The pro-Trump cable outlet Newsmax and voting technology company Smartmatic settled a major 2020 election defamation lawsuit Thursday in a last-minute agreement to avoid a high-stakes trial. But in the run-up to the trial, Smartmatic’s hand weakened significantly, further raising the possibility of a settlement. Smartmatic has claimed that the lies promoted by Newsmax, Fox News, and other Trump allies destroyed its reputation and cost the company billions of dollars. However, as the Newsmax trial approached, Smartmatic’s lawyers reduced the company’s damages claim to approximately $370 million, according to statements in court. CNN —DirecTV filed a complaint Saturday with the Federal Communications Commission alleging Disney did not negotiate in good faith as the two sides remain at an impasse on a distribution deal. ESPN owns the broadcast rights to “Monday Night Football,” which will be blacked out for DirecTV subscribers unless a deal is reached. “We continue to negotiate with DirecTV to restore access to our content as quickly as possible,” a Disney spokesperson told CNN on Sunday. The opening game for “Monday Night Football” features the New York Jets and San Francisco 49ers. The blackout also includes ESPN’s suite of channels and the Disney Channel, Disney Jr., FX and National Geographic.

In a court filing Monday, Smartmatic subpoenaed the four board members — Anne Dias, Charles Carey, Roland Hernandez, Jacques Nasser — over Fox News’s repeated airing of bogus conspiracy theories that the 2020 election was stolen from former President Donald Trump. “Smartmatic plans to pursue Fox’s board members as well to determine why they allowed the company’s most valuable asset, Fox News, to spread disinformation about the 2020 election.”New York Judge David Cohen had previously ordered Fox Corporation to turn over documents related to the board members in the case. It’s the second time Murdoch has been engaged in a year. Last March, the media titan announced plans to marry Ann Lesley Smith, a former dental hygienist and conservative radio host. Murdoch and Zhukova reportedly started dating in the summer and plan to marry at Moraga Bel Air, Murdoch’s luxury vineyard and estate in California. Murdoch was previously married to former flight attendant Patricia Booker, journalist Anna Murdoch and entrepreneur Wendi Deng, who reportedly introduced him to Zhukova.

Not only have theme park visits gotten more expensive, but so have Disney’s cruise vacations, souvenirs and the company’s streaming services. Over the summer, Disney quietly raised the prices at two of the adult-exclusive restaurants on board its cruise ships to $135 per person for dinner, a nudge up of $10, according to the Disney Cruise Line Blog. Cohen already let the case proceed against Fox News — and on Wednesday, he rejected a request by Fox Corporation to throw out the claims against the parent company. The parent corporation had argued that it shouldn’t be involved in the defamation case because it only had general oversight of Fox News itself. The case is still in the discovery phase, with some major depositions taking place in the past month, including former Fox Corporation chairman Rupert Murdoch. The decision boosts Smartmatic’s case against the right-wing media behemoth. A similar 2020-related lawsuit by Dominion Voting Systems was also allowed to proceed against Fox and its parent company.

New York CNN —Tucker Carlson’s top producer, who left Fox News along with the far-right host to work on his X show, is accused of sexually assaulting a former colleague in an alleged incident that occurred more than a decade ago. Andrew Delancey, a former Fox News employee, filed a lawsuit against Justin Wells, the former executive producer of “Tucker Carlson Tonight,” accusing him of sexual assault and harassment in 2008 when Delancey moved to New York for a job with Fox News’ affiliate video service. In the lawsuit, Delancey alleges that he was befriended by Wells who told Delancey he could help him “learn the ropes” of the right-wing cable network. At the time Wells was a producer for Greta Van Susteren’s Fox News show. Fox fired Carlson in April and canceled his program during the fallout from the $787 million lawsuit settlement between Fox News and Dominion Voting Systems.

CNN —Rupert Murdoch is set to be deposed on Tuesday in voting technology company Smartmatic’s mammoth $2.7 billion election defamation lawsuit against Fox News, a person familiar with the matter told CNN. Murdoch founded Fox News and served as executive chairman of Fox Corporation, Fox News’ parent company, until earlier this month, when the 92-year-old media baron transitioned to chairman emeritus, crowning his son Lachlan as king of his media empire. A spokesperson for Fox Corporation declined to comment, though the company has consistently said it plans to vigorously fight the lawsuit. Smartmatic filed its lawsuit against Fox Corporation in 2021 after it was swept up in baseless conspiracy theories about the 2020 election. In April, Fox Corporation reached a historic $787 million settlement in a similar election lies case filed by another voting technology company, Dominion Voting Systems.
