CNN —A New Mexico judge on Monday denied “Rust” armorer Hannah Gutierrez Reed’s request for new trial and upheld her involuntary manslaughter conviction for the 2021 death of cinematographer Halyna Hutchins. Gutierrez Reed, who as armorer was in charge of firearms on the movie set, was convicted of involuntary manslaughter in March. Her defense attorney argued she was scapegoated for the safety failures of film set management and other crew members. Baldwin was also charged with involuntary manslaughter and had pleaded not guilty. Assistant film director David Halls took a plea deal in 2023 for his role in the shooting.

CNN —A New Mexico judge on Thursday is set to consider the “Rust” movie armorer’s motion to be released from prison, months after similar charges against actor Alec Baldwin were dismissed due to prosecutorial misconduct. At her trial, prosecutors argued she repeatedly violated safety protocol and was negligent in performing her duties, allowing six live rounds on to the set. Her defense attorney argued she was scapegoated for the safety failures of film set management and other crew members. But just days after his trial began, Judge Mary Marlowe Sommer threw out the charges and ruled prosecutors did not properly turn over evidence to the defense. The judge called the withholding of evidence “intentional and deliberate” and dismissed the case with prejudice, meaning it cannot be brought again.

CNN —The dramatic dismissal of the involuntary manslaughter case against actor Alec Baldwin over withheld evidence could mean the release of convicted “Rust” movie armorer Hannah Gutierrez Reed from a New Mexico state prison, legal experts say. But the Baldwin case imploded on Friday – just two days after the trial began – with the sudden and shocking twists and turns of a nail-biting legal thriller. “I fully expect Hannah Gutierrez Reed to make the same argument for her conviction to be overturned,” Neama Rahmani, a former federal prosecutor, told CNN. Her ruling regarding the failure to disclose the ammunition should carry significant weight in the Gutierrez Reed case, CNN legal analyst Joey Jackson said. Hannah Gutierrez Reed will go free as well.

CNN —Joel Souza, the director and screenwriter of the “Rust” film, took to the stand Friday in the involuntary manslaughter trial of the film’s armorer, to testify about the moment he was shot on set. “There was an incredibly loud bang” unlike typical discharges on set, Souza testified. “I distinctly remember (Hutchins) being lowered to the ground, people had her sort of on either side. “I remember initially thinking, ‘Had she been startled by it?’ and then I saw the blood on her back.” Hutchins was fatally shot during the October 2021 incident. At the hospital, the filmmaker said did not understand he had been shot by a bullet.

CNN —An unnamed witness has said “Rust” film armorer Hannah Gutierrez Reed “transferred a small bag of cocaine” after returning from a police interview on the day of the “Rust” fatal shooting, according to a motion filed by prosecutors Thursday. The new filing comes after prosecutors last week charged Gutierrez Reed with tampering with evidence in relation to the shooting death of the movie’s cinematographer Halyna Hutchins, according to an amended complaint filed last week. The charge is in addition to two counts of involuntary manslaughter filed against Gutierrez Reed earlier this year. “This is more of the same underhanded, secret, reprehensible tactics from the state.”CNN previously reported Gutierrez Reed transferred narcotics to another person “with the intent to prevent the apprehension, prosecution or conviction of herself,” an amended complaint said. CNN —The armorer on the set of the movie “Rust” likely was hungover when she loaded a prop gun used by actor Alec Baldwin that fired a live round of ammunition during a rehearsal, killing cinematographer Halyna Hutchins, prosecutors said in a court filing. Witnesses told investigators Hannah Gutierrez Reed “was drinking heavily and smoking marijuana in the evenings during the shooting of Rust,” prosecutors said in the Friday filing. Gutierrez Reed will plead not guilty to two counts of involuntary manslaughter in connection with the October 2021 shooting, an attorney for her has said. A final decision on charges against Baldwin would be made before August 8, prosecutors said in the Friday filing.
