision of Kaspersky software in the United States, citing national security concerns. More than 400 million people and 240,000 companies worldwide use Kaspersky Lab’s software products, according to the company.
