Elon Musk’s daily $1 million lottery for registered swing state voters who sign his super PAC’s petition falls into a legal gray area and could potentially violate election law, three experts told NBC News. Paying someone to vote or to register to vote is explicitly illegal under federal law. “This is at best very questionable legally,” said Michael Morse, an assistant professor of law at the University of Pennsylvania Carey Law School. But none of the experts who spoke with NBC News believed law enforcement is likely to stop the lottery or fine Musk before the election. “You can only register to vote in Pennsylvania until today.

The parent company of TikTok says it has dismissed an intern that it found to have "maliciously interfered" with its artificial intelligence technology effort. In a statement in Chinese released Monday, the parent company, ByteDance, said the intern in question had committed a "serious violation" against its commercial technology team's "research project." In particular, the intern's actions affected ByteDance's AI training program, the company said. In the AI world, companies attempt to program an AI application by "training" it on vast amounts of data to recognize patterns, understand context, and make decisions — in other words, "learn." It is not clear what aspect of the AI model the intern is accused of interfering with.

A highly anticipated legislative hearing began Monday but without its key witness: a Texas inmate whose execution for his daughter's "shaken baby" death was narrowly averted last week. The high court, however, said Sunday it would not rule on the manner in which Roberson must testify. Roberson, 57, has maintained his innocence in the 2002 death of his 2-year-old daughter, Nikki, based on "shaken baby syndrome." But hours later, Roberson said, he woke up and realized Nikki was not breathing and her lips looked blue. Wharton, the lead detective in the case, has also voiced his support for Roberson, telling House committee members at a hearing last week: "This is an innocent man, beyond question."

Billionaire tech mogul Elon Musk has forcefully ramped up his efforts to help re-elect former President Donald Trump, raising eyebrows across the political world and inviting questions about the legality of some of his tactics. Meanwhile, news reports have chronicled some of the issues facing America PAC, a political action committee funded by Musk to help boost Trump in the home stretch of the campaign. The two men rallied together earlier this month in Butler, Pennsylvania, where the former president survived an assassination attempt over the summer. The giveaway plan was met with immediate pushback from some election law experts. Rick Hasen, a law professor at UCLA and an NBC News election law analyst, wrote in a post on his website Saturday that the payments were “clearly illegal.”“Essentially what you’re doing is you are creating a lottery.

WASHINGTON — The Supreme Court on Monday rejected disbarred lawyer Michael Cohen’s last-ditch effort to revive a civil rights claim against his former boss Donald Trump. But constitutional claims against individual federal officials are notoriously difficult to bring as a result of a line of Supreme Court rulings. In a 2022 case called Egbert v. Boule, the Supreme Court effectively put “Bivens claims” on life support in a ruling that tossed out allegations against a Border Patrol agent. A federal judge in New York and the 2nd Circuit U.S. Court of Appeals both highlighted the Supreme Court’s recent ruling in throwing out Cohen’s claims. Unless Congress passes legislation to allow a form of Bivens claims, there are few legal avenues to seeking accountability when federal officials, including thousands of law enforcement officials, commit unlawful acts.

Jury selection begins Monday in the trial of Daniel Penny, a retired Marine charged in the deadly subway chokehold of Jordan Neely. A conviction for criminally negligent homicide would require the jury to find that Penny unjustifiably put Neely at risk of death, but failed to perceive that risk. Prosecutors have said the chokehold, which Penny held for several minutes, killed Neely, a 30-year-old homeless man and former Michael Jackson impersonator. Officers could be seen saying he had a faint pulse, and then shown giving him CPR about four minutes after they arrived. U.S. President Joe Biden speaks as he announces a new plan for federal student loan relief during a visit to Madison Area Technical College Truax Campus, in Madison, Wisconsin, U.S, April 8, 2024. Federal student loan payments for some 8 million borrowers will remain on pause for six months or longer, a spokesperson for the U.S. Department of Education said. The development on Monday comes as the administration has been dragged into a slew of legal battles waged by Republicans over its recent student loan relief efforts. The borrowers who are excused from their monthly payments are those enrolled in the Biden administration's new SAVE plan. Before the legal challenges, the Education Department had already forgiven $5.5 billion in student debt for 414,000 borrowers through the SAVE Plan.

The Supreme Court is visible on July 29, 2024 in Washington, DC. In an op-ed in The Washington Post, U.S. President Joe Biden laid out his proposed reforms to the Supreme Court including 18 year term limits for Supreme Court Justices and a new code of ethics for the court ahead of a speech tonight at the Lyndon B. Johnson Presidential Library in Austin, Texas. Lawyers for Democratic President Joe Biden's administration had urged the Supreme Court to turn away the appeal, arguing that the plaintiffs lacked the required legal standing to sue the agency and that their claims are foreclosed by Supreme Court precedent. The current Supreme Court, with a 6-3 conservative majority, has taken an expansive view of presidential powers in recent years and has shown skepticism toward broad authority for federal agencies. This case gives the conservative justices a chance to rein in or depart from Humphrey's Executor.
