Jury nullification is the term for when a jury declines to convict a defendant despite overwhelming evidence of guilt. The defense is not allowed to encourage a jury to nullify a case, and the jury is required to follow the evidence and the law. In recent decades, jury nullification has reared its head in cases that touched on hot-button social issues. The quasi-legal status of nullification leads to a sort-of “don’t ask, don’t tell” position in which neither the defense nor the jury mentions nullification out loud. Darrell Brooks attempted to argue for jury nullification at his 2022 intentional homicide trial despite the judge's warnings.

Luigi Mangione pleaded not guilty Monday to New York state charges in the killing of UnitedHealthcare CEO Brian Thompson, as his defense complained about police parading him in “perp walks” that are “perfectly choreographed, utterly political.”Mangione wore a white shirt under a maroon sweater and light colored pants in his arraignment before Manhattan Supreme Court Justice Gregory Carro. Manhattan prosecutors last week unsealed an 11-count indictment against Mangione, charging him with a host of crimes connected to the Dec. 4 slaying. Mangione pleaded not guilty to all charges. Luigi Mangione, the man accused of fatally gunning down health insurance executive Brian Thompson on a Manhattan street, pleaded not guilty on Monday to New York state murder charges that brand him a terrorist. Mangione leaned into a microphone and said "not guilty" when asked how he pleaded to the 11-count indictment, which includes three murder charges, including murder as an act of terrorism. "They are treating him like he is some sort of political fodder, some sort of spectacle," Agnifilo said. Monday's arraignment was the second court appearance in New York for Mangione, 26. U.S. Magistrate Judge Katharine Parker ordered Mangione detained at a Dec. 19 presentment on those charges.
