Nebraska’s Dan Osborn is returning to work Tuesday as a steamfitter after his unsuccessful Senate run, but his political career isn’t over. Osborn, who ran as an independent, is launching a political action committee, called the Working Class Heroes Fund, to support working-class candidates of all parties. And he isn’t ruling out another run for office after his loss to GOP Sen. Deb Fischer. Osborn said his PAC will support candidates of any party, and he said he didn’t expect to have many policy litmus tests, apart from supporting campaign finance overhaul and rejecting corporate donations. His Senate campaign raised $7.9 million through mid-October, according to the latest campaign finance reports, and he said it ultimately raised more than $14 million.

Representative Don Bacon of Nebraska, one of the most politically vulnerable Republicans in the country, has defeated his Democratic challenger and won a fifth term, according to The Associated Press. His victory denies Democrats one of their best opportunities this year to pick up a seat and bolsters his party’s drive to hold its majority. The race was the second matchup between Mr. Bacon and Tony Vargas, who came within 6,000 votes of unseating the congressman in 2022. Mr. Vargas came up short again on Friday evening, even after top Democrats including Representative Hakeem Jeffries, the minority leader, and Gov. The contest between Mr. Bacon, 61, a former brigadier general in the Air Force, and Mr. Vargas, 40, a former public-school teacher who is the son of Peruvian immigrants, featured debates over national issues including abortion rights, taxes and public safety.

Next door in the 7th District, GOP state Rep. Ryan Mackenzie defeated Democratic Rep. Susan Wild, who had flipped a GOP seat in a 2018 special election. Republicans also flipped an open seat in Michigan’s 7th District, after Democratic Rep. Elissa Slotkin decided to run for the Senate. Because California is notoriously slow in counting ballots, some of the half-dozen hyper-competitive races there — critical to which party wins the House majority — likely will take days. In the 27th District, GOP Rep. Mike Garcia was narrowly beating Democrat George Whitesides with 65% of the vote in. In another California battleground race, NBC News projected Wednesday that GOP Rep. Kevin Kiley has defeated Democrat Jessica Morse.

Constitutional amendments to protect or expand abortion passed in seven of the 10 states where they appeared on the ballot Tuesday, NBC News projects. Voters in Arizona and Missouri approved ballot initiatives that will effectively protect abortion rights until fetal viability and undo existing abortion laws on the books. But voters in Florida, Nebraska and South Dakota rejected proposed amendments that would have done the same — becoming the first pro-abortion-rights ballot measures to fail since the Supreme Court overturned Roe v. Wade in June 2022. The other amendment, that would have enshrined abortion rights until fetal viability in the conservative state’s constitution, was rejected. The defeats of the amendments in Florida, Nebraska and South Dakota ended what had been an unbroken winning streak for ballot measures backing abortion rights in the 2½ years since the fall of Roe.

Vice President Kamala Harris has won Nebraska’s 2nd Congressional District, NBC News projects, earning an electoral vote from a red state. The historically competitive 2nd District, which includes Omaha and the surrounding suburban areas, has oscillated between Democratic and Republican representation (and presidential winners) in recent years. Nebraska is one of two states that allocates its electoral votes by congressional district. I’m voting for Harris.”Trump’s allies failed in their effort to change Nebraska’s electoral vote allocation back to a winner-take-all system. In a state that has leaned Republican going back decades, had lawmakers reverted to that model, Trump would have captured all five of the state’s electoral votes.

Republicans have averted a potential disaster in Nebraska, with NBC News projecting that Sen. Deb Fischer has won re-election to a third term. Fischer faced a surprisingly competitive challenge from independent Dan Osborn, a mechanic and union leader who cast her as a creature of Washington. Fischer's win gives the Republicans 51 Senate seats, putting them over the threshold needed for control of the chamber, NBC News projects. But it has been nearly 20 years since the state elected a Democrat to the Senate, and Republicans typically carry statewide races with ease. Fischer was elected to the Senate in 2012 in a resounding victory over Democratic former Sen. Bob Kerrey, who had also been governor.

Republicans are projected to retake the majority in the US Senate. AdvertisementRepublicans are projected to regain control of the US Senate after winning seats in West Virginia and Ohio, according to Fox News and the Associated Press, ending four years of Democratic control. Republicans also appeared likely to win a 52nd seat in Montana, where Sen. Jon Tester trailed the GOP candidate Tim Sheehy. Despite dramatically outraising Republicans in many of this year's tightest Senate races, Democrats faced a punishing map and were primarily on defense. Democrats' best pick-up opportunity in the Senate was in Texas, where Republican Sen. Ted Cruz ultimately survived a tougher-than-expected challenge from Rep. Colin Allred.

