Daniel Penny went “way too far” when he put Jordan Neely in a chokehold on a New York City subway train last year until he died, a Manhattan prosecutor told jurors Friday during opening statements in Penny’s manslaughter trial. “A chokehold is only permitted when it’s absolutely necessary and only for as long as it’s absolutely necessary,” Yoran told jurors. CNN —Former NFL stars Chad “Ochocinco” Johnson and James Harrison will fight in an exhibition mixed martial arts (MMA) bout in New Orleans next year, the pair announced on social media Wednesday. Johnson first said it was a three-round bout before Harrison said it would actually last five rounds. The pair have already been exchanging barbs, with Johnson telling Harrison: “I’m gone beat yo a** in round 1 so don’t worry about the other 4. Harrison, meanwhile, enjoyed a 15-year NFL career, spent mostly with the Steelers. Harrison won two Super Bowl rings with the Pittsburgh Steelers.

CNN —Sean “Diddy” Combs wants to testify at his criminal trial for charges of sex trafficking and racketeering, according to his attorney. He is very eager to tell his story,” the embattled rap mogul’s attorney Marc Agnifilo said in an interview for a new TMZ documentary. When contacted by CNN, a representative for Combs declined to elaborate on Agnifilo’s comments or say whether Combs will, in fact, take the stand. TEMPE, Arizona — Police are investigating what appears to be gunfire damage overnight at a Democratic Party-coordinated campaign office for Vice President Kamala Harris. The office is shared by staff for the Arizona Democratic Party, the Harris campaign, and Senate and House campaigns, to boost turnout for the party in November. “Overnight, several shots were fired into our Tempe Democratic Party coordinated campaign office,” McEnerney said. The coordinated campaign office in Tempe is one of 18 field offices for the Harris campaign in Arizona, according to Patty Socarras, the state Democratic Party's communications director. On Aug. 28, the Harris campaign held a campaign event in Tempe featuring Democratic Florida Rep. Maxwell Frost.

A federal judge denied Combs bail Wednesday saying the bail proposal set forth by his defense attorneys was “insufficient” in addressing the court’s concerns.
