CNN —The Justice Department sued Alabama on Friday over the state’s recent effort to remove more than 3,000 names from its voter rolls, arguing the move violated federal law prohibiting such action from taking place too close to an election. But in an 18-page lawsuit filed in federal court in Alabama, the Justice Department argued that the so-called voter roll purge ran afoul of the National Voter Registration Act, which governs how and when most states can execute large-scale changes to their lists of registered voters. Nonpartisan election law experts say it’s almost always caught when it does happen, and that it isn’t a widespread problem plaguing US elections. The new lawsuit expands the legal fight against Alabama’s actions, which had been challenged earlier this month by voters in the state, including several impacted by the purge. “I was elected Secretary of State by the people of Alabama, and it is my Constitutional duty to ensure that only American citizens vote in our elections,” Allen said.

Certain groups have been advocating for fetal personhood for decades, she said. So instead, fetal personhood was indirectly written into other areas of law, with a particular focus on advocating for prosecutions of pregnant women. “The goal was not just to have these individual people go to prison, it was meant to set a precedent about what fetal rights look like,” she said. Prosecutors have already charged Ryan Wesley Routh with two firearms offenses, and a federal magistrate judge on Monday ordered him detained pending further court proceedings. The attempted assassination charge is “pretty rare,” according to former FBI Deputy Director Andrew McCabe, a CNN senior law enforcement analyst. But it has been used in other high-profile attempted assassination cases, such as that of a man charged with traveling to Brett Kavanaugh’s Maryland home with a gun, burglary tools and other equipment in an apparent attempt on the Supreme Court justice’s life. To prove their case, prosecutors would have to convince a jury that Routh took affirmative steps to carry out a plot to kill the former president. Ron DeSantis said last week that the state “will be conducting its own investigation regarding the attempted assassination at Trump International Golf Club.” Routh has not been charged in state court.

That’s why Maricopa County has spent over $864,000 in federal funds and more than $3 million in county funds to bolster its election security and processes over the past four years. Officials readily shared their worries with CNN, citing death threats, harassment, baseless lawsuits, onerous public-records requests and various security threats spurred by false claims about voter fraud. Amid these challenges, budgets for election security have been squeezed in several ways. “The Devil,” a U.S. fugitive who was featured on “America’s Most Wanted,” has been captured in Mexico, the United States Marshals Service said. Antonio Riano, 62, was arrested Thursday in his hometown of Zapotitlan Palmas, State of Oaxaca, Mexico, officials said, where he was found to be working an ironic job. “When Riano was arrested in Mexico he was found to be working as a local police officer,” the agency said in a press release on Thursday. Afterwards, he fled the United States allegedly to avoid prosecution. After being captured, Riano was flown from Mexico City to Cincinnati, then transported to the Butler County Jail.

The pardon won’t automatically change the record of convicted veterans, but it will allow them to apply for a certificate that will help them receive withheld benefits. “Our nation’s service members stand on the frontlines of freedom, and risk their lives in order to defend our country. Despite their courage and great sacrifice, thousands of LGBTQI+ service members were forced out of the military because of their sexual orientation or gender identity,” Biden said. A service member’s discharge status can determine what Veterans Affairs benefits they are eligible for. To get their records changed under the pardon, veterans will need to complete an online application, which will go to their military service department.

CNN —President Joe Biden is expected to pardon US veterans who were convicted by the military over a 60-year period under a military law that banned gay sex, three US officials told CNN. The granting of pardons won’t automatically change convicted veterans’ records but allows those impacted to apply for a certificate of pardon that will help them receive withheld benefits. A service member’s discharge status can determine what kind of Veterans Affairs benefits they are eligible for. “For decades, our LGBTQ+ service members were forced to hide or were prevented from serving altogether,” Defense Secretary Lloyd Austin said at the time. If a certificate of pardon is issued, the service member will then have to apply to their respective military department’s board of corrections to have their military records corrected.

