CNN —Hunter Biden is requesting a new trial in his federal gun case, with his lawyers claiming that there was a procedural issue in the timing of the early June trial that resulted in a guilty verdict against him. His lawyers claim that the trial court did not have jurisdiction over his case because of appeals that he had filed challenging his prosecution. The defense team says that the conviction must be wiped away because, even though the appeals court had rejected the appeals by the time the trial started, it had not issued what’s known as a “mandate” – the procedural maneuver that effectively notifies a lower court of ruling made by a higher court in an appeal. Biden’s lawyers are pointing to the absence of a mandate sending the case back to the trial court after the 3rd US Circuit Court of Appeals handed down rulings rejecting two of his appeals in late May. “The Third Circuit, however, did not then and has not yet issued its mandate as to the orders dismissing either appeal,” his lawyers wrote.

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. When Biden and Trump meet in a debate on CNN Thursday, expect part of the audience to be wondering exactly who and what will come next. Biden, who’s battling low approval ratings, is sticking with Vice President Kamala Harris, whose polls are also bleak. There were 28, and we’ve had 11 so far this year, Bridget Johnson noted in the first of a CNN Opinion series about America’s preparedness. “It’s a measure of his hold on American society that he’s still revered a half-century later,” wrote Frederic J. Frommer.

On Monday, the federal judge overseeing the case will hold a hearing for both parties to present their arguments over the proposed gag order, and tensions between the two sides could quickly rise. Citing Trump’s continued mischaracterization of the FBI’s policy in place around the use of deadly force during the search, prosecutors say Trump’s false claims that he nearly escaped death from federal agents could lead to threats and harassment against them. Trump was in New York when agents searched the Florida estate. “Shortly after the execution of the search warrant at Mar-a-Lago, one of Trump’s supporters carried out an armed attack on an FBI office in the wake of Trump’s Truth Social statements regarding the search,” prosecutors wrote. Supreme Court upholds domestic violence gun restriction
  + stars: | 2024-06-21 | by ( Lawrence Hurley | )   time to read: +4 min
Activists rally outside the U.S. Supreme Court before the start of oral arguments in the United States v. Rahimi second amendement case in Washington on Tuesday, November 7, 2023. The Supreme Court on Friday upheld a federal law that prohibits people subjected to domestic violence restraining orders from having firearms, taking a step back from its recent endorsement of a broad right to possess a gun. The court on an 8-1 vote ruled in favor of the Biden administration, which was defending the law — one of several federal gun restrictions currently facing legal challenges. He argued that he cannot be prosecuted under the federal gun possession restriction in light of what the Supreme Court concluded. But the case before the justices concerns his separate prosecution by the Justice Department for violating the federal gun possession law.

CNN —Despite its name, June’s full moon will not look like a strawberry. But the bright orb could still turn heads Friday night with an appearance that is bigger and more colorful than the average moon. Since a full moon is opposite the sun, this strawberry moon will shine lower in the sky than usual, according to NASA. Native American tribes across North America gave the strawberry moon its name to mark the in-season ripeness of strawberries, according to The Old Farmer’s Almanac. For optimal viewing, Dyches recommends looking when the moon is rising or setting to see the effects of the moon illusion.

Trump is arguing that Jack Smith – who has brought charges against Trump in Florida and Washington, DC – was unlawfully appointed as special counsel. At the center of Trump’s argument is the claim that the Attorney General Merrick Garland does not have legal authority to appoint someone as special counsel who hasn’t confirmed by the Senate. The Justice Department says the attorney general has ample authority to appoint “inferior officers,” which would include special counsels. “This Court should hold as a matter of law that the Attorney General lawfully appointed the Special Counsel,” the attorneys wrote. Almost inverse from Trump, Biden argued that special counsel David Weiss was unlawfully appointed because he was already in the federal government and therefore not fully independent.

CNN —The Supreme Court upheld a federal law Friday that bars guns for domestic abusers, rejecting an argument pressed by gun rights groups that the prohibition violated the Second Amendment. The 8-1 decision lands as the nation continues to grapple with gun violence and mass shootings. A roiling political debate over firearms has left Washington unable to pass new gun laws. The decision could help shore up similar federal gun regulations that have been challenged since the Supreme Court vastly expanded gun rights in 2022. Rahimi’s lawyers claimed that the Supreme Court’s blockbuster decision two years ago meant that the law on domestic violence orders could not be squared with the Constitution.

That sent lower courts scurrying into historical analyses to figure out if modern gun laws had some connection to the 18th Century. Roberts’ opinion said that lower courts were misunderstanding what the majority had said in that ruling. But Justice Ketanji Brown Jackson, a member of the court’s liberal wing, suggested it was the high court’s fault for not providing clarity for lower courts to follow. One deals with a Pennsylvania man’s challenge to a federal law prohibiting felons, including those who are non-violent, from possessing firearms. Solicitor General Elizabeth Prelogar presented that argument with an eye toward several other challenges pending to similar federal gun prohibitions that involve non-violent criminal activity.

