New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed. The proposal Tuesday from Manhattan District Attorney Alvin Bragg's office would need to be signed off on by Judge Juan Merchan to become official. A ruling against Trump on the issue would have paved the way for the judge to proceed with his sentencing, which was tentatively scheduled for Nov. 26. That case has been paused while Trump and some of his co-defendants seek to have an appeals court remove Willis from the case for an alleged conflict of interest. Trump's lawyers have contended that even if she’s allowed to remain on the case, any Trump trial would have to wait until he’s out of office in 2029 because of constitutional issues.

CNN —Donald Trump’s lawyers and the Manhattan district attorney’s office have agreed to delay activity in the hush money case until November 19 to give the president-elect’s lawyers time to make new arguments on how his election victory impacts the case. Judge Juan Merchan was expected to rule Tuesday on whether to overturn the business fraud conviction based on this summer’s Supreme Court ruling on presidential immunity. “The stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump’s ability to govern,” Bove wrote. The Supreme Court’s immunity decision also indefinitely tied up Trump’s federal election subversion case in Washington, DC. CNN —Donald Trump urged the judge in his New York hush money case to dismiss his conviction in light of the Supreme Court’s ruling on presidential immunity last month, according to a new court filing. “In order to vindicate the Presidential immunity doctrine, and protect the interests implicated by its underpinnings, the jury’s verdicts must be vacated and the Indictment dismissed,” Trump’s attorneys wrote to Judge Juan Merchan. “Much of the unconstitutional official-acts evidence concerned actions taken pursuant to ‘core’ Executive power for which ‘absolute’ immunity applies.”The district attorney’s office declined to comment for this story. The district attorney’s office will respond later this month, and Merchan said he will decide the matter in September, with a potential sentencing scheduled on September 18, if necessary. The heated exchange between Trump’s attorney Todd Blanche and Cohen marked the biggest blow to the prosecution’s case so far. But the DA also must prove the actual business records crime, for which Trump has been charged with 34 counts of falsifying business records in the first degree. How I see it, Cohen’s testimony only satisfied half the equation beyond a reasonable doubt. Weisselberg could be the linchpin to validate Cohen’s claims about Trump agreeing to reimburse him through Trump Organization, as a business expense. If so, there would have been no intent to falsify the business records.
