WASHINGTON — The Supreme Court could further weaken the power of federal agencies by agreeing on Friday to hear a dispute over a Federal Communications Commission program that requires companies to subsidize telecommunications services in underserved areas. The FCC case raises two interlinked issues, one of which concerns the broad question of whether Congress exceeded its powers. The FCC turned to the Supreme Court after the New Orleans-based 5th U.S. The Supreme Court earlier this year issued a series of rulings against federal agencies, including one overturning a 40-year-old precedent that gave leeway to agencies to interpret laws written ambiguously. Three of them serve on the Supreme Court.

WASHINGTON (AP) — The Supreme Court on Friday stepped into a major legal fight over the $8 billion a year the federal government spends to subsidize phone and internet services in schools, libraries and rural areas, in a new test of federal regulatory power. The justices had previously denied two appeals from Consumer Research after federal appeals courts upheld the program. Circuit Court of Appeals, among the nation’s most conservative, ruled 9-7 that the method of funding is unconstitutional. The last time the Supreme Court invoked what is known as the non-delegation doctrine to strike down a federal law was in 1935. But several conservative justices have suggested they are open to breathing new life into the legal doctrine.

The Texas Supreme Court has ruled against lawmakers who used their subpoena power to halt the execution of a death row inmate for his daughter’s “shaken baby” death, paving the way for it to proceed. "Categorically prioritizing a legislative subpoena over a scheduled execution, in other words, would become a potent legal tool that could be wielded not just to obtain necessary testimony but to forestall an execution," the Texas Supreme Court said in its ruling Friday. But the Office of the Attorney General quickly appealed the subpoena, which was supported by a district court judge's temporary injunction that halted Roberson's execution. After the state's highest criminal court agreed with the attorney general's office, allowing Roberson's execution to continue, lawmakers then petitioned their case to the Texas Supreme Court. "Given the overwhelming new evidence of innocence, we ask the State of Texas to refrain from setting a new execution date."

A coalition of parents attempting to block a state law that would require that the Ten Commandments be displayed in public school classrooms by next year have won a legal battle in federal court. At least 1,017 out LGBTQ candidates ran for election this year, a 1.1% increase compared with 2020, according to the LGBTQ+ Victory Fund, a political organization that tracks and supports LGBTQ candidates for elected office. The LGBTQ+ Victory Fund endorsed and tracked 477 of the LGBTQ candidates who made it to the general election. As of Friday afternoon, about three-quarters of those races had been called, with LGBTQ candidates having a success rate of approximately 80%. LGBTQ candidates won elections to at least 37 state legislatures this year, according to the LGBTQ+ Victory Fund, and several were historic firsts. “Having LGBTQ+ candidates in the halls of power will be paramount in helping to protect and uphold pro-equality values,” Meloy said.

Conservatives are prepared for Supreme Court retirements, with the most attention on Justice Samuel Alito, 74. GOP won't pursue Supreme Court ethics rulesTrump already transformed the federal courts in his first term, appointing 54 appeals court judges and 174 district court judges, many of whom are closely linked with the Federalist Society, a conservative legal group.
