CVS Health and UnitedHealth Group are demanding Federal Trade Commission Chairwoman Lina Khan and two other commissioners recuse themselves from a lawsuit accusing the companies and other drug middlemen of boosting their profits while inflating insulin costs for Americans. In separate motions filed Tuesday night with the FTC, CVS and UnitedHealth argued that all three commissioners have an extensive track record of making public statements that indicate "serious bias" against the companies' so-called pharmacy benefit managers. CVS said those statements demonstrate that the commissioners have "prejudged this matter," so their participation in the case "violates due process." The FTC filed the suit last month against the three largest PBMs, CVS Health's Caremark, UnitedHealth Group 's Optum Rx and Cigna 's Express Scripts. The FTC has been investigating PBMs and their role in insulin prices since 2022.

The Federal Trade Commission on Wednesday announced a crackdown on what the regulator called "deceptive AI claims and schemes" by three business opportunity ventures and two companies, including the legal services firm DoNotPay. "Using AI tools to trick, mislead, or defraud people is illegal," FTC Chair Lina Khan said in a statement. "The FTC's enforcement actions make clear that there is no AI exemption from the laws on the book," Khan said. In a complaint, the FTC said that DoNotPay, which touted its AI service as "the world's first robot lawyer," failed to live up to that claim. "Since about 2023, Defendants' deceptive sales pitch has said their business model is powered by artificial intelligence ("AI")," the suit says.

Hong Kong CNN —Fitch downgraded its outlook on China’s credit rating on Tuesday, citing increasing risks to its finances as it faces economic challenges. Lowering its outlook from stable to negative does not automatically mean the ratings agency will downgrade China’s creditworthiness, but it increases the chances. Fitch has kept its rating on Chinese sovereign bonds at A+. Fitch believes the general government deficit will rise to 7.1% of gross domestic product in 2024 from 5.8% last year. In December, rival ratings agency Moody’s downgraded its outlook on China’s credit rating from stable to negative, citing risks related to “structurally and persistently lower medium-term economic growth” and ongoing troubles in its property sector.

The aerial view shows residential buildings under construction in Hangzhou, China on March 15, 2024. Ratings agency Fitch revised its outlook on China's sovereign credit rating to negative on Tuesday, citing risks to public finances as the economy faced increasing uncertainty in its shift to new growth models. Fitch forecast the general government deficit would rise to 7.1% of gross domestic product (GDP) in 2024 from 5.8% in 2023, the highest since a reading of 8.6% in 2020, when Beijing's strict Covid curbs weighed heavily on the world's No. While it lowered its outlook, indicating a downgrade is possible over the medium term, the agency affirmed China's IDR rating at "A+." Fitch forecast China's economic growth would slow to 4.5% in 2024 from 5.2% last year, in contrast to Citi and the International Monetary Fund, which both revised up their China forecasts.

"China's overcapacity distorts global prices and production patterns and hurts American firms and workers, as well as firms and workers around the world." China has a surplus of solar power, electric vehicles and lithium-ion batteries that it can ship out to other countries at cheaper prices. Yellen said she intends to put pressure on Chinese officials about these trade practices during her upcoming visit to China. Meanwhile, China has been pouring billions into clean energy for years, outpacing the rest of the world in the energy transition. Yellen added that the more China's clean energy glut interferes with global market prices, the worse off supply chains for these energy sectors will be.

In an interview with the Financial Times, CBO director Phillip Swagel said US government debt — which the Treasury Department puts at nearly $35 trillion — is on an “unprecedented” trajectory. UK government bonds, or gilts, and the pound sold off sharply, partly in response to plans by Truss to issue more debt in order to pay for tax cuts. Mortgage rates and other borrowing costs soared as investors demanded much higher premiums for owning UK debt. He has promised to extend his 2017 tax cuts and has also spoken about reducing the corporate tax rate from the current 21% to 15%. “I will make the Trump tax cuts the largest tax cut in history,” he said last month at the Black Conservative Federation’s Honors Gala in South Carolina.

Congress has until Friday at midnight to pass six major spending bills to avert a partial government shutdown. Six spending bills that cover roughly three-quarters of all federal discretionary spending are at stake:– Defense: Includes funding for nearly all military-related activities. – State, Foreign Operations and Related Programs: Includes funding for U.S. diplomatic activities, cultural exchanges, development and humanitarian assistance. As of Monday morning, appropriators had yet to release any of the six funding bills they’ll need to pass. October 1 has been the official kickoff date for the federal fiscal year since 1977. Lawmakers have passed at least one continuing resolution in all but three of the years in the nearly half-century since. Instead, they will wrap the spending bills into larger packages – frequently called an “omnibus” that is passed in December or later. In 1997, for instance, there was no CR, but the spending bills were all passed together as an omnibus. Don’t hold your breath for them to get the 2025 spending bills done on time.