CNN —Republicans will win the US Senate majority, CNN projects, shifting the balance of power in Washington. Should Harris prevail, she would face problems in confirming members of her Cabinet and judicial nominees, and the GOP Senate could thwart her domestic plans. Jim Justice was projected to pick up the Senate seat vacated by retiring Democrat-turned-independent Sen. Joe Manchin. And in Nebraska, CNN projects that Republican Sen. Deb Fischer will defeat a stronger-than-expected challenge from independent Dan Osborn, who, along with his allies, outspent Republican forces in the state. Alsobrooks will become just the fourth Black woman elected to the Senate after Democrat Lisa Blunt Rochester, the third, was projected to win Delaware’s open Senate seat earlier in the night.

Kamala Harris is projected to have won a potentially critical Electoral College vote in Nebraska. Democrats have now won an electoral vote in Nebraska in three elections since 2008. With over 80% of the expected vote in, Fox News and The New York Times have called the district and its Electoral College vote for Harris. CNN —Republican Sen. Deb Fischer will win reelection in Nebraska, defeating an unexpectedly strong challenge from independent Dan Osborn, CNN projects. Fischer was first elected to the Senate in 2012, when she became the first female senator elected to a full term in Nebraska. Fischer, who will begin her third Senate term in January, said she changed her mind after realizing how important seniority is for members of Congress. Former President Donald Trump also sought to tie Osborn to the left in his endorsement of Fischer. The state also held a special Senate election to fill the other seat left vacant by Republican Ben Sasse’s resignation.

In the top-of-the-ticket presidential race, Vice President Kamala Harris and former President Donald Trump entered the day virtually deadlocked in national polling and surveys of the pivotal battleground states. Senate Democrats and House Republicans were hoping to hang on to thin majorities amid fierce competition. Trump planned to gather family, friends and staff at Mar-a-Lago, his resort in West Palm Beach, Florida, to monitor returns. Along with the rest of the country, Trump and Harris must now await the judgment of voters in the seven swing states — Pennsylvania, Michigan, Wisconsin, Georgia, North Carolina, Arizona and Nevada — to find out who is right. Senate Democrats are also playing defense in Ohio, Pennsylvania, Nevada, Michigan, Wisconsin, Nevada and Maryland.

ArizonaThe Arizona Abortion Access Act would enshrine the right to an abortion in the state constitution up to fetal viability, around 22 to 24 weeks into pregnancy. Abortion rights supporters say the moment served as a stark reminder of what could come if reproductive rights aren’t enshrined in the state constitution. ColoradoThe Colorado Right to Abortion and Health Insurance Coverage Initiative would enshrine abortion rights in the state constitution and approve the use of public funds for abortion. In Nevada, an amendment must be passed in two successive general elections before it can be added to the state constitution. While proponents have focused on abortion rights, opponents have used the measure’s broad nature to raise concerns about transgender and parental issues.

Critics have said that school choice puts public education at risk by diverting funds away from public schools and that some school choice initiatives have disproportionately helped wealthier families. Colorado's Amendment 80 establishes a constitutionally protected right to school choice for children from kindergarten through 12th grade. This week, the state health department issued an advisory to doctors suggesting that recent ads about Nebraska’s abortion restrictions had created "confusion." She said the health department and Gov. Jeff Powell, communications director for the Nebraska Department of Health and Human Services, said the intent of the health alert was to "clarify the current law." In response to the health department alert, two doctors in the state said there is no confusion among physicians about how to treat ectopic pregnancies or miscarriages. In 2020, election week replaced election night: Joe Biden wasn’t declared the winner until Saturday. The truth is the Decision Desk cannot know until election night which scenario will unfold, regardless of how carefully we have analyzed the polls, early vote, and other election-related data. One thing is clear: The days of projecting a winner on election night itself are almost certainly over. North Carolina has a similar pattern in how it reports out the vote, with 99% of the vote counted by midnight in past elections. And unlike some other close states, it wasn’t just because the margin was so thin.

Voters across the country are set to decide on nearly 150 ballot measures next week that will shape the future of a wide variety of policy issues in their states. (In addition, Louisiana will let voters decide on four constitutional amendments on its Dec. 7 ballot.) “Everyone knows this is a big issue this year — it’s the most we’ve ever seen for reproductive freedom ballot measures in history,” Fields Figueredo said. For Democrats, President Joe Biden dominated the primaries and faced only token opposition. Vice President Kamala Harris speaks as former President Donald Trump listens during a presidential debate at the National Constitution Center in Philadelphia on September 10, 2024. Trump was accused by the Justice Department of election interference after he tried to overturn the 2020 election results. The most populous states are California (54 electoral votes), Texas (40 electoral votes) and Florida (30 electoral votes). The total number of electoral votes, 538, is an even number, which means a tie is conceivable.

The Nebraska Supreme Court ruled that convicted felons who served their sentences are allowed to vote, after the state's top election official sought to keep them from casting ballots ahead of the Nov. 5 election. Nebraska has historically restored the voting rights of former felons two years after they completed the terms of their sentences. While Nebraska is solidly Republican state, it awards an electoral vote to the winner of each of its congressional districts. The Sentencing Project, criminal justice reform advocacy group, estimated that eliminating the waiting period for convicted felons in Nebraska would restore voting rights for 7,000 people.
