AdvertisementGetting accepted is just the startThe Manhattan mental health court is one path available to those who plead guilty to felonies. Related storiesMerchan is the sole judge of the mental health court in all of Manhattan, and has presided over it since its founding in 2011. If the office allows it, a mental health court treatment plan can become part of their plea agreement, which includes different consequences for failures. "It's really hard, a huge burden to even get so far as to be accepted into mental health court," said Orlins. If you fail the mental health court program in such a dramatic fashion, the next step can be a sentencing hearing.

But while the former president has been uncharacteristically restrained recently, a cast of Republican lawmakers and Trump surrogates have traveled to court to rail about the proceedings. It's raised questions about whether the "surrogates" could be violating Trump's gag order. Sen. Tommy Tuberville of Alabama, who has been floated as a potential VP pick, told Newsmax one reason he attended was to "overcome this gag order." Under the gag order, Trump is not allowed to comment about Cohen. But Neama Rahmani, a former federal prosecutor, told BI that "practically speaking," Judge Merchan can do little to stop lawmakers from speaking on Trump's behalf.

Former President Donald Trump has run out of legal options to delay Monday's start of his Manhattan hush-money trial, legal experts predict. Trump's lawyers struck out 0-3 this week, when three Manhattan appellate judges rejected three separate emergency delay bids during arguments on Monday, on Tuesday, and Wednesday. Barring an unforeseen, nonlegal emergency, jury selection in Trump's first of four criminal cases will begin as scheduled on Monday morning in Supreme Court in lower Manhattan, experts said. Ditto the US Supreme Court, where Trump could ultimately end up, given that all three appellate efforts raise Constitutional issues, Schechtman said. Trump struck out 0-3 during three visits this week to a Manhattan appellate courthouse. Former President Donald Trump has run out of legal options to delay Monday's start of his Manhattan hush-money trial, legal experts predict. Barring an unforeseen, nonlegal emergency, jury selection in Trump's first of four criminal cases will begin as scheduled on Monday morning in the Supreme Court in lower Manhattan, legal experts say. But even if Trump wins — and that's a long shot — it's highly unlikely any of these three appellate decisions would stop or even pause the trial, legal experts also say. Ditto the US Supreme Court, where Trump could ultimately end up, given that all three appellate efforts raise Constitutional issues, Shechtman said.

Donald Trump's "extreme and deliberate provocations" in his hush money trial are aimed to undermine the case, the Manhattan district attorney said Monday as he urged a judge to strengthen a gag order on the former president. Alvin Bragg said in a blistering filing in New York Supreme Court. Bragg's request came after Trump, in numerous social media posts, targeted Judge Juan Merchan's adult daughter over her work for a Democratic political firm. Merchan last week imposed a gag order that bars Trump from speaking about likely witnesses and other figures, but does not explicitly prohibit criticism of the judge or his family. Bragg's office asked the judge on Thursday to "clarify or confirm" that the order protects the court's family.

Read previewAdult film actor Stormy Daniels drops so many bombshells in the smart, surprisingly moving documentary, "Stormy," that it's no wonder former President Donald Trump's "hush money" case lawyers are now raging against it. 'Unacceptable'"Extraordinarily prejudicial," Trump's lawyers called the film in defense filings made public this week. There is also their client to consider, Trump's lawyers said, in the delay request made public Thursday. Trump's lawyers are meanwhile asking that Daniels — given name Stephanie Clifford — be barred from testifying at the hush-money trial. A still from the Peacock documentary, "Stormy."

On Friday, Trump, who was not charged in his company's case, lashed out at Merchan on his Truth Social platform. "The Judge 'assigned' to my Witch Hunt Case, a 'Case' that has NEVER BEEN CHARGED BEFORE, HATES ME," wrote Trump, who has launched a campaign to regain the presidency in 2024. Merchan has been a Manhattan criminal court judge since 2009 after prior stints on the state's Court of Claims, which hears cases against the state and its agencies, and family court in the Bronx. Merchan presided over the 2012 case of the so-called "Soccer Mom Madam" Anna Gristina, which garnered lurid headlines in the New York media. Gristina sued Merchan in 2021 to unseal records in her case as part of an effort to vacate her record.
The Manhattan district attorney's office last year charged the Trump Organization and Allen Weisselberg, its then-chief financial officer, with awarding "off the books" benefits to some senior executives, enabling certain employees to understate their taxable compensation and the company to evade payroll taxes. Weisselberg in August pleaded guilty to charges including grand larceny and tax fraud while admitting to concealing $1.76 million in income. Justice Juan Merchan, the judge overseeing the trial in a New York state court, said he was closely observing the prospective jurors and disagreed with van der Veen. "I can appreciate that in your opinion the other jurors were visibly chilled," Merchan said, addressing van der Veen. Prosecutors and defense lawyers later on Tuesday were expected to begin questioning the 18 prospective jurors, the next step in what is expected to be a weeklong process to seat a 12-member panel.
