Juul agreed to a settlement in 2022, but the Altria settlement, which was needed to kickstart payouts, was not approved until earlier this year. And it was only this month that claims for the approximately 842,000 eligible Juul customers began to be verified. Vaping remains mired in controversy in the U.S., as e-cigarette companies and federal regulators continue to haggle over the products’ health effects and marketing guardrails.

The Food and Drug Administration on Friday authorized the first menthol-flavored electronic cigarettes for adult smokers, acknowledging that vaping flavors can reduce the harms of traditional tobacco smoking. The FDA said it authorized four menthol e-cigarettes from Njoy, the vaping brand recently acquired by tobacco giant Altria , which also sells Marlboro cigarettes. "This decision could mean we'll never be able to close the Pandora's box of the youth vaping epidemic," said Meredith Berkman, co-founder of Parents Against Vaping E-cigarettes. Njoy is one of only three companies that previously received FDA's OK for vaping products. Altria's data showed Njoy e-cigarettes helped smokers reduce their exposure to the harmful chemicals in traditional cigarettes, the FDA said.

The Food and Drug Administration announced Thursday that it has reversed its ban on Juul e-cigarettes while it reviews new court decisions and considers updated information provided by the vape-maker. The FDA first stopped the company from marketing its products in 2022, but they have stayed on shelves pending an appeal. Even as Juul has pursued its appeal of the 2022 marketing ban, that initial FDA ruling significantly disrupted the company's finances, prompting a bailout from two of its largest investors, The Wall Street Journal has reported. Juul also continues to face lawsuits from consumers saying its products harmed their health. To date, the FDA has given only 23 e-cigarette products, made by just three companies, official approval to be marketed to consumers.

New York CNN —Move over vapes, Americans appear to have a new addiction: Zyn, a tobacco-free nicotine pouch product, that has exploded in sales over the past year. Philip Morris announced Thursday that it shipped about 350 million cans of Zyn in 2023, a whopping 62% growth compared to the previous year. Nicotine is very addictive and can harm young people’s developing brains, according to the US Centers for Disease Control and Prevention. However, like Juul, the popularity and growth of Zyn might face difficulties, in particular from US government. “Zyn is the next battle.”Despite the growth, shares of Phillip Morris declined 2% in early trading because of lower demand for cigarettes.

While they do not contain tobacco, many include nicotine, a dangerous chemical known for its addictive properties. In a survey, 10% of high school students said they had used electronic cigarettes in the previous month, down from 14% last year. Use of any tobacco product— including cigarettes and cigars — also fell among high schoolers, according to the Centers for Disease Control and Prevention report. — About 1 in 10 middle and high school students said they recently had used a tobacco product. There was a slight increase in middle schools students who said they had used at least one tobacco product in the past month, while that rate fell among high school students.

Altria Group, the parent company of Philip Morris USA and the nation's largest tobacco company, reported third-quarter results Thursday that fell short of Wall Street's expectations as demand for its core cigarette business cools and illicit e-vapor products flood the market. The Marlboro maker said its domestic cigarette shipment volume decreased 11.6%, primarily driven by wider declines across the industry and competition from illicit e-vapor products, among other factors. In a conference call with analysts, Altria CEO Billy Gifford said the lack of regulation of illicit e-vapor products has come at the expense of legal operators and approved. Although federal crackdowns have placed more restrictions on the flavors and marketing for tobacco products, illicit operators are skirting many tobacco-related laws and are flooding the market with disposable e-cigarettes that aren't FDA-approved and are illegal to sell. Like many other tobacco companies, Altria is moving beyond traditional, combustible cigarettes and towards smoke-free products.

Juul Labs said Wednesday it's planning to cut about 30% of its workforce as it looks to cut costs and boost profits. The layoffs will affect about 250 people, reducing the company's headcount to about 650, a company spokesperson said. This will reduce operating expenses by $225 million, the Juul spokesperson added. In response to the suit, a Juul spokesperson told CNBC, "We stand behind our intellectual property and will continue to pursue our infringement claims."
