A Georgia appeals court on Monday canceled until further notice oral arguments on an effort by President-elect Donald Trump and other co-defendants to remove Fulton County District Attorney Fani Willis from the criminal election interference prosecution against them. The Georgia Court of Appeals acted on its own in canceling the arguments scheduled for Dec. 5. Trump and other defendants had appealed that ruling, and the Court of Appeals in June halted proceedings in the case pending the outcome of that effort. Circuit Court of Appeals to suspend proceedings in that case, citing Trump's election victory. That federal appeals court granted Smith's request.

Former President Donald Trump will not be sentenced in his New York criminal hush money case until after the Nov. 5 presidential election, a judge ruled Friday. The sentencing, which was set for Sept. 18, will instead take place on Nov. 26, Manhattan Supreme Court Judge Juan Merchan ruled. The Supreme Court's ruling had already spurred Merchan to delay Trump's sentencing, which was originally scheduled for July 11, by more than two months. Trump campaign spokesman Steven Cheung in a statement Friday said, "There should be no sentencing in the Manhattan DA's Election Interference Witch Hunt." "As mandated by the United States Supreme Court, this case, along with all of the other Harris - Biden Hoaxes, should be dismissed," Cheung said.

The New York Court of Appeals in a brief decision declined to hear Trump's bid "upon the ground that no substantial constitutional question is directly involved." The decision means Trump's gag order, which bars him from speaking about jurors, witnesses and other parties involved in the Manhattan Supreme Court case, remains in effect. Trump's attorneys asked Judge Juan Merchan, who presided over the trial, to terminate the gag order because the trial is over. The Manhattan District Attorney's Office asked Judge Juan Merchan to keep the gag order on Trump in place "at least through the sentencing hearing" for the former president next month, and "the resolution of any post-trial motions." Trump's lawyers earlier this week asked Merchan to vacate the gag order, arguing that the grounds for it no longer exist because the trial had concluded, with Trump being convicted on all 34 felony counts. But prosecutors in their new letter to Merchan said the gag order was "based not only on the need to avoid threats to the fairness of the trial itself ... but also on the Court's broader 'obligation to prevent actual harm to the integrity of the proceedings.' Last week prosecutors asked the judge to clarify or confirm whether the gag order issued earlier in the week including prohibiting Trump from making comments about family members. Last week, soon after the gag order stopping Trump from making statements about witnesses, jurors, prosecutors, court staff or the family members of prosecutors and court staff, Trump launched a series of posts on his social media platform. The gag order did not cover District Attorney Alvin Bragg or the judge. Trump said Merchan was “compromised” and he identified by name the judge’s daughter who works for a political consulting firm. A spokesman for the court said the judge’s daughter deactivated her account two years ago and the posts were not from her.
