2 seed San Jose State lost to No. 1 seed Colorado State in the Mountain West Conference volleyball final on Saturday at the Cox Pavilion in Las Vegas amid an ongoing gender controversy surrounding a Spartans player. With the loss, San Jose State’s chance of making the tournament takes a hit. The dispute continued as several athletes from various schools in the conference filed a federal lawsuit earlier this month seeking to stop a San Jose State player from competing in championship games. Neither the player in question nor San Jose State University have commented publicly on the player’s gender.

It would be another 12 years before the NCAA made a major revision to its rules on transgender athletes. The Independent Council on Women’s Sports is financing a class-action lawsuit against the NCAA over its policy on transgender women athletes. Those pushing for acceptance of trans athletes in competitive sports argue there is no evidence showing transgender women have an advantage. But the rules of World Aquatics bar transgender athletes from competition unless they have not experienced biological puberty. And like cisgender athletes, trans athlete’s abilities vary.

A federal judge ruled Monday that a volleyball player for the San Jose State University women's team, who is at the center of controversy about transgender athletes, can compete in this week's conference tournament. Judge S. Kato Crews, with the U.S. District Court for the District of Colorado, denied the emergency motion for a preliminary injunction filed this month against the Mountain West Conference. "San José State University will continue to support its student-athletes and reject discrimination in all forms," the university said said. "All San José State University student-athletes are eligible to participate in their sports under NCAA and Mountain West Conference rules." The Mountain West Conference has said it is taking the suit’s allegations seriously.

A transgender volleyball player at San Jose State University can continue to compete on the women’s team, a judge ruled Monday, despite complaints from other players who object to the participation of an athlete who is transgender. It is the latest chapter in the fierce national debate about whether transgender athletes, particularly transgender women, should be allowed to compete on teams that align with their gender identity. Players for other colleges in San Jose State’s conference, the Mountain West, had filed a lawsuit seeking to bar the player from competition. They were joined by some people affiliated with San Jose State, including a current co-captain of the team, former players and a recently suspended assistant coach. The plaintiffs argued that allowing the player to participate in the tournament would discriminate against women by denying them equal opportunities.

A group of more than a dozen Republican lawmakers is urging a collegiate athletic conference to ban transgender women from competition after reports of a trans student competing on the s women’s volleyball team of a participating university. “Under these guidelines, it is only fair that biological males play men’s sports and biological females play women’s sports.”“Clearly, the Mountain West Conference has dropped the ball,” it continues. In September, SJSU volleyball player Brooke Slusser joined a lawsuit filed by more than a dozen women athletes against the NCAA, which oversees collegiate athletics, about trans athletes’ participation in school sports. The lawsuit argues that the NCAA violated the Title IX rights of cisgender female athletes by allowing transgender women to compete against them. Just last week, Slusser and 10 other former and current athletes in the Mountain West Conference filed a separate lawsuit against the conference and three SJSU staffers, accusing them of violating players’ Title IX rights.

“It’s disappointing it’s come to this point,” she said, calling it a "failure at every level of leadership.”The Mountain West Conference said it is taking the suit’s allegations seriously. “The Mountain West Conference prioritizes the best interests of our student-athletes and takes great care to adhere to NCAA and MW policies,” the conference said in a statement to NBC Bay Area. Already, four teams in the Mountain West Conference — University of Nevada, Reno; University of Wyoming; Boise State University; and Utah State University — have forfeited games against the SJSU Spartans. Separately, Southern Utah University, which is not in the Mountain West Conference, forfeited a match. A member of the Spartans volleyball team joined the suit last month, claiming that having a transgender teammate is unsafe for her, her teammates, and opposing teams.

One member of the women’s volleyball team at San Jose State University has signed on to being part of a federal lawsuit against the NCAA challenging the presence of transgender athletes in women’s college sports. As with other points of dispute in the struggle over gender identity and transgender rights, one thing opposing sides have in common is framing their stance as a matter of what’s fair and right. This political and cultural backdrop makes the attention surrounding the SJSU situation more understandable. Anawalt echoes such an idea — that a resolution to the “fairness” question is muddy, elusive and perhaps ultimately unanswerable. And so where do you draw the bright white line in terms of what’s fair and what’s not fair?”

