New York prosecutors told the judge who presided over Donald Trump's hush money trial on Tuesday that his sentencing should be postponed while the president-elect's lawyers file further legal arguments asking the case be dismissed. The proposal Tuesday from Manhattan District Attorney Alvin Bragg's office would need to be signed off on by Judge Juan Merchan to become official. A ruling against Trump on the issue would have paved the way for the judge to proceed with his sentencing, which was tentatively scheduled for Nov. 26. That case has been paused while Trump and some of his co-defendants seek to have an appeals court remove Willis from the case for an alleged conflict of interest. Trump's lawyers have contended that even if she’s allowed to remain on the case, any Trump trial would have to wait until he’s out of office in 2029 because of constitutional issues.

A Georgia appeals court on Monday canceled until further notice oral arguments on an effort by President-elect Donald Trump and other co-defendants to remove Fulton County District Attorney Fani Willis from the criminal election interference prosecution against them. The Georgia Court of Appeals acted on its own in canceling the arguments scheduled for Dec. 5. Trump and other defendants had appealed that ruling, and the Court of Appeals in June halted proceedings in the case pending the outcome of that effort. Circuit Court of Appeals to suspend proceedings in that case, citing Trump's election victory. That federal appeals court granted Smith's request.

The judge overseeing Donald Trump's New York criminal trial delayed a key ruling Tuesday on whether the president-elect's conviction should be set aside, according to correspondence between the parties. The court has granted them a week's delay to provide their position, the clerk informed both sides in a court filing. CNN —The Supreme Court declined Tuesday to let Mark Meadows move his Georgia election subversion case to federal court, effectively barring the former chief of staff during Donald Trump’s first term from claiming immunity from those charges. Meadows wanted to have his case heard in federal – rather than state – court, where he would be able to raise immunity claims. The Atlanta-based 11th US Circuit Court of Appeals ruled last year that the Georgia prosecution against Meadows should continue in state court, concluding that former federal officials are not covered by that statute “removing” state cases against government officials to federal court. The Georgia case has been at a standstill while an appeals court considers ethics allegations against Fulton County District Attorney Fani Willis. Meadows has also sought to move his criminal case related to the 2020 election in Arizona to federal court but failed to convince a judge in September.

An Alabama man was sentenced Tuesday to one year and nine months in prison for threatening a sheriff and a district attorney in Georgia over the jail mug shot of former President Donald Trump, prosecutors said. Hanson also threatened District Attorney Fani Willis, saying that if Trump was indicted, "anytime you’re alone, be looking over your shoulder." Hanson made the threats in two voicemails left for Labat and Willis on Aug. 6, 2023, before Trump was indicted or his mug shot was taken. A co-defendant in the racketeering and gun conspiracy case against Atlanta rapper Young Thug accepted a plea deal Tuesday after days of speculation over whether Georgia's longest-running criminal trial may end in a mistrial. Young Thug and the others have been jailed since 2022 on charges of conspiracy and criminal street gang activity and additional firearm- and drug-related charges. The indictment accuses Young Thug, 32, of leading a street gang, Young Slime Life, or YSL, with members committing illegal and violent acts, including murder, armed robbery, drug dealing and carjacking. Opening statements finally began last November after several defendants had already taken plea deals while others chose to be tried separately from Young Thug. The defendants have denied they are part of a street gang and critics contend the RICO law is being unfairly used against Black hip-hop artists.

Fulton County prosecutors asked a Georgia appeals court this week to restore six charges against former President Donald Trump that were tossed in his indictment over attempts to overturn his 2020 election loss in the state. In a court filing, prosecutors from Fulton County District Attorney Fani Willis' office requested that the state's Court of Appeals reinstate six counts, including three against Trump, that she said Fulton County Superior Court Judge Scott McAfee wrongly discarded earlier this year. "The trial court erred by quashing six counts of the indictment in this case, each of which alleged the crime of Solicitation of Violation of Oath by Public Officer," they wrote. CNN —Fulton County District Attorney Fani Willis has asked the state’s Court of Appeals to reinstate six counts in the election subversion case against Donald Trump and his co-defendants, including three specifically against the former president. The court filing brings the aftermath of the 2020 presidential election, and the effort to overturn Trump’s election defeat, back into the spotlight as early voting begins in Georgia in the 2024 election. The counts relate to Trump and his co-defendants’ alleged efforts to have state officials appoint a fake slate of electors for the state following his loss in the 2020 election. In his March decision, McAfee wrote that Willis failed to give the defendants “enough information” to prepare their defenses. “As written, these six counts contain all the essential elements of the crimes but fail to allege sufficient detail regarding the nature of their commission, i.e., the underlying felony solicited,” McAfee wrote at the time.

A judge on Thursday dismissed two criminal counts against Donald Trump in his Georgia election interference case, but kept intact the top racketeering charge and other counts against the former president and other defendants. Fulton County Superior Judge Scott McAfee also tossed out a third count that had been lodged against a number of Trump allies. The third count the judge tossed — numbered as Count 14 in the indictment — was criminal attempt to commit filing false documents. In March, judge tossed out three counts of solicitation of violation of oath by a public officer that had been lodged against Trump. Trump's appeal is set to be heard in oral arguments at the Georgia Court of Appeals in December.
