In the ballot litigation, Trump is appealing a decision from the Colorado Supreme Court in December that he incited the attack on the US Capitol as electoral votes were being counted in 2021. Arguments at the US Supreme Court last week focused less on whether there was an insurrection and more on technical questions about whether states may enforce the ban. A political fight over eligibility would likely be limited to Congress, but it could sweep the Supreme Court back into the thicket, as well. “Depending on just how horrendously ugly the situation could get, the court might feel compelled to become involved,” Foley said.

CNN —Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday. The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote. CNN —Most Americans want to see a verdict on the federal charges former President Donald Trump faces related to election subversion in 2020 before this year’s presidential election, according to a new CNN poll conducted by SSRS. About half of Americans, 48%, say it’s essential that a verdict is reached before the 2024 presidential election, and another 16% that they’d prefer to see one. Trump currently faces four separate criminal indictments, including federal charges related to his alleged efforts to overturn the results of the 2020 presidential election. Among those who see a pre-election verdict in the federal Trump election subversion case as essential, just 35% express trust in the Supreme Court on election-related cases. About half (48%) of Americans say they’d favor Trump attempting a mass deportation of undocumented immigrants and 39% that they’d favor repealing and replacing the ACA.

CNN —The inmate accused of attacking Derek Chauvin, the former police officer convicted in George Floyd’s killing, stabbed him approximately 22 times with an improvised knife in an attack the Arizona inmate had been contemplating for around a month, according to court documents. Turscak, who has been charged with attempted murder, told the corrections officers he would have killed Chauvin had they not responded so quickly, according to the complaint. A person familiar with the matter told CNN Chauvin was assaulted Friday at the Federal Correctional Institution in Tucson and was in stable condition. Minnesota Attorney General Keith Ellison, whose office prosecuted Chauvin in the George Floyd case, was notified that Chauvin was stabbed and is in stable condition, his office told CNN early Saturday.
