Portrait of Andrew N. Ferguson Federal Trade Commission“At the FTC, we will end Big Tech’s vendetta against competition and free speech,” Ferguson posted to Xon Tuesday. Consolidation in tech makes it easier for governments to pressure social media companies to take down content, Ferguson told Missouri Republican Sen. Eric Schmitt. Schmitt, as the state’s attorney general in 2022, led a high-profile lawsuit about alleged social media censorship that wound up before the Supreme Court in its last term. Ferguson has weighed in on social media speech in other ways, too. In a June interview with the Mercatus Center, a libertarian think tank, Ferguson defended some initiatives spearheaded by Khan’s FTC.

Readers sometimes ask why we pay so much attention to regulatory agencies, and there are two answers. One is that someone in the press has to do it, and the other is because the administrative state is where most of the abuse in government is these days. See nearby for an example at the Federal Communications Commission, but another is what we’ve been reporting about the Federal Trade Commission under the unrestrained Chair Lina Khan . Republicans in the House are now shining a light on Ms. Khan, and there seem to be few limits on her agency’s willingness to use its power against those she dislikes.

Federal Trade Commission Chair Lina Khan is breaking sundry regulatory norms in her rush to remake modern antitrust law, as commissioner Christine Wilson details nearby in explaining her resignation. Ms. Khan’s norm-busting ironically may make the FTC more vulnerable to legal challenges that eventually weaken its powers. President Biden first broke political norms by installing Ms. Khan as FTC Chair immediately after the Senate confirmed her by a 69-28 vote to serve on the commission. It’s customary for a President when nominating members to independent agencies to announce at the same time if they will serve as chair. Mr. Biden didn’t.
