Gautam Adani, chair of India's Adani Group and one of the world's richest people, was indicted with others on bribery and fraud charges unsealed Wednesday in federal court in New York. Andani and other defendants are accused of bribing Indian government officials more than $250 million in bribes to obtain solar energy supply contracts worth more than $2 billion in profits. The five-count indictment in U.S. District Court in Brooklyn also charged Ranjit Gupta and Rupash Agarwal, former executives in the renewable-energy company Azure Power, and three former employees of the Canadian institutional investor Caisse de Depot et Placement du Quebec: Cyril Cabanes, Saurabh Agarwal and Deepak Malhotra. Those defendants are accused of conspiracy to violate the Foreign Corrupt Practices Act in connection with the bribery scheme by Adani and the others at the energy company. Cabanes, Saurabh Agarwal, Malhotra and Rupash Agarwal are also accused of conspiring to obstruct criminal and Securities and Exchange Commission investigations into the bribery scheme.

On Tuesday, the company said it would invest $300 million to form a joint venture with $19 billion Adani Green Energy (ADNA.NS) to build solar and wind farms in the country. The latest tie-up ought to help Total to hit its target of having 100 gigawatts of renewable energy capacity by 2030. Adani Green Energy and Adani Total Gas (ADAG.NS), in which Total owned stakes of about 20% and 37% at the end of June, have lost about 50% and 80% of their market value since January, and are among the worst performing of the group’s nine core listed entities. Total’s green capacity targets may be more pressing than the risk of further Adani problems. Adani Green will contribute assets to the joint venture, it said in a statement, adding that the deal will help it achieve its target of having 45 gigawatts of renewable energy capacity by 2030.

Deloitte in May had pointed to certain transactions flagged by the U.S. short-seller in its report and gave only a qualified opinion, which indicates concerns by a company's auditor. Deloitte's resignation comes after it asked Adani Ports to conduct an independent inquiry on related party transactions flagged by Hindenburg, to which the company did not agree, the source said. Deloitte and Adani Ports did not immediately respond to Reuters' requests for comments. Deloitte's decision to quit as Adani Ports' auditor might come as soon as Monday, the source added.
