CNN —A hearing that could derail the election subversion case against Donald Trump and others in Georgia is underway as a judge considers whether Fulton County District Attorney Fani Willis should be disqualified. It’s unclear if another prosecutor in Georgia would even be inclined to take up the case from Willis, given its political and legal challenges. Wade and Willis acknowledged in court filings that they had a personal relationship but deny any wrongdoing. McAfee called for the hearing Thursday to “establish the record on those core allegations” against Willis and Wade and their relationship. “We are focusing on what the judge asked us to show him – the personal and financial benefits that Willis got from Wade,” Merchant told CNN.

Lawyers for Mark Meadows asked a judge to dismiss the criminal charges against him. He faces RICO charges in Georgia for his efforts in Trump's scheme to overturn election results. His lawyers say he was just doing his job as Trump's chief of staff. Even if state officials like Willis deem his activities as breaking state law, they're consistent with federal law and therefore protected, according to his lawyers. "Even if they had, moreover, a federal official does not lose Supremacy Clause immunity based on a violation of federal law where the violation was not clear and willful."

Donald Trump must surrender to Fulton County, Georgia, authorities by August 25. When you voluntarily surrender, you turn yourself in at a precinct of your own accord instead of being taken into custody by officials. In this case, Trump and his 18 allies must surrender to Fulton County authorities. Once they surrender, they will be booked and processed at the Fulton County Jail, which could include being fingerprinted and taking mugshots. In June, Trump voluntarily appeared in Miami court for arraignment after being accused of taking classified documents from the White House and bringing them to his home at Mar-a-Lago, hiding them from authorities.

Legal experts told Insider that some of them might flip on Trump and cooperate with the prosecution. "It's not surprising to see unindicted co-conspirators," Anna Cominsky, an associate professor of law and the director of the Criminal Defense Clinic at New York Law School, told Insider. She said that some unindicted co-conspirators will never be charged "for whatever reason, perhaps there they're not known. "The other reason why those individuals may not be charged is because they're cooperating," Cominsky said. "There are all kinds of reasons to do that," Tobias told Insider.

Donald Trump's advisors say he's is "very upset" that Rudy Giuliani was indicted, Maggie Haberman told CNN. Giuliani was indicted alongside Trump in Georgia on Monday night over their attempt to overturn the 2020 election. "One of the ironies right now in the situation around Donald Trump is you will hear some of his advisors say 'He's really upset that Rudy got indicted,' or, leading into this, 'He was really worried about Rudy,'" Haberman told Collins. The main requirements under the federal RICO law are at least two underlying crimes and participation in a criminal enterprise over a long period of time. WHY ARE PROSECUTORS USING RICO? That means prosecutors would not necessarily have to prove Trump personally broke the law but knowingly coordinated with others who did. RICO cases are inherently more complex because prosecutors must first prove the existence of a criminal enterprise. Prosecutors will need to prove that Trump and his co-defendants worked together towards a common criminal purpose, which is not always as straightforward as proving an underlying RICO crime.

District Attorney Fani Willis brought charges against Trump and 18 other defendants under the Georgia Racketeer Influenced and Corrupt Organizations (RICO) Act. The charges include forgery in the first degree, false statements and writing, and violating the RICO Act.
