CNN —Former President Donald Trump on Tuesday decried the gag order issued on him by the federal judge overseeing his federal 2020 election subversion case, claiming she “took away my right to speak.”“We’re being railroaded. I’m a candidate that’s running for office and I’m not allowed to speak,” Trump said, referring to the partial gag order issued Monday by US District Judge Tanya Chutkan. The gag order restricts Trump’s ability to publicly target court personnel, potential witnesses or special counsel Jack Smith and his staff. “This is not about whether I like the language Mr. Trump uses,” Chutkan said in court Monday as she announced the order. Tuesday’s proceedings in the New York civil fraud case will include more testimony from Donna Kidder, the Trump Organization’s assistant controller.

NEW YORK (AP) — Former President Donald Trump returns to a New York City courthouse Tuesday to be a spectator at the civil fraud trial threatening to disrupt his real estate empire. His appearance was initially supposed to coincide with testimony by Michael Cohen, his former attorney turned foe. But Cohen's planned appearance on the witness stand was delayed until at least next week, due to a health problem. Instead of Cohen, Trump's courtroom visit is likely to overlap with the resumption of testimony from his company's assistant controller, Donna Kidder. The trial concerns six remaining claims in the lawsuit, including allegations of conspiracy, insurance fraud and falsifying business records.

Fueled by a combination of strong winds and dry conditions – and complicated by the island’s geography – the fires have killed at least 36 people. Severe level drought conditions in Maui County ticked up to 16% from 5% last week, while statewide moderate drought levels jumped to 14% from 6%. Dried-out land and vegetation can fuel wildfires, which can swiftly turn deadly if strong winds help fan the flames toward communities. These winds coupled with low humidity levels produced "dangerous fire weather conditions” through Wednesday afternoon, the weather service said.

The charts suggest that breaking the December low in the S & P 500 around 3765 – down just 2.5% from here – would lose the bullish case a lot more credibility than has been surrendered so far. Of course, fears of contagion can outrun the facts and sometimes can become self-fulfilling, but the S & P 500 has (for now) simply backslid to a nine-week low. Jason Hunter, technical strategist at JP Morgan, had been expecting "a weakening corporate earnings environment would eventually take the narrative away from the Fed driven rates market. In the past week Apple shares lost about a third of what the S & P 500 did. Inflation has been at generational highs for two years as it was not then, and the labor market wasn't nearly as tight.

Ralph DeNunzio was chairman of the New York Stock Exchange and ran Kidder Peabody. Shortly after graduating from Princeton University in 1953, Ralph DeNunzio joined the Wall Street securities firm Kidder, Peabody & Co. and began a swift rise in the industry.
