Circuit Judge Reid Scott rejected Tesla's motion to summarily dismiss Kim Banner's lawsuit accusing the company of causing her husband Jeremy Banner's death in 2019.
In a 23-page ruling, Scott found that Kim Banner's attorneys presented sufficient evidence to let the case proceed to trial sometime next year.
But Scott agreed that Banner's attorneys had provided enough evidence for the case to proceed.
The board said Tesla's Autopilot should have safeguards that don't allow the system’s use on highways that have cross-traffic.
The car should also make certain drivers using Autopilot remain engaged with their hands on the wheel.
