By tradition, all eligible voters gather at the now-dormant Balsams Hotel in Dixville Notch to cast their secret ballots once polls open at midnight. Once every ballot is cast, votes are tallied and results announced – hours before anywhere else, making it a destination for national reporters, who often outnumber the voters. In 2016, the Libertarian Party presidential candidate, Gary Johnson, received more votes than any of the party’s other candidates in history and the most of any third-party candidate since Ross Perot — and arguably, the Libertarian Party has never recovered. Much like the conservative movement, the libertarian movement has been divided between more “normie” libertarians who have embraced criminal justice reform and social freedoms (like immigration and the rights of L.G.B.T.Q. And in 2024, the Libertarian Party Convention featured appearances from people like former President Donald Trump. But in a major surprise, the winner of the party’s presidential nominating process was not the Mises Caucus’s favorite but Chase Oliver, a 38-year-old, gay antiwar activist who had left the Democratic Party. I spoke with Mr. Oliver about what libertarianism means to him today, how he plans to fight for independent votes this year and why the Libertarian Party failed 2020’s “libertarian moment.”

CNN —Independent candidate Robert F. Kennedy Jr. is perhaps the biggest X factor remaining in the presidential race. That’s better than any third-party or independent candidate has polled in an individual survey at this stage in the cycle since Ross Perot in 1996. Biden is likely aware that Kennedy voters tend to skew younger – a demographic that traditionally leans Democratic. Perhaps more concerning for the independent candidate is what’s going on under the hood. He’d previously never had a net negative favorable rating in the double digits.

But the idea of simply placing Kennedy atop the Libertarian Party ticket to marry his momentum with their organization left Kennedy with an embarrassing loss at the Libertarian Party convention in Washington. About half – 51% – said they would support Trump in a two-way matchup, compared with 37% who said they would pick Biden. The last third-party candidate to win a state and get Electoral Votes was George Wallace, who won Southern states in 1968. The only third-party candidate to outperform a major party candidate was former President Teddy Roosevelt, who outpolled Republicans after he failed to get their nomination in 1912 and then ran as a third-party candidate. But rather than focus on the relatively few people who turn out for a third-party candidate, why not look at the large number of people who don’t take part in elections at all?

CNN —Independent presidential candidate Robert F. Kennedy Jr. officially qualified for the ballot in Michigan, a key battleground state that could prove pivotal in deciding the outcome of the 2024 presidential election. Natural Law Party of Michigan chair Doug Dern told CNN the party nominated Kennedy in a convention on Wednesday. The Michigan Secretary of State’s office confirmed to CNN the party’s nomination has been approved and Kennedy will appear on the state’s ballot. In a hypothetical head-to-head matchup between Trump and Biden, Trump earned 48% support from Michigan voters, while Biden earned 45% support. Michigan is the second state where Kennedy has officially qualified for the ballot.

CNN —The Joe Biden vs. Donald Trump rematch is a presumptive reality after the president and former president both dominated Republican and Democratic primaries on Super Tuesday. Independent candidates. When Kennedy, West and the Green Party’s Stein were added into the question, things changed. Trump was still on top with 42%, Biden got 39%, Kennedy had 15%, West had 3% and Stein had 2%. Buzzy independent candidates have a tendency to lose support as Election Day nears.

The White House is pressing Congress to extend a subsidy program that helps one in six U.S. families afford internet and represents a key element of President Joe Biden's promise to deliver reliable broadband service to every American household. “It seems to be a bipartisan issue — internet access and the importance of it,” Johnson said. Biden has likened his promise of affordable internet for all American households to the New Deal-era effort to provide electricity to much of rural America. He traveled to North Carolina last month to tout its potential benefits, especially in wide swaths of the country that currently lack access to reliable, affordable internet service. A man exonerated after spending over two decades in prison for murders in Queens that he did not commit will receive a $17.5 million settlement from New York City, an apparent record, according to his lawyer and city data. Mr. Bell was sentenced in 1999 to life in prison without parole. In 2021, a judge threw out the three men’s convictions and admonished prosecutors for withholding evidence that could have cast doubt on their guilt. The judge also found that prosecutors had made false statements at trial. “These three defendants were undoubtedly wronged by the district attorney’s office’s misconduct,” the judge, Joseph A. Zayas of the Appellate Division of State Supreme Court, wrote in his decision.

The West Virginia Democrat’s model has served him well with repeated statewide wins in one of the most conservative pro-Trump states in the nation. For now, Manchin’s noncommittal answers are worrying some of his Democratic colleagues. Polls show that both Biden and Trump, the front-runner for the GOP nomination, are unpopular. It argues, therefore, that 79 electoral votes are potentially at risk for Biden from the involvement of a third-party challenger. Such a challenger would also need to win states where Biden won big, and at least some conservative bastions.

This would normally be the part of the story where I’d tell you that a third-party candidate has little chance of winning next year – and I am telling you that. It’s also true, however, that 2024 is shaping up to be the kind of election Biden could lose primarily because of a third-party candidacy. This year it’s pretty clear that such a portion of third-party voters probably already exists for a simple reason: Biden and Trump are historically unpopular. The headlines and the fears Democrats have about a third-party candidate are, at least partially, a tacit acknowledgement that Biden is unpopular. So why aren’t we hearing Republicans worry about a third-party candidate?
