Harvey Weinstein’s attorneys have submitted a filing opposing a move by prosecutors to combine two sexual crimes cases against the disgraced film mogul. Manhattan prosecutors have sought to consolidate new charges with ones previously brought against Weinstein so that they could be tried in court together. But in a court document, a response to the prosecutors' motion to consolidate cases filed Oct. 2, the Oscar-winning producer’s lawyers accused the district attorney’s office of acting improperly and unfairly. Bragg’s office signaled that it would seek to link the two cases together ahead of Weinstein’s retrial. Samson says prosecutors say they won’t be ready in time and want to move the trial to January.

Harvey Weinstein was arraigned on an additional sex crimes charge in a New York City courtroom Wednesday, roughly two months ahead of a retrial in the disgraced Hollywood producer’s landmark #MeToo case. “Thanks to this survivor who bravely came forward, Harvey Weinstein now stands indicted for an additional alleged violent sexual assault,” Bragg said. “This investigation is ongoing.”In all, more than 80 women have accused Weinstein of sexual assault or harassment going back decades. (He was acquitted of two counts of predatory sexual assault and a count of first-degree rape.) (The jury acquitted him of a count of sexual battery by restraint and failed to reach a verdict on three other sexual assault counts.)

CNN —A critical witness in the original trial of disgraced Hollywood producer Harvey Weinstein has announced she will testify in his upcoming retrial on criminal charges. After Weinstein’s conviction was overturned earlier this year, Mimi Haley, a former production assistant on The Weinstein Company’s “Project Runway,” said she wasn’t sure if she wanted to go through it all again. Haley alleged that Weinstein had pinned her down and forced her into a sex act in 2006 at his Manhattan apartment. Last week, he was indicted in Manhattan in connection to new sexual assault allegations, according to prosecutors. If he is cleared to attend the hearing, Weinstein is expected to be arraigned on the new indictment.

CNN —A Manhattan grand jury has indicted Harvey Weinstein on new sex crime charges, according to his attorney Arthur Aidala. “The grand jury has indicted Mr. Weinstein,” prosecutor Nicole Blumberg said during a court hearing on Thursday. It could include sexual assault allegations from three women, prosecutors said at a separate hearing last week. One alleged assault occurred at a residential building in lower Manhattan in the winter months between 2005 and 2006. A source with knowledge of the matter told CNN that alleged assault is said to have occurred during in 2006.

They argued the “prior bad acts” witnesses should not have been allowed to testify and the court should not have given prosecutors the ability to question Weinstein about instances of verbal abuse and bullying on cross-examination. In sexual assault cases, their testimony can turn a difficult “he said, she said” case into a more convincing “he said, they said” case.

CNN —The New York Court of Appeals on Thursday overturned the sex crimes conviction against Harvey Weinstein, the powerful Hollywood producer whose downfall stood as a symbol of the #MeToo movement. Douglas H. Wigdor, an attorney who has represented eight of Weinstein’s accusers, including two of the “prior bad acts” witnesses at his New York criminal trial, criticized the ruling. In addition, three other women testified during the trial as “prior bad acts” witnesses as prosecutors sought to show Weinstein had a pattern of abuse. The use of “prior bad acts” witnesses has increased in recent years with the rise of the #MeToo movement. “Prior bad acts” evidence is one exception to this rule.

CNN —Two years after his conviction on rape and sexual assault charges, disgraced movie producer Harvey Weinstein is again set to go on trial on similar charges in Los Angeles. Weinstein, 70, has pleaded not guilty to charges including four counts of rape, four counts of forcible oral copulation, sexual penetration by force and sexual battery by restraint in incidents dating from 2004 to 2013. Weinstein was already found guilty in New York of first-degree criminal sexual act and third-degree rape and was sentenced to 23 years in prison. The former movie producer appeared in frail health during the trial and used a walker as he arrived to and left court each day. He used a wheelchair to arrive to the sentencing in March 2020 as well as in a court hearing in Los Angeles in July 2021.
