Wall Street returned to its winning ways this week — and Nvidia 's blowout earnings report Wednesday night was a big reason why. Twenty-six of our 32 portfolio stocks have delivered their results this earnings season (we didn't own Abbott Labs at the time of its report). It was a muted week for macroeconomic data, but we did get a slightly better-than-expected January existing home sales report on Thursday. In the week ahead, two more Club names are set to report earnings before a market-moving economic update arrives Thursday morning. The two other reports of note are the January new home sales report on Monday and ISM Manufacturing report on Friday.

Six Flags plans a "strollerpalooza" this summer to bring families back, The Wall Street Journal reported. Jeffrey Siebert of Six Flags Fiesta Texas said it had revamped designs and added kid-friendly rides. Speaking to The Wall Street Journal, Six Flags Fiesta Texas's president Jeffrey Siebert said the company was planning a "strollerpalooza" this summer, referring to plans to increase the numbers of families visiting its attractions. He also said he was trying to turn Six Flags customers from "the Kmart, Walmart to maybe the Target customers." Shares in Six Flags have fallen 62% over the past five years, leaving the company worth just over $2.2 billion.

For a private placement under Rule 144A, the financing parties may offer some flexibility regarding the required financing statements. The term refers collectively to provisions that benefit debt financing parties by limiting their liability in an acquisition financing, including provisions that provide for:No recourse to the financing parties. The target company has no recourse against the financing parties and cannot pursue litigation against the financing parties directly. The financing parties are third-party beneficiaries of the Xerox provisions to permit the financing parties to enforce their rights under the merger agreement.

New York CNN —Two anonymous women who accuse the late Jeffrey Epstein of sexual abuse have filed separate civil lawsuits against JP Morgan Chase & Co. and Deutsche Bank AG, claiming the big banks enabled and benefitted financially from Epstein’s alleged sex trafficking operation. The class action suits were filed in part under a new law in New York, which allows adult sexual abuse survivors to sue their alleged abusers, even if the statute of limitations has expired. Specifically, Deutsche Bank chose facilitating a sex trafficking operation in order to churn profits,” the suit claims. The suit alleges Deutsche Bank ignored red flags including payments to numerous young women and large withdrawals of cash. In 2020, New York regulators fined Deutsche Bank $150 million and slammed the lender for “mistakes and sloppiness” in its relationship with Epstein.
Thomas Lauria runs the bankruptcy team at White & Case where clients have included Hertz and Johnson & Johnson. But Lauria told Insider that the ability of crypto companies to reorganize will depend on whether they have any real assets. Notably, when Lauria represented Hertz in its Chapter 11 case during the coronavirus pandemic, even its unsecured creditors were repaid in full. So I'm not sure that what's happening in crypto right now is really going to be a reorganization boom, but really probably more of a liquidation boom. About $10 billion of Hertz debt, when they filed, was related to financing in connection with their US fleet.
Oct 23 (Reuters) - Australia will introduce laws to parliament to increase penalties for companies subject to major data breaches, Attorney-General Mark Dreyfus said, after high-profile cyberattacks hit millions of Australians in recent weeks. When Australians were asked to hand over personal data to companies, they had a right to expect it would be protected, the attorney-general said. "Significant privacy breaches in recent weeks have shown existing safeguards are inadequate. It's not enough for a penalty for a major data breach to be seen as the cost of doing business," Dreyfus said. "We need better laws to regulate how companies manage the huge amount of data they collect, and bigger penalties to incentivise better behaviour."
