☆ Marcellus Williams execution brings fresh scrutiny to Supreme Court’s death penalty approach

“The Supreme Court has a limited role to play death penalty cases,” said Paul Cassell, a University of Utah law professor who is representing a victim’s family in another death penalty case before the high court this year. Another involves an Alabama man who claims he is intellectually disabled and therefore ineligible for execution under Supreme Court precedent. The Supreme Court’s approach to death penalty appeals is “to correct severe misapplications of constitutional law by America’s state court systems,” said Seth Kretzer, a Texas attorney who has represented death row inmates at the Supreme Court. Alabama is appealing that decision to the Supreme Court and has been waiting more than year for an answer. In Oklahoma, Brenda Andrew faces the death penalty for the 2001 shooting death of her estranged husband.

Missouri is set Tuesday to execute Marcellus Williams, a death row inmate whose case has spurred several efforts to save his life amid doubts about the evidence presented at his 2001 murder trial and the actions of a trial lawyer in the case. The attorneys are asking for the court to either find that those actions violated Williams’ rights or have a lower court address those issues. A St. Louis County circuit judge and Gayle’s family also agreed to the deal, but state Attorney General Andrew Bailey, a Republican, opposed it, and the state Supreme Court agreed. A judge ultimately rejected the motion to vacate, a ruling Williams’ attorneys appealed to the state Supreme Court in the hearing Monday. In addition to the state Supreme Court appeal, Williams’ attorneys also have an appeal before the U.S. Supreme Court and a clemency request before Missouri Gov.

Around 100 demonstrators were present on the prison grounds protesting capital punishment and Williams’ execution, Pojmann said. Williams’ team filed a clemency petition to the US Supreme Court last week, noting Missouri’s previous governor had postponed Williams’ execution indefinitely amid questions about the integrity of Williams’ trial. Eric Greitens previously halted Williams’ execution and formed a board to investigate his case and determine whether he should be granted clemency. “The Board investigated Williams’ case for the next six years — until Governor Michael Parson abruptly terminated the process,” Williams’ attorneys wrote. “The Governor’s actions have violated Williams’ constitutional rights and created an exceptionally urgent need for the Court’s attention,” Williams’ attorneys said in court documents.

The St. Ann Police Department received a tip around 1 p.m. Tuesday through the Courage2Report tip line about a threat to Ritenour High School in St. Louis. Police found the teen sitting in a car in the parking lot of Husky Academy, about a mile away from the high school with a fully loaded gun. The video the teen posted to social media panned to show an unoccupied police vehicle parked next to the teen’s car. The teen, a former student with the Ritenour School District, was charged with first-degree terrorist threat, resisting arrest, and unlawful use of weapons. The chief said the police department has already investigated seven unsubstantiated school shooting threats since the beginning of the school year.

CNN —Rescuers are searching for two people in northern Minnesota who went missing after going over Curtain Falls in canoes, according to authorities. The St. Louis County Sheriff’s Office was dispatched to Iron Lake near the border of Canada at 7:21 p.m. Saturday, according to a news release. Two canoes had gone over Curtain Falls in the Boundary Waters Canoe Area, the sheriff’s office said. Shortly after midnight, a helicopter was used to rescue one injured person and one uninjured person, according to the sheriff’s office. CNN has reached out to the St. Louis County Sheriff’s Office for comment.

LOUIS (AP) — An off-duty St. Louis County officer accused of displaying his badge and firing into the air at a trick-or-treating event no longer is employed at the agency, a police spokesperson confirmed Monday. Matthew McCulloch was no longer working at the department as of Thursday, St. Louis County Police officer Adrian Washington said in an email. Washington declined to comment on whether McCulloch was fired or quit, describing it as a personnel matter. Police said McCulloch told multiple attendees that “you are all going to die,” according to the probable cause statement. McCulloch then shot into the air at least a dozen times “while shouting that all attendees would die,” police alleged.
