Speaker Mike Johnson on Sunday left the door open to adjourning Congress so President-elect Donald Trump can appoint his Cabinet nominees outside of the usual Senate confirmation process if necessary. Both chambers usually gavel in for pro forma sessions even during times of recess specifically to prevent the president from making recess appointments and bypassing congressional approval. President Barack Obama once tried to use recess appointments and was rebuked by the Supreme Court, which said in 2014 that recesses needed to be 10 days or longer for recess appointments to be legal. Johnson isn’t the only Trump ally who has left the door open to using a recess appointment to confirm Trump’s Cabinet picks. “I have literally not discussed one word about the ethics report, not once, and I’ve been with him quite a bit this week,” Johnson said.

Rather than face the humiliation of a rejection vote in the Senate, Cabinet nominees are more frequently withdrawn when it becomes clear they cannot be confirmed. Here’s a look at the Cabinet confirmation process, why it exists, where it’s gone wrong and how Trump wants to find a way around it. Presidents like Ronald Reagan, Clinton and both Bushes did use recess appointments, although usually for positions below the Cabinet level. While Democrats can no longer filibuster Cabinet nominees, they can slow the process down. Then, the Senate rejected Taney when Jackson put him forward for a Supreme Court nomination.

You can’t look this up in a law book and find an answer to the query because it doesn’t exist.”Previously, prosecutors have not objected to Trump’s bids to delay his sentencing before the election, which Judge Juan Merchan noted in agreeing to postpone Trump’s sentencing until late November. If Trump loses on immunity, his lawyers are expected to ask Merchan to delay Trump’s sentencing so they can appeal. Trump’s attorneys attempted this in 2023, and District Judge Alvin Hellerstein denied it. But following the Supreme Court ruling, Trump’s attorneys made a second attempt this summer. That was denied when Merchan agreed to postpone Trump’s sentencing.

And right now, the presidential campaigns’ dollars are talking about the “blue wall” — and about defining Kamala Harris. But there’s an equal amount of contrast spots, as well as positive ads telling the affirmative case for Harris. Pennsylvania is drawing far and away the most ad spending this month, from both parties. While Pennsylvania drew almost 20% of Democratic presidential ad spending and 11% of Republican spending over this period in 2020, it’s drawing more than a quarter of each party’s spending this year. Meanwhile, a longtime swing state, Iowa, has ceased to be a main battleground — with a resulting drop in ad spending.

Two days before his sentencing, Trump, they predict, will seek something never before allowed in the appellate courts in New York or in most states for that matter: an interlocutory appeal. AdvertisementEven Trump's Manhattan prosecutors are conceding that this is a legal monkey wrench to be reckoned with. "If New York's courts deny him a right to appeal, he can challenge the decision in federal court," said Paradis. If the federal district court in Manhattan says no, "he can appeal that to the second circuit federal court of appeals." More than in any other foreign arena, Vance has sought to echo Trump on the Ukraine war. In doing so, he emphasized the thick vein of “scarcity politics” that runs through his foreign policy, arguing that the U.S. can’t equip Ukraine with enough materiel to hold back an opponent as vast as Russia. Vance described Ukraine ceding territory to Vladimir Putin as being in “America’s best interest” while appearing more supportive than Trump of remaining in NATO. The foreign policy views of Pence, vice president when Trump was in office, while not loved by everyone, were at least “mature” — they were informed by several terms experiencing the consequences of foreign policy becoming reality, according to Daniel Kurtzer, a former U.S. ambassador to Israel and now a professor at Princeton. Vance, on the other hand, brings “no foreign policy experience, certainly no expertise,” Kurtzer says, and he will fall in behind his boss when needed.

In this week’s mammoth New York trial of former President Donald Trump on charges of falsifying business records in connection to hush money paid to an adult film star, the yawning gap between “Us” and “Them” is along partisan lines. After all, making hush money payments, as Trump is alleged to have done with former adult film actress Stormy Daniels, isn’t illegal. For decades, Trump has been a fixture on our airwaves, social media sites and political coverage. But they didn’t, and now many are feeling a rally-round-the-flag effect in what is likely the first and potentially only Trump criminal case that’s going to trial before Election Day. Bragg’s decision to bring this case, with its attenuated connection to an actual crime, can’t be taken out of its political context.

New York CNN —It took Donald Trump less than 24 hours to test the boundaries of Judge Juan Merchan’s gag order in his New York criminal trial. Inside the courtroom, Trump has been admonished and threatened with removal for being disruptive. Outside the courtroom, Trump has repeatedly railed against the charges he faces in front of cameras and attacked all of those involved on social media. Trump and Manhattan prosecutors are arguing over the scope of this week's hush-money gag order. AdvertisementLawyers for Donald Trump made an extraordinary request in his hush-money case on Friday: they want state Supreme Court Justice Juan Merchan to affirm that Tuesday's gag order lets Trump continue verbally attacking the judge's progressive daughter. Their motion, if allowed, would ask the judge to "direct that defendant immediately desist from attacks on family members." The next step in this battle over Trump's hush-money gag order is now in Merchan's court, so to speak. Alternately, he could expand or clarify the gag order to protect family members, and deny further motions on the topic.

CNN —Judge Arthur Engoron hit Donald Trump with his biggest punishment to date on Friday, in a ruling that fined the former president $355 million for fraudulently inflating the values of his properties. The high-stakes civil case strikes at the heart of Trump’s brand – his real estate empire. New York Attorney General Letitia James is suing Trump for $250 million and seeking to bar him from doing business in the state. Trump’s attacks in a vacuum weren’t particularly remarkable – he’s used the same barbs throughout the course of the trial, which he’s attended repeatedly as a spectator. Trump’s rhetoric prompts an angry response from the judgeEngoron tried at the outset of Trump’s testimony to stop the former president from making speeches and instead answer the questions, but it did little to change Trump’s approach. “There’s a disclaimer clause where you don’t have to get sued by the attorney general of New York,” Trump said.

NEW YORK (Reuters) -The judge overseeing Donald Trump’s civil fraud trial on Tuesday imposed a gag order - promising sanctions for any violations - after the former U.S. president used social media to lash out against the judge’s top law clerk. The trial could lead to the dismantling of Trump’s business empire as he seeks to regain the presidency in 2024. Engoron had ruled before the trial that Trump committed fraud, and canceled business certificates for companies that control crown jewels of Trump’s portfolio, including Trump Tower and 40 Wall Street in downtown Manhattan. The trial will review six additional claims including falsifying business records, insurance fraud and conspiracy, and address how much the defendants should pay in penalties. He also faces a January civil damages trial for defaming a writer who accused him of rape, which he denies.