“The president has gotten increasingly punchier in recent remarks about Trump and plans to carry that theme through to the debate,” one Biden campaign official said. (CNN debate rules stipulate that each candidate will have a pen, writing pad and a bottle of water at the podium.) Biden’s former chief of staff, Ron Klain, is taking the lead to help the president get ready to debate Trump, a Biden campaign official told CNN. London CNN —London’s stock market has edged ahead of its rival in Paris as fears grow over the outcome of France’s looming parliamentary elections. The first round of the French elections is scheduled for June 30, followed by a second round on July 7. Hubert de Barochez, a senior market economist at consultancy Capital Economics, said investors might be concerned that a parliament run by the National Rally would penalize banks. In contrast with the political and financial turmoil in France, UK financial markets are “relatively stable,” said Rudolph at IG Group. At the time, Mr. Biden was widely expected to be Mr. Trump’s opponent in the 2020 election. Eugene Vindman, who was dismissed from the White House early in 2020, he says as improper retaliation for his whistle-blowing actions, raised a remarkable sum of money for a first-time candidate. “I sacrificed my military career to expose Trump’s corruption,” Eugene Vindman said in one of his campaign ads. His election to the House is not guaranteed. But Glenn Youngkin, a Republican, won the district the year before by 4.9 points en route to winning the governor’s mansion.

A US-based lawyer who has represented accused Chinese money launderers said the tempo of law enforcement operations against the alleged launderers has increased in recent weeks as federal agents close in on “bigger fish” among Chinese money launderers in the US. None of the federal law enforcement agencies involved in tracking Chinese money launderers agreed to be interviewed on the record. Grassley and Whitehouse have each introduced legislation they say is key to closing loopholes in US law that are actively exploited by the cartels’ money launderers. Elaborate networksRecent court documents illuminate how far-flung and elaborate US-based networks of alleged Chinese money launderers are. CNN —The Republican primary race between Virginia Rep. Bob Good, the House Freedom Caucus chair who angered allies of former President Donald Trump and former Speaker Kevin McCarthy, and state Sen. John McGuire was too early to call Tuesday night. The congressman from Virginia’s 5th Congressional District has faced a fierce effort to knock him out from a broad swath of the GOP in what became the most expensive House Republican primary of the cycle. Vindman’s role in Trump’s impeachment likely made a difference in his campaign. After spending most of his career in Illinois, Bondar moved to Texas in 2020, living outside Dallas – where he voted in this March’s Republican primary. State voting records show Bondar’s early in-person ballot in his primary race is the first time he has voted in Oklahoma.

CNN —Bitter tensions are escalating between Joe Biden and Donald Trump over race and the future of the Supreme Court as they gear up for the most critical presidential debate clash in years. This is why Trump spent Saturday in Michigan, seeking to take advantage of signs of waning enthusiasm for Biden among Black voters. According to CNN exit polls in 2020, Trump won about 1 in 10 Black voters. But a recent New York Times/Siena College poll found the ex-president winning more than 20% of Black voters in battleground states. But the Biden campaign seemed keen to show the president in an informal setting with Obama and stars including Julia Roberts and George Clooney.

"Inside Out 2" debuted with an estimated $155 million domestically, the second-highest theatrical opening of an animated film and the first film since Warner Bros.' "Let's issue a collective 'welcome back' to Disney, Pixar, and the summer box office," said Shawn Robbins, founder and owner of Box Office Theory." Typically, these films average $100 million to $200 million openings, with 2019's "Avengers: Endgame" hitting a record $357.1 million. When my son Nic was born, I was like other parents who hope that their children will be healthy and happy. But when Nic became addicted to heroin and methamphetamine as a teenager, my dreams shifted. I’ve been thinking about another father of a son with a severe substance-use disorder; a son who survived and is now in recovery. But much of the discourse around Joe and Hunter Biden seems so wrongheaded to me. That’s because it reflects a profound misunderstanding of the relationship many parents have with children with substance-use disorders.

President Biden was eager to get off the stage at the Group of 7 summit Thursday night, clearly a bit testy after answering questions about Hunter Biden’s conviction and the prospects of a cease-fire in Gaza. But at the end of his news conference with President Volodymyr Zelensky of Ukraine, he couldn’t seem to help jumping in as the Ukrainian leader spoke delicately about China’s tightening relationship with Russia. He leaned into his microphone as soon as Mr. Zelensky was finished. “By the way, China is not supplying weapons” for the war in Ukraine, Mr. Biden said, “but the ability to produce those weapons and the technology available to do it.”“So, it is, in fact, helping Russia,” he said. Throughout the Group of 7 summit meeting in Puglia, China has been the lurking presence: as the savior of “Russia’s war machine,” in the words of the summit’s final communiqué; as an intensifying threat in the South China Sea; and as a wayward economic actor, dumping electric cars in Western markets and threatening to withhold critical minerals needed by high-tech industries.

“The American principle that no one is above the law was reaffirmed,” President Biden said after former President Donald J. Trump was convicted last month of falsifying records to cover up a sex scandal. “No one in this country is above the law,” David Weiss, the special counsel who prosecuted Hunter Biden on gun charges, said after Mr. Biden was convicted this week. The expression has been used by plenty of political figures in recent weeks, including Vice President Kamala Harris (“Donald Trump thinks he is above the law,” she said at a recent campaign event). The phrase “above the law” has appeared in The New York Times 100 times this year alone. The specific origin of the phrase is not clear, with several people getting credit for pushing it forward.
