Donald Trump could use Joe Biden’s pardon of Hunter Biden for his own gain, some worry. Hunter Biden pardon gives Trump political coverPresident Joe Biden’s decision to pardon his son Hunter Biden was a move by a father to protect his son that some lawmakers said they could understand. “I’ll put it this way — if it was my son, I’d pardon him too,” Republican Sen. Tommy Tuberville said. What hasn’t resonated as widely is Biden’s stated reason for pardoning Hunter Biden. Yesterday, White House press secretary Karine Jean-Pierre defended Biden, telling reporters he believes “Hunter was singled out.

The sweeping pardon means Hunter Biden won’t face any punishment for criminal convictions in two separate cases, one involving gun charges, the other tax evasion. “They took a gamble that didn’t play out as they hoped,” former Justice Department spokesman Anthony Coley said. If he follows through, Trump may try to blunt the fallout by invoking the Biden pardon. “Joe Biden's pardon of Hunter Biden proves President Trump's signature campaign promise to end the weaponization of our justice system needs to happen,” she said, adding: “President Trump has made that promise. A judge has already ruled there is no merit to the idea that Hunter Biden is a victim of selective prosecution.

Special counsel David Weiss's office on Monday appeared to push back on President Joe Biden's claim that its prosecutions of Hunter Biden were politically motivated, calling such allegations "baseless." The Court rejected that claim finding that '[a]s the Court stated at the hearing, Defendant filed his motion without any evidence.' It noted that Hunter Biden "made similar baseless accusations" in the Delaware case, which were rejected by that judge as well. Three appeals court panels also rejected Hunter Biden's arguments, the filing said. Hunter Biden had been scheduled to be sentenced in both cases later this month.

White House press secretary Karine Jean-Pierre on Monday defended President Joe Biden's decision to pardon his son, Hunter Biden, despite telling the press multiple times that the president had no such plans. She added, "Hunter was singled out, and because his last name was Biden, because he was the president’s son. Hunter Biden, the president's only surviving son, was found guilty in June on federal gun charges and pleaded guilty in a separate tax evasion case in September. During a White House press briefing on Nov. 7, Jean-Pierre again dismissed a question about whether Biden had planned to pardon his son. Asked Monday about the pardon, first lady Jill Biden said, “Of course I support the pardon of my son."

WASHINGTON — GOP lawmakers began publicly fuming shortly after President Joe Biden announced that he was pardoning his son Hunter Biden. President-elect Donald Trump's communications director, Steven Cheung, reacted to Biden's announcement without naming the president or his son. "The failed witch hunts against President Trump have proven that the Democrat-controlled DOJ and other radical prosecutors are guilty of weaponizing the justice system," Cheung said in a statement. CNN —President Joe Biden’s decision to pardon his son has left some Democrats fuming over his choice to repeatedly and unequivocally claim that he would never take that step, even though a pardon long appeared possible to Hunter Biden’s legal team. That comes despite the White House saying that a final decision on the pardon was reached only this weekend. Press secretary Karine Jean-Pierre said as recently as November 7 that a pardon for Hunter Biden was not being considered. Joe Biden’s decision to pardon his son presented a delicate balancing act for the president, who has long been fiercely loyal to his family, even when it comes at his own personal or political detriment. People close to the president’s son said they didn’t want him to have to undergo sentencing.

Mr. Biden said, as recently as June, that he wouldn’t pardon Hunter or commute his sentence, and his press secretary reiterated that he had no plans to pardon Hunter after last month’s election. It is “not limited to all offenses charged or prosecuted” and encompasses the period when the younger Mr. Biden joined the board of Burisma. Mr. Biden sought to define his presidency in counterpoint to the corruption and indecency of the first Trump years. With the pardon of his son, Mr. Biden added his name to the roll call of presidents who dishonored their office by misusing the pardon power. By changing his plan to issue this pardon, Mr. Biden himself seemed to recognize how wrong it was, and is.

To the Editor:Re “Biden Issues a ‘Full and Unconditional Pardon’ of His Son Hunter Biden” (nytimes.com, Dec. 1):President Biden’s pardon of his son Hunter was, in a word, just. While the jury’s verdict was a fair one, based on the overwhelming evidence of Hunter Biden’s illegal possession of a firearm, the decision to overcharge this victimless crime was, in a word, political. The overcharging of Hunter Biden was most certainly influenced by a perceived need within the Justice Department to bend over backward to demonstrate its “impartiality.” All prosecutorial decisions are discretionary: If Hunter’s surname were not Biden, the charges and sentencing recommendations would have fit the crime. It would be inhumane to have expected 82-year-old Joe Biden to have left his only surviving son in the safekeeping of the Trump administration penal system — and subjected, potentially, to other trumped-up charges under the soon-to-be gutted and weaponized Justice Department. The president’s pardon of his son was merciful and fully justified, given the totality of the circumstances.

CNN —President Joe Biden’s pardon of his son Hunter deepened an entanglement of politics and the rule of law that has tarnished faith in American justice and is almost certain to worsen in Donald Trump’s second term. And the cases against Hunter Biden lack the constitutional gravity or historic importance of the indictments against Trump and his frequent attacks on the rule of law. Already, Republicans are arguing the Hunter Biden pardon shows that the current president, and not the next one, is most to blame for politicizing the system of justice by meting out favorable treatment to his son. Yet at the same time, Hunter Biden put himself in a position in which he created a political vulnerability and potential conflict of interest for his father. Then, the investigation into the 2016 Trump campaign’s ties to Russia soured many of the 45th president’s supporters on the justice system.

Biden the Father vs. Biden the Institutionalist

On the day President Biden’s career in national politics began in 1973, he walked up to a lectern set up in a Delaware hospital room while holding his 3-year-old son, Hunter, in his arms. Biden was there to take the oath to become a senator, a ceremony held at the hospital so his sons could be there. And, he suggested, if there was ever a “conflict between my being a good father and being a good senator,” he would step aside. It was an extraordinary move that came after he and his press secretary repeatedly insisted he would not pardon his son. It seemed to upend Biden’s attempts to portray himself as an institutionalist.

Broad Pardon for Hunter Biden Troubles Experts

With President Biden’s pardon, his son escaped a legal reckoning not just for crimes for which he was found guilty, but likely for any crimes he might have committed in the past 11 years. That sweeping amnesty is raising awkward historical comparisons and sharp questions about the use of presidential clemency. It also has inflamed a debate about who deserves mercy and for what, while underscoring the Biden family’s concerns about Hunter Biden’s vulnerability to prosecution related to his foreign business activities. Experts searched for an apt comparison, finding some similarities to the pardons granted by Gerald R. Ford to Richard M. Nixon; Andrew Johnson to former Confederate soldiers; George H.W. “It is extraordinarily hazardous to use the pardon power in a case where the person is an intimate of the president,” said Aziz Z. Huq, a professor at the University of Chicago Law School.
