NEW ORLEANS — Louisiana’s plan to make all of the state’s public school classrooms post the Ten Commandments next year remains on hold under an order Wednesday by a federal appeals court in New Orleans. The state contends that deGravelles’ order affects only the five school districts that are defendants in a legal challenge. Jeff Landry signed the bill into law in June, prompting a group of Louisiana public school parents of different faiths to sue. Murrill, the Republican attorney general, has said she disagreed with deGravelles’ ruling and that the law is constitutional under Supreme Court precedents. In recent years, similar bills requiring the Ten Commandments to be displayed in classrooms have been proposed in states including Texas, Oklahoma and Utah.

Donald Trump's attorneys are demanding the judge who presided over his New York hush money trial and conviction immediately throw out the case, saying it would be "uniquely destabilizing to the country" otherwise. The letter also cited presidential immunity as a reason to dismiss the case, and maintained Trump is already protected by it. "Just as a sitting President is completely immune from any criminal process, so too is President Trump as President-elect," the letter said. The attorneys have argued he can't be sentenced while in office because it would interfere with his constitutional duties. Trump was convicted earlier this year on 34 counts of falsifying business records related to a hush money payment made to adult film actor Stormy Daniels.

New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed. The proposal Tuesday from Manhattan District Attorney Alvin Bragg's office would need to be signed off on by Judge Juan Merchan to become official. A ruling against Trump on the issue would have paved the way for the judge to proceed with his sentencing, which was tentatively scheduled for Nov. 26. That case has been paused while Trump and some of his co-defendants seek to have an appeals court remove Willis from the case for an alleged conflict of interest. Trump's lawyers have contended that even if she’s allowed to remain on the case, any Trump trial would have to wait until he’s out of office in 2029 because of constitutional issues.

Prosecutors on Tuesday are set to tell a judge whether they think the criminal hush money case against President-elect Donald Trump should head to sentencing, as planned, or be dismissed following his electoral victory, as his lawyers have requested. Those records related to a $130,000 payment his then-personal lawyer Michael Cohen made shortly before the 2016 election to porn star Stormy Daniels to buy her silence about a purported one-time sexual tryst with Trump a decade earlier. Judge Juan Merchan had been expected to rule on a dismissal request by Trump's lawyers on Nov. 12 at the earliest. But on the heels of Trump's election win, the DA's office told Merchan they wanted him to delay his ruling, to give them time to determine how that victory affected the case. Merchan gave them one week to do so.

WASHINGTON — An ex-Army soldier who was previously court-martialed for shooting a handcuffed Iraqi civilian was sentenced to over four years in federal prison on Monday for assaulting officers during the Jan. 6 attack on the U.S. Capitol. Richmond was sentenced to 51 months in federal prison after he pleaded guilty earlier this year to a felony count of assaulting, resisting or impeding an officer with a deadly weapon. Both the prosecution and defense agreed that Richmond's sentencing guidelines were between 51 and 63 months in federal prison. Another Jan. 6 rioter, Christopher Maurer, was sentenced to 50 months in prison on Monday after pleading guilty earlier this year to assaulting, resisting, or impeding officers with a deadly or dangerous weapon. Prosecutors say Indian national Harshkumar Ramanlal Patel, 29, ran part of the scheme and recruited Steve Shand, 50, of Florida, to shuttle migrants across the border. Prosecutors say when Jagdish Patel’s body was found, he was holding Dharmik, who was wrapped in a blanket. Patel is a common Indian surname and the victims were not related to Harshkumar Patel. The U.S. Border Patrol arrested more than 14,000 Indians on the Canadian border in the year ending this Sept. 30. President-elect Donald Trump said Thursday he will nominate Todd Blanche, one of his criminal defense lawyers, to be deputy attorney general. The statement noted that Blanche has experience working for the Justice Department — something former Rep. Matt Gaetz, R-Fla., Trump's choice for attorney general, does not have. Blanche was Trump's lead lawyer when he stood trial on charges of falsifying business records related to a hush money payment this year. If Blanche's nomination is confirmed before Gaetz's, he could serve as acting attorney general while Gaetz goes through the process. He will also nominate D. A coalition of parents attempting to block a state law that would require that the Ten Commandments be displayed in public school classrooms by next year have won a legal battle in federal court. The judge wrote that the law is "facially unconstitutional" and "in all applications," barring Louisiana from enforcing it and adopting rules around it that require all public K-12 schools and colleges to exhibit posters of the Ten Commandments. We've shown that in our briefs by creating a number of posters," Murrill told reporters. The displays included historical context for the commandments that the state believes makes its law constitutional. When asked what he would tell parents concerned about having the Ten Commandments in public schools, Landry said in August: "Tell your child not to look at them."

Judge Juan Merchan was expected to rule Tuesday on whether to overturn the business fraud conviction based on this summer’s Supreme Court ruling on presidential immunity. “The stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump’s ability to govern,” Bove wrote. Trump’s legal team, meanwhile, is evaluating its next steps for how to get all four criminal cases resolved, and plan to argue soon that all of the cases “must stop immediately,” according to a source directly involved in the discussions. Since it is a state case, Trump does not have the power to pardon himself next year after he is sworn into office. SAN DIEGO — Former military defense contractor Leonard “Fat Leonard” Francis was sentenced Tuesday to 15 years in prison for masterminding a decade-long bribery scheme that swept up dozens of U.S. Navy officers, federal prosecutors said. The Malaysian defense contractor was a key contact for U.S. Navy ships at ports across Asia for more than two decades. He pleaded guilty in 2015, admitting that he had offered more than $500,000 in cash bribes to Navy officials, defense contractors and others. While awaiting sentencing, Francis was hospitalized and treated for renal cancer and other medical issues. The felony convictions of four former Navy officers were vacated following allegations of prosecutorial misconduct.

San Diego AP —Former military defense contractor Leonard “Fat Leonard” Francis was sentenced Tuesday to 15 years in prison for masterminding a decade-long bribery scheme that swept up dozens of U.S. Navy officers, federal prosecutors said. The Malaysian defense contractor was a key contact for U.S. Navy ships at ports across Asia for more than two decades. He pleaded guilty in 2015, admitting that he had offered more than $500,000 in cash bribes to Navy officials, defense contractors and others. While awaiting sentencing, Francis was hospitalized and treated for renal cancer and other medical issues. The felony convictions of four former Navy officers were vacated following allegations of prosecutorial misconduct.