Justice Clarence Thomas never disclosed three trips aboard the private jet of the Texas billionaire Harlan Crow, according to documents obtained by the Senate Judiciary Committee. The documents, obtained by Democrats on the panel, list three visits that have not been previously been reported: one to a city in Montana, near Glacier National Park, in 2017; another to his hometown, Savannah, Ga., in March 2019; and another to Northern California in 2021. The purpose of each trip was not immediately clear, nor was the reason for their omission on the justice’s disclosure forms. However, all of the flights involve short stays: two were round trips that did not include an overnight stay. The revelation underlined the extent to which Justice Thomas has relied on the generosity of his friends over the years and the consistency with which he declined to report those ties.

Alito Jr.’s wife, Martha-Ann, recently told a woman posing as a conservative supporter that she wanted to fly a Catholic flag at the couple’s Virginia home in response to a Pride flag in her neighborhood. “You know what I want?” the justice’s wife said to the woman, Lauren Windsor, who secretly recorded the conversation during a black-tie event last week at the Supreme Court. “I want a Sacred Heart of Jesus flag because I have to look across the lagoon at the Pride flag for the next month.”But Ms. Alito said that after she suggested the Sacred Heart of Jesus flag as a retort to the symbol for L.G.B.T.Q. rights, her husband said, “Oh, please, don’t put up a flag.”She said that she had agreed, for now, but that she had told him that “when you are free of this nonsense,” “I’m putting it up and I’m going to send them a message every day, maybe every week. At about 10:30 a.m. on Wednesday, a federal prosecutor, Derek Hines, brandished the headliner in question — Mr. Biden’s notorious laptop, a silver Apple MacBook Pro encased in a plastic cover. He waggled it about with his left hand while reminding a government witness, Erika Jensen, an F.B.I. special agent, of all the data that had been seized during the Department of Justice’s investigation of Mr. Biden. The jurors and courtroom spectators gazed at government Exhibit 16 as if expecting sparks to fly from it. Three seconds later, Mr. Hines returned the laptop to the prosecutors’ table, soon to be buried under a heap of other government evidence.

Cannon is planning on holding a sprawling hearing on Trump’s request to declare Jack Smith’s appointment as special counsel invalid, signaling she could be more willing than any other trial judge to veto the special prosecutor’s authority. Wednesday, Cannon went further, adding a hearing on a gag order request from prosecutors to limit Trump’s rhetoric about law enforcement and allotting more time to hear arguments on the special counsel issue. Cannon’s signal of willingness to entertain challenges to the special counsel comes in the same week Republicans are bearing down on Attorney General Merrick Garland for his use of special counsels. A third group says the Department of Justice’s use of a special counsel should be upheld. Cannon still agreed to the hearing Trump wanted.

CNN —Chief Justice John Roberts on Thursday rejected a meeting request from Democratic lawmakers who wanted to discuss two provocative flags hoisted at Justice Samuel Alito’s properties. “Separation of powers concerns and the importance of preserving judicial independence counsel against such appearances,” Roberts wrote in a letter released by the Supreme Court. “My wife is fond of flying flags,” Alito wrote. The Supreme Court is considering two appeals tied to the 2020 election and the attack on the US Capitol. Whitehouse posted on social media that “the work must continue” until the Supreme Court applies “honest fact-finding and neutral decision-making” to itself.

Chief Justice John G. Roberts Jr. on Thursday declined requests to have Justice Samuel A. Alito Jr. recuse himself from cases related to the Jan. 6 Capitol attack after provocative flags flew on the justice’s properties. I won’t even opine whether my flying the flag upside-down flag at my house would have constituted a violation of the Code of Ethics that binds me and all federal judges — except the justices. The fact is that, regardless of its legality, displaying the flag in that way, at that time, shouldn’t have happened. To put it bluntly, any judge with reasonable ethical instincts would have realized immediately that flying the flag then and in that way was improper. The same goes with the flying of an “Appeal to Heaven” flag at Justice Alito’s vacation house along the New Jersey shore. Like the upside-down flag, this flag is viewed by a great many people as a banner of allegiance on partisan issues that are, or could be, before the court.