The House and Senate both passed a stopgap bill on Thursday to avert a partial government shutdown at the end of the week. The House vote was 320 to 99 with 113 Republicans voting in favor and 97 Republicans voting against. “The appropriations process is ugly,” Johnson told reporters on Thursday. Rep. Marjorie Taylor Greene of Georgia, who will vote against the stopgap bill, swiped at the speaker over cutting a deal with Democrats on government funding. Rep. Tim Burchett of Tennessee, who was one of the eight Republicans who voted to oust McCarthy, said he opposed the stopgap bill and broader funding deal but was sympathetic to Johnson’s circumstances.

COLUMBUS, Ohio (AP) — Banning marijuana growing at home, increasing the substance's tax rate and altering how those taxes get distributed are among vast changes Ohio Senate Republicans proposed Monday to a marijuana legalization measure approved by voters last month. “This is not what voters wanted.”The Senate changes still have a long way to go, however. The Senate's proposal also would increase the approved tax on marijuana products of 10% to 15%. Tax revenue would go toward general state funding, law enforcement training, substance abuse treatment and prevention and safe driving training. Under the new measure, marijuana products would have to be sold in child-safe packaging and could not resemble any animals, fruit or fictional characters such as those from cartoons.

The Wall Street sign is pictured at the New York Stock exchange (NYSE) in the Manhattan borough of New York City, New York, U.S., March 9, 2020. Fed futures markets think a first cut may come as soon as March - with a quarter-point easing by then already two-thirds priced. Two-year Treasury yields hit their lowest since June on Friday and 10-year yields their lowest in three months, although they edged higher on Monday. U.S. crude hit its lowest in two weeks and is tracking year-on-year losses of almost 10%. But that is widening into yearend as peak rate hopes encourage some rotation to smaller cap stocks.

Speaker Mike Johnson enters into his big shutdown test
  + stars: | 2023-11-13 | by ( Lauren Fox | ) edition.cnn.com   time to read: +6 min
Johnson’s spending plan would fund government agencies through spending bills for the military, Veterans Affairs, transportation, housing and urban development and energy and water through mid-January. One of the first major tests for Johnson will be whether he can even pass a procedural vote for the spending bill known as the rule. McCarthy passed the last short-term spending bill under a suspension of the rules, a decision that ultimately cost him his job. Over the course of the last week, House Republicans have struggled just like they did under McCarthy to unify on spending. Congress must avoid a shutdown and pass a CR that facilitates enacting full-year spending bills and emergency assistance as soon as possible.”CNN’s Manu Raju contributed to this report.

Amid the economic turmoil of the pandemic, his government racked up Canada's highest ever deficit. Failing to curb spending now risks "the market dictating to you what you have to do with fiscal policy," said Doug Porter, chief economist at BMO Capital Markets. "I do think they have to trim the sails a bit," he added. "It's going to be easier to get inflation down if monetary and fiscal policy are rowing in the same direction," Macklem said. That shift in legal doctrine was profound, shaping how courts have applied antitrust law ever since. Khan’s ideas have challenged the closest thing to a sacred cow in antitrust law. The most ambitious of those never became law, but Khan’s role in the probe, which Cicilline described as “critical,” helped further raise her profile. Amazon and Meta have both pushed for Khan to recuse herself from matters involving the companies, questioning her objectivity. The US Federal Trade Commission sued Amazon.com Inc. in a long-anticipated antitrust case, accusing the e-commerce giant of monopolizing online marketplace services by degrading quality for shoppers and overcharging sellers.

The U.S. is in a weaker position now than when S&P downgraded its sovereign credit rating in 2011, according to the former chairman of the agency's sovereign rating committee. S&P controversially downgraded the long-term credit rating from AAA representing a "risk free" rating to AA+ as early as 2011, citing political polarization after another debt ceiling squabble in Washington. John Chambers, former chairman of the Sovereign Rating Committee at S&P Global Ratings at the time of that 2011 downgrade, told CNBC's "Capital Connection" on Tuesday that a government shutdown is likely and that the whole episode was a "sign of weak governance." This was a factor that led to S&P's downgrade of 2011, and Chambers said the U.S. fiscal position is now even weaker than it was back then. At the time, we forecasted that it might get to 100% of GDP, and the government ridiculed us for being too scaremongering," he said.
