Elon Musk's controversial $1 million-a-day swing state sweepstakes was never a lottery, a Philadelphia judge said in a written decision explaining why he declined to shut the program down after a hearing last Monday. Lotteries require a prize, a payment for a chance to win that prize, and for winners to be chosen at random, the judge said. Representatives for Krasner, Musk, and the PAC did not immediately respond to requests for comment on the judge's decision and next steps in the case.

PHILADELPHIA — Elon Musk’s legal team filed court papers that delayed a potential ruling on a lawsuit over his super PAC's $1 million lottery-style giveaways. The federal court filing automatically blocked any immediate action in state court, where Judge Angelo Foglietta had already scheduled Thursday’s hearing. Summers said he planned to argue in federal court to have the case returned to state court. “We will proceed to federal court, and we will address the issues there and seek to have the matter remanded back to the state court,” he told reporters outside the state courtroom Thursday. “Let’s be serious.”“If anyone could land a rocket ship in Philadelphia, it’s Elon Musk,” Summers replied.

Philadelphia CNN —Tech billionaire and Trump ally Elon Musk is trying to move a lawsuit over his $1 million giveaway to voters into federal court, short-circuiting a required appearance Thursday at a Pennsylvania court. Lawyers for the Tesla CEO filed a “motion of removal” in federal court late Wednesday night. The parties will now continue pressing their case in federal court. Foglietta said he’s available later Thursday or Friday if the federal judge sends the case back to state court. Musk endorsed Trump in July and has donated $118 million to his super PAC.