Las Vegas AP —Mountain West Conference Commissioner Gloria Nevarez said Thursday the forfeitures that volleyball teams are willing to take to avoid playing San Jose State is “not what we celebrate in college athletics” and that she is heartbroken over what has transpired this season surrounding the Spartans and their opponents. Four teams have canceled games against San Jose State: Boise State, Southern Utah, Utah State and Wyoming, with none of the schools explicitly saying why they were forfeiting. You just don’t let it happen.”After Trump’s comment, San Diego State issued a statement that said “it has been incorrectly reported that an San Diego State University student-athlete was hit in the face with a volleyball during match play with San Jose State University. “We’re a volleyball team that wants to compete and get better,” he said after Thursday night’s loss in Albuquerque, New Mexico. Nevada released a statement acknowledging that “a majority of the Wolf Pack women’s volleyball team” had decided to forfeit against San Jose State.

A fourth university has forfeited its women’s volleyball match against San José State University following controversy over the gender identity of one of the team’s players. In the lawsuit, Slusser says the teammate who was the subject of the media coverage told her she was a trans woman. Tony Hoang, the executive director of Equality California, said that in forfeiting matches against SJSU, school administrators are harming all students involved. The Republican governors of both Utah and Idaho publicly supported decisions by Southern Utah University, Utah State University and Boise State University to cancel their matches against SJSU. Previously, trans athletes’ participation in sports was regulated by state sports associations, school districts and, in college athletics, the NCAA.

Spruce Pine, North Carolina has no running water or electricity, more than a week after Helene ripped through the town of 2,200. Mines in Spruce Pine produce the world’s purest form of quartz, which plays a central role in chip manufacturing. Now, the town’s exceedingly valuable supply of high-purity quartz is at risk, threatening to cripple the $600 billion global semiconductor industry. “The Spruce Pine community has been hit particularly hard,” Sibelco said in a statement on Sept. 30. For the semiconductor industry, the challenges that any long-term disruption to the Spruce Pine mines would present cannot be overstated, experts say.

Yoshihiro Uchida, the longtime San Jose State University coach who helped establish judo as one of the most popular martial arts in America — and who was widely regarded as the best college judo coach in history — died on June 27 at his home in Saratoga, Calif. The son of Japanese immigrants, Uchida, who went by the nickname Yosh, began coaching judo at San Jose State in the 1940s, while he was still a student there. Americans had long incorporated elements of judo into other combat sports, and returning soldiers from the Pacific Theater brought a new level of interest in martial arts to the country. Uchida, who had been practicing judo since he was 10, despaired over the quality of the training available, especially at the higher levels. Working with a judo coach at the University of California, Berkeley, he established standards for competition, including weight classes, and in 1953 won approval from the Amateur Athletic Union.

New York CNN —The Internal Revenue Service has good news for millions of taxpayers in 17 states who received a one-time special state payment last year to offset inflation and other negative economic impacts: Those payments won’t be subject to federal income tax. Prior to the conclusion of its review of state special payments, the agency had suggested recipients hold off on filing their 2022 returns until it made its determination. The IRS decision regarding the federal taxability of special state payments for residents of other states is a little more nuanced. On your 2021 federal tax return, you either claimed the standard deduction, or you itemized. So the amounts that potentially are subject to federal income tax may not be large.
Millions of taxpayers in other states got different types of special payments from their state governments as well — such as income or property tax rebates. In the meantime, the agency advises filers who received special state payments to hold off on filing their returns until guidance is issued. “The best course of action is to wait for additional clarification on state payments rather than calling the IRS,” the agency said. Keep in mind, each state issued special payments for different reasons (e.g., inflation relief, surplus revenue rebates, disaster relief, etc.). So the amounts that potentially are subject to federal income tax may not be large,

Voters in states from across the political spectrum chose to enshrine abortion rights on Tuesday, a major victory for reproductive rights advocates in the first national election since the fall of Roe v. Wade in June. While the amendment’s defeat will not change whether Kentucky residents have abortion access if the state Supreme Court continues to allow a ban that is currently being challenged, abortion rights advocates were thrilled by voters’ support. Meanwhile, voters in two Democratic states, California and Vermont, chose to officially protect abortion rights in their constitutions. Democrats said they care most about abortion rights, while Republicans said their biggest concern was inflation, according to the poll. “Until there’s a new federal right, state constitutions are really the best avenue to ensure reproductive rights and abortion rights in any given state,” she said.
