Behind the scenes, the conservative justice sought to put a thumb on the scale for states trying to restrict how social media companies filter content. The states enacted their laws in 2021 and, with variations, restricted the ability of social media platforms to filter third-party messages, videos and other content. Greg Abbott signed that state’s measure, he said, “there is a dangerous movement by social media companies to silence conservative viewpoints and ideas.” In Florida, Gov. Kagan added a footnote to her majority opinion buttressing that point and reinforcing Barrett’s view. But, despite Alito’s protest, Kagan had a majority signing her decision, which, at minimum, offers lower court judges a strong indication of the framework the high court majority would use in future online challenges.

It is a sign of the polarizing nature of the current Supreme Court that even knowledgeable critics of its opinions make diametrically opposed arguments. Justice Breyer’s criticism follows on the heels of that of another judge, Kevin Newsom of the U.S. Court of Appeals for the 11th Circuit. Such traditions, he warned, “have no demonstrable connection to the original, written text.”The current Supreme Court is the object of considerable controversy and confusion. Justice Breyer is right that the Constitution should be interpreted, in part, in light of practices that persisted after its ratification, but wrong to think that the current court is not doing this. Judge Newsom is right that the current court is doing this, but wrong to think that it should not be.

Judge Kevin Newsom, a Trump appointee, pushed back against the Fearless Fund's argument that the grants are protected by the First Amendment because they are charitable donations. He asked the Fearless Fund's attorneys whether the same protection would apply to a contest open only to white applicants. “I think that's a pretty simple yes or no,” Newsom said, interrupting when the attorney for the Fearless Fund, Jason Schwartz, started to reply. They’re saying, no, we want all the pie,” Ben Crump, a civil rights attorney who is also representing the Fearless Fund Fund, said a news conference following the hearing. But since the lawsuit was filed, the Fearless Fund has had trouble securing new investment, said co-founder Arian Simone.

May 2 (Reuters) - A lawyer for a Florida prosecutor on Tuesday urged a federal appeals court to reinstate his client after the state's Republican governor, Ron DeSantis, indefinitely suspended him over his pledge not to prosecute people seeking or providing abortions. "This governor punishes dissenting voices," David A. O'Neil, a lawyer for suspended prosecutor Andrew Warren, told a three-judge panel of the 11th U.S. Henry Whitaker, a lawyer in the Florida Attorney General's office representing DeSantis, said Warren was suspended for his conduct of refusing to enforce the law, not for his speech. Whitaker urged the court to uphold a January ruling in favor of DeSantis by U.S. District Judge Robert Hinkle. Warren, who won re-election in 2020 as the Hillsborough County state attorney, sued DeSantis last August.
