Disputes across the country are brewing over the role of local election boards and how much power they have to question – or even throw out – election results. In Georgia, for instance, Trump-backed members of the state election board recently passed controversial rules that could allow local election boards responsible for certifying results to conduct investigations that threaten to delay certification. One of the Georgia rules, the “Reasonable Inquiry Rule,” would allow election officials to conduct a “reasonable inquiry” before certifying election results. The petitioners in the case argue that the rule would give partisan board members a wide ability to cast doubt on, or even reject, election results. In some cases, the threat of legal action has been enough to deter officials from pursuing challenges to the certification process.

ATLANTA (AP) — The charges against former President Donald Trump in the Georgia election interference case seek to criminalize political speech and advocacy conduct that the First Amendment protects, his lawyers argued in a court filing challenging the indictment. Fulton County Superior Court Judge Scott McAfee plans to hear arguments on that filing and on two pretrial motions filed by former Georgia Republican Party chair David Shafer during a hearing set for Thursday. Lawyers for Shafer argue that he acted legally when he and other state Republicans signed a certificate asserting that Trump won the 2020 presidential election in Georgia and declaring themselves the state’s “duly elected and qualified” electors. McAfee is forging ahead with the case even as Trump and other defendants have said they plan to seek a ruling from the Georgia Court of Appeals to disqualify District Attorney Fani Willis. The charges against him include impersonating a public officer, forgery, false statements and writings, and attempting to file false documents.

ATLANTA (AP) — A bill to require cash bail for 30 additional crimes is headed to Georgia Gov. The GOP-dominated House voted 97-69 for Senate Bill 63 on Monday, backing a measure that would erodes changes that Republican Gov. “This legislation will make it clear that Georgia is not going down the path of failure seen by other states and communities that have eliminated cash bail," Gaines said. It’s part of a push by Republicans nationwide to increase reliance on cash bail, even as some Democratic-led jurisdictions end cash bail entirely or dramatically restrict its use. Under the bill, bail would be required for a second or later misdemeanor offense of reckless driving or criminal trespass, as well as for any misdemeanor battery.

ATLANTA (AP) — Accusations that Fulton County District Attorney Fani Willis had an inappropriate relationship with a special prosecutor she hired to seek convictions of Donald Trump and others for interfering in Georgia's 2020 election have led to renewed calls to remove Willis from the case. Merchant alleges that Willis' office paid Wade large sums and that Willis improperly benefited when Wade then paid for the two of them to go on vacations. Willis, an elected Democrat, has shown no signs of stepping down, but there are ways she could be removed. COULD WILLIS STEP AWAY FROM THE CASE IN ORDER TO SAVE IT? ATLANTA (AP) — Jury selection is set to begin Friday for the first defendant to go to trial in the Georgia case that accuses former President Donald Trump and others of illegally scheming to overturn the 2020 election in the state. CHESEBRO WILL BE TRIED BY HIMSELFUntil Thursday morning, Chesebro was set to go on trial alongside Powell after each filed a demand for a speedy trial. On Monday, prospective jurors will be called in groups of 14 for individual questioning. Then the prosecution and the defense attorneys will have one hour per group of 14 prospective jurors to ask questions. McAfee recently said he would tell prospective jurors during jury selection that it's likely to take up to five months.

CNN —Trump-era Justice Department official Jeffrey Clark cannot move his Georgia election subversion case from state to federal court, a judge ruled Friday. All defendants in the Georgia case – including Clark, Trump and Meadows – pleaded not guilty. The three fake electors – former Georgia GOP chair David Shafer, sitting Georgia state Sen. Shawn Still, and former Coffee County GOP chair Cathy Latham – have pleaded not guilty. Lawyers for the three fake electors clashed with Fulton County prosecutors at a recent hearing about where their case should be tried. Several struck cooperation deals with prosecutors last year, and Willis said in a recent filing that at least four uncharged fake electors would be witnesses at trial.

ATLANTA (AP) — Lawyers for three Georgia Republicans, who falsely claimed that Donald Trump won the state and they were “duly elected and qualified” electors, are set to argue Wednesday that criminal charges against them should be moved from state to federal court. Shafer, Still and Latham have all indicated in court filings that they will not be present in court for the hearing. If their cases are moved to federal court, a jury would be drawn from a broader and potentially less Democratic pool than in Fulton County alone. Prosecutors allege that Shafer, Still, Latham — and the other Georgia Republicans who participated in that plan — “falsely impersonated” electors. They argued in court filings that “contingent electors” are not presidential electors — either the contingency is met and they become presidential electors or it is not met and the losing candidate's electors have no role.

ATLANTA (AP) — A Georgia state senator won't be suspended from office after he was one of 18 others indicted along with former President Donald Trump on charges that he sought to illegally overturn the results of the 2020 presidential election in the state. Two of the people charged have filed speedy trial demands, and Judge Scott McAfee set their trial for Oct. 23. That could lead to multiple trials in the high-profile case happening simultaneously, creating security issues and “unavoidable burdens” on witnesses and victims, prosecutors argued. Five of the defendants are seeking to move their cases to federal court, and lawyers for Trump have said he may do the same. But prosecutors noted that the law explicitly allows a case to continue to move forward in a state court while the question of moving a case to federal court is pending. Federal Judge Steve Jones last week rejected the attempt by Trump White House chief of staff Mark Meadows to move his case to federal court and sent it back to state court, but Meadows is appealing that ruling.

Since lawyers Kenneth Chesebro and Sidney Powell have both filed speedy trial demands, Fulton County Superior Court Judge Scott McAfee said their trial would begin Oct. 23, but he seemed skeptical of prosecutors’ arguments that all 19 defendants could be tried together that soon. The judge said Chesebro and Powell would be tried together starting on the Oct. 23 trial date already set for Chesebro to comply with their demands for a speedy trial. Four other defendants who are also seeking to move their cases to federal court have hearings set before Jones later this month. Whenever and wherever any trial in the case ultimately takes place, jury selection is likely to be a challenge. Jury selection in a racketeering and gang case brought last year by Willis began in January and is still ongoing.
