Rather than face the humiliation of a rejection vote in the Senate, Cabinet nominees are more frequently withdrawn when it becomes clear they cannot be confirmed. Here’s a look at the Cabinet confirmation process, why it exists, where it’s gone wrong and how Trump wants to find a way around it. Presidents like Ronald Reagan, Clinton and both Bushes did use recess appointments, although usually for positions below the Cabinet level. John Cornyn, a member of the Senate Judiciary Committee, said he “absolutely” wants to see the House Ethics Committee’s findings on Gaetz. “I think there should not be any limitations on the Senate Judiciary Committee’s investigation, including whatever the House Ethics Committee has generated,” he said. Trump has pushed to keep all options on the table to greenlight his nominees, including recess appointments, which would bypass the typical Senate confirmation process. However, Sen. Rick Scott told CNN, “I believe in recess appointments.” Scott had supported recess appointments during his bid for GOP leader, which he lost to Thune. The Supreme Court has ruled on questions about recess appointments, which makes the outcome of taking these questions to court uncertain.

The three-way fight to replace outgoing Senate Republican leader Mitch McConnell, R-Ky., pits Senate Minority Whip John Thune, R-S.D., against Sen. Pennsylvania's hotly contested Senate race hangs in the balance nearly a week after Election Day, with Republicans declaring victory and Democrats holding out hope that the remaining batch of outstanding ballots will allow them to close the gap. A McCormick victory would further pad Republicans' newfound majority in the Senate, where they will hold at least 52 seats after the election. But even before the new Congress is sworn in next January, the outcome of the Pennsylvania race could have implications for the Senate leadership elections Wednesday. Pennsylvanians can cast provisional ballots when officials are unclear about their eligibility or there were issues with their returned mail-in ballots. McCormick’s campaign filed two lawsuits Friday challenging an estimated 15,000 to 20,000 provisional ballots in Philadelphia that may have issues, such as missing signatures.
