☆ KFC sues Church’s over ‘Original Recipe’

Last week, KFC accused Church’s Texas Chicken of violating its trademark rights when its fried chicken competitor began using the words “Original Recipe” in its advertising and promotions. KFC claimed in a lawsuit that beginning September 30, it noticed Church’s “abruptly” began using the phrase and ignored KFC’s October 24 letter objecting to the ads. In the disputed promotions, Church’s posted photos of its fried chicken deals with text above reading: “our original recipe is back.”The phrase, which KFC has been using for over half a century, “is likely to create confusion in the marketplace and dilute the ORIGINAL RECIPE® Mark,” the lawsuit, which was filed in US District Court in Texas, said. But when it comes to fried chicken, KFC also has to compete with Church’s Texas Chicken, Popeyes, Raising Cane’s, Zaxby’s and more. KFC’s “Original Recipe” trademark, which it says is a secret blend of 11 herbs and spices, has long been part of the company’s branding.

CNN —Despite throwing a career-high five interceptions, Jared Goff led the Detroit Lions to a come-from-behind 26-23 victory over the Houston Texans on Sunday Night Football at NRG Stadium. The Lions trailed 23-7 heading into halftime after Goff threw three interceptions in the first half. Goff threw a career-high five interceptions in the Lions' win. Goff threw for 240 yards and two touchdowns while running back Jahmyr Gibbs added 71 yards on the ground. The Lions host the Jacksonville Jaguars next week while the Texans head to Dallas to take on the Cowboys on Monday Night Football.

Yum Brands on Tuesday reported quarterly earnings and revenue that missed Wall Street's expectation as same-store sales at KFC and Pizza Hut slid more than expected. Yum's worldwide same-store sales fell 2% in the quarter, dragged down by weaker performances at KFC and Pizza Hut, which both reported same-store sales declines of 4%. KFC's U.S. same-store sales slid 5% this quarter. The pizza chain saw its international same-store sales shrink 6%, while U.S. same-store sales fell just 1%. Demands for a federal investigation mount as witnesses and survivors of a gangway collapse at a dock in Georgia describe the “catastrophic failure” that killed seven people traveling for a festival celebrating Gullah Geechee history. DARIEN, Ga. — The seven people killed Saturday in a gangway collapse on a Georgia barrier island were all in their 70s, except for one woman in her 90s, the coroner said Sunday. A portion of the gangway which collapsed Saturday afternoon remains visible on Sapelo Island in McIntosh county, Ga., on Sunday. Sapelo Island ferry service will resume Monday using an auxiliary dock, Department of Natural Resources spokesperson Tyler Jones said Sunday. It’s not clear if any of those who died in Saturday's collapse were Gullah Geechee people. Meanwhile, Grovner said, survivors of those who died Saturday will be embraced by the Gullah Geechee and their longstanding fight to exist.

US Steel and Nippon Steel both indicated in statements that they’re open to legal fights to get the deal approved, no matter what actions is announced by Biden. Shares of US Steel (X) closed down 17.5% on the news at $29.37, well below the $55 a share that Nippon Steel agreed to pay for the stock back in December when the deal was announced. US Steel said the future of this and other union-represented plants at the company are at risk unless it gets approval to be purchased by Nippon Steel. New York CNN —Fast food giant Yum Brands is going all in on value — but only Taco Bell is performing well enough to immediately bring back inflation-weary customers. But Gibbs said Taco Bell is outperforming its rivals in the fast food industry. “I think we’re really seeing Taco Bell stand out from the crowd,” he said to investors.
