Amnesty International said Thursday that it had found evidence that Israel has committed genocide against Palestinians in its war in Gaza. It also comes as another blow to Israel’s contention that its conduct has been justifiable. The Amnesty International report adds to such claims against the government from inside and outside of Israel, including a former defense minister who said his country was committing war crimes and ethnic cleansing in Gaza, and the International Criminal Court's arrest warrant against Prime Minister Benjamin Netanyahu for alleged war crimes and crimes against humanity. A spokesperson for the Israel Defense Forces called the report's claims "entirely baseless." Amnesty International said Israel had committed acts prohibited by the Genocide Convention, an international treaty that criminalizes genocide, citing “killing, causing serious bodily or mental harm and deliberately inflicting on Palestinians in Gaza conditions of life calculated to bring about their physical destruction.”The organization added that Israel has done so “with the specific intent to destroy Palestinians,” a group protected under the Genocide Convention.

Francis, leader of the 1.4-billion-member Catholic Church, is usually careful not to take sides in international conflicts, and to stress de-escalation. Francis has not previously described the situation in Gaza as a genocide in public.

The International Court of Justice on Friday ordered Israel to “immediately” halt its military offensive in the city of Rafah in southern Gaza, dealing another blow to the country as it faces increasing international isolation and a drumbeat of criticism over its conduct in the war. The court has few effective means of enforcing its order, and it stopped short of ordering a cease-fire in Gaza, with some of the court’s judges arguing that Israel could still conduct some military operations in Rafah under the terms of their decision. But the order added more pressure on the government of Prime Minister Benjamin Netanyahu, who has faced domestic and external calls to reach a cease-fire deal with Hamas that would lead to the release of hostages held in Gaza. “The court considers that, in conformity with obligations under the Genocide Convention, Israel must immediately halt its military offensive, and any other action in the Rafah governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part,” the court’s president, Nawaf Salam, said in reading the 13-2 ruling.

CNN —The signs are mounting that the International Criminal Court (ICC) is weighing an indictment against Israeli Prime Minister Benjamin Netanyahu and other top Israeli officials over Israel’s conduct of its war against Hamas in Gaza. But in 2015 the ICC stepped in to decide that implicitly it is, by accepting it — without consulting the Assembly of States Parties (ASP), representing ICC member states. Could the highly respected chief prosecutor, Britain’s Karim Khan, be feeling some pressure to play his part in ramping up the pressure on Netanyahu? CNN —The United Nations’ top court struck down a demand by Nicaragua that Germany immediately halt its arms exports to Israel on Tuesday, saying it cannot issue emergency measures against Berlin under the current circumstances. However, the court also rejected Germany’s demand to strike the lawsuit from its list, meaning the case will now move on. The ruling on Tuesday only concerned whether or not Berlin should be ordered to immediately stop selling arms to Israel. Germany “welcomed the ICJ ruling” according to a statement posted by the German Foreign Ministry on X shortly after the announcement. The ICJ is still considering whether Israel is guilty of violating the Genocide Convention, a legal process that could take years.

Berlin CNN —Germany has hit back at allegations by Nicaragua that it has been “facilitating genocide” in Gaza, telling an international court on Tuesday that history undergirds German support for Israel. But Germany argued Tuesday that because the “bedrock” of Nicaragua’s case was aimed at Israel and its “alleged violations of international law by Israel,” the ICJ did not have jurisdiction. British lawyer Samuel Wordsworth, who advocated on behalf of Berlin, said the case against Germany is “entirely dependent” upon a “prior finding of breach” of international law by Israel in Gaza. The ICJ is hearing a separate case brought against Israel by South Africa, but has not ruled on whether Israel has breached international law in Gaza. The international court will now consider whether to order the emergency measures requested by Nicaragua.

