Prosecutors on Tuesday are set to tell a judge whether they think the criminal hush money case against President-elect Donald Trump should head to sentencing, as planned, or be dismissed following his electoral victory, as his lawyers have requested. Those records related to a $130,000 payment his then-personal lawyer Michael Cohen made shortly before the 2016 election to porn star Stormy Daniels to buy her silence about a purported one-time sexual tryst with Trump a decade earlier. Judge Juan Merchan had been expected to rule on a dismissal request by Trump's lawyers on Nov. 12 at the earliest. But on the heels of Trump's election win, the DA's office told Merchan they wanted him to delay his ruling, to give them time to determine how that victory affected the case. Merchan gave them one week to do so.

Former President Donald Trump will not be sentenced in his New York criminal hush money case until after the Nov. 5 presidential election, a judge ruled Friday. The sentencing, which was set for Sept. 18, will instead take place on Nov. 26, Manhattan Supreme Court Judge Juan Merchan ruled. The Supreme Court's ruling had already spurred Merchan to delay Trump's sentencing, which was originally scheduled for July 11, by more than two months. The New York Court of Appeals in a brief decision declined to hear Trump's bid "upon the ground that no substantial constitutional question is directly involved." The decision means Trump's gag order, which bars him from speaking about jurors, witnesses and other parties involved in the Manhattan Supreme Court case, remains in effect. Trump's attorneys asked Judge Juan Merchan, who presided over the trial, to terminate the gag order because the trial is over. The Trump campaign and the lawyer who filed the gag order appeal to the state's top court did not immediately respond to CNBC's requests for comment.

A Georgia appeals court on Wednesday halted the criminal election case against Donald Trump in the state pending the outcome of his bid to disqualify the district attorney prosecuting the former president. The order by the Georgia Court of Appeals all but guarantees that Trump and eight co-defendants in the case will not stand trial before the November presidential election, where Trump is the presumptive Republican nominee. The appeals court said it would hear arguments on Oct. 4 on Trump's effort to boot Fulton County District Attorney Fani Willis from the case. The appeals court must rule on the question by March 14, 2025, according to the court's website. The appeals court order Wednesday halting the case also applies to Rudy Giuliani, David Shafer, Robert Cheeley, Michael Roman, Mark Meadows, Cathy Latham, Jeffrey Clark and Harrison Floyd.