CNN —There are “reasonable grounds” to believe Israel is “committing the crime of genocide against the Palestinians as a group in Gaza,” the United Nations’ Special Rapporteur on human rights in the Palestinian territories has said. Francesca Albanese made the remarks Wednesday following the submission of her latest report called “Anatomy of a Genocide” to the UN Human Rights Council in Geneva on Monday. Speaking at a press conference, Albanese said: “Israel has committed three acts of genocide with a requisite intent: killing members of the group, causing serious bodily or mental harm to members of the group, and deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part.”Israel said it “utterly rejects” the report, which it said “brings shame” on the Human Rights Council. Hamas’s Oct. 7 attack on Israel had many unpredictable consequences, but the elevation of the International Court of Justice to global public attention is a particularly unexpected one. In December, South Africa brought a case against Israel alleging violations of the Genocide Convention, and last week the court held hearings on a separate matter regarding Israel’s occupation of Palestinian territories. And although the court’s enforcement powers are limited, its public hearings, at a time of intense interest in the conflict, give it considerable power to shape, and reflect, global opinion. The court’s conspicuous role is partly a coincidence of timing: The U.N. General Assembly requested that the court in The Hague issue a nonbinding advisory opinion on the legality of Israel’s occupation back in January 2023. It’s unlikely we’d be discussing those hearings in detail if war had not broken out in the meantime, and if South Africa had not filed its genocide case in the same court.

The ICJ's six days of hearings starting on Monday come after the U.N. General Assembly asked the court in 2022 for an advisory, or non-binding, opinion on the occupation. It is the second time the U.N. General Assembly has asked the ICJ, also known as the World Court, for an advisory opinion related to the occupied Palestinian territory. “The International Court of Justice is set for the first time to broadly consider the legal consequences of Israel’s nearly six-decades-long occupation and mistreatment of the Palestinian people,” said Clive Baldwin, senior legal adviser at Human Rights Watch. While Israel has filed a written statement with the court, it has not asked to participate in the hearings.

AMSTERDAM (Reuters) - Nicaragua has filed an application with the International Court of Justice (ICJ) to join South Africa in its genocide case against Israel, the ICJ, also known as the World Court, said on Thursday. The court said in a statement that Nicaragua considers that the conduct of Israel is in "violation of its obligations under the Genocide Convention". South Africa and Israel have been invited to furnish written observations on Nicaragua's application for permission to intervene as a party. Several other states have signalled they might want to intervene in the Gaza genocide case but none have formally done so before Nicaragua. Last month the World Court ordered Israel to prevent acts of genocide against Palestinians and do more to help civilians, although it stopped short of ordering a ceasefire as requested by South Africa.

CNN —The United Nations’ top court on Friday said that it will move forward with a case brought by Ukraine over Russia’s justification of its February 2022 invasion. Kyiv had asked the court to declare it did not commit genocide in eastern Ukraine - a claim made by Russia as a pretext for launching its attack. Ukraine filed the the case to the International Court of Justice (ICJ) just days after Russia launched its invasion on February 24, 2022, citing Moscow’s invocation of the Genocide Convention to justify its assault. During hearings in September last year, lawyers representing Moscow urged judges to throw out the entire case. Ukraine is asking the court to rule “that there is no credible evidence that Ukraine is responsible for committing genocide in violation of the Genocide Convention in the Donetsk and Luhansk oblasts of Ukraine.”However, the court said it did not have the jurisdiction to rule on all submissions put forward by Ukraine, including the claim Russia’s invasion itself violated the Genocide Convention and that Russia’s recognition os separatist territories in eastern Ukraine also breached the convention.

The court rejected Ukraine’s requests to order reparations for both violations and only ordered Russia to comply with the treaties. Ukraine’s representative Anton Korynevych stressed the judgment was important for Kyiv because it did establish Russia violated international law. Ukraine had filed the lawsuit at the ICJ, also known as the World Court, in 2017, accusing Russia of violating an anti-terrorism treaty by funding pro-Russian separatists in Ukraine. In a hearing at the court in The Hague last June, Russia dismissed Ukraine’s allegations that it funded and controlled pro-Russian separatists in eastern Ukraine as fiction and “blatant lies”. The court dismissed all of the claims related to the Tatars but found Moscow did not do enough to support Ukrainian language education.
