Donald Trump's attorneys are demanding the judge who presided over his New York hush money trial and conviction immediately throw out the case, saying it would be "uniquely destabilizing to the country" otherwise. The letter also cited presidential immunity as a reason to dismiss the case, and maintained Trump is already protected by it. "Just as a sitting President is completely immune from any criminal process, so too is President Trump as President-elect," the letter said. The attorneys have argued he can't be sentenced while in office because it would interfere with his constitutional duties. Trump was convicted earlier this year on 34 counts of falsifying business records related to a hush money payment made to adult film actor Stormy Daniels.

AdvertisementLawyers for Donald Trump on Wednesday demanded the immediate dismissal of his hush-money case. Trump can't be sentenced while either president-elect or president, they argued. Donald Trump's legal team filed for immediate dismissal of his New York hush-money case on Wednesday, arguing that he cannot be sentenced while either president-elect or president. "On November 5, 2024, the Nation's People issued a mandate that supersedes the political motivations of DANY's 'People,'" the defense filing concludes, using the acronym for the District Attorney of New York. One prosecutor should not have "practical power to interfere with the ability of a popularly elected president to carry out his constitutional functions," the defense filing says.

President-elect Donald Trump said Thursday he will nominate Todd Blanche, one of his criminal defense lawyers, to be deputy attorney general. The statement noted that Blanche has experience working for the Justice Department — something former Rep. Matt Gaetz, R-Fla., Trump's choice for attorney general, does not have. Blanche was Trump's lead lawyer when he stood trial on charges of falsifying business records related to a hush money payment this year. If Blanche's nomination is confirmed before Gaetz's, he could serve as acting attorney general while Gaetz goes through the process. He will also nominate D. John Sauer, who argued Trump's successful immunity case before the Supreme Court, for solicitor general.

CNN —Donald Trump’s lawyers and the Manhattan district attorney’s office have agreed to delay activity in the hush money case until November 19 to give the president-elect’s lawyers time to make new arguments on how his election victory impacts the case. Judge Juan Merchan was expected to rule Tuesday on whether to overturn the business fraud conviction based on this summer’s Supreme Court ruling on presidential immunity. “The stay, and dismissal, are necessary to avoid unconstitutional impediments to President Trump’s ability to govern,” Bove wrote. The Supreme Court’s immunity decision also indefinitely tied up Trump’s federal election subversion case in Washington, DC. The jury should not have heard any testimony from Hope Hicks about events in 2018 when she was the White House Communications Director, Trump’s lawyers argued.

AdvertisementDonald Trump will use his new status as president-elect in a renewed effort to challenge his upcoming sentencing on his Manhattan hush-money conviction, legal experts predicted Wednesday. Lawyers for Trump on Monday night again sought to move his hush-money case to federal court. An appellate brief reprises arguments from two failed attempts to move the case out of state court. AdvertisementLawyers for former President Donald Trump have filed a 99-page appellate brief seeking again to transfer his hush-money case to federal court. Trump's first attempt at what is called "removal" to federal court was made in May during his Manhattan trial. Leeds' allegations weren't part of Carroll's accusations, but the trial judge allowed her testimony because they demonstrated what Carroll's lawyers argued was a pattern of behavior by Trump. "It's very hard to overturn a jury verdict for evidentiary grounds," he said. Two days before his sentencing, Trump, they predict, will seek something never before allowed in the appellate courts in New York or in most states for that matter: an interlocutory appeal. AdvertisementEven Trump's Manhattan prosecutors are conceding that this is a legal monkey wrench to be reckoned with. "If New York's courts deny him a right to appeal, he can challenge the decision in federal court," said Paradis. If the federal district court in Manhattan says no, "he can appeal that to the second circuit federal court of appeals." CNN —Federal Judge Aileen Cannon said Tuesday she had “a hard time seeing” any problems with the warrant the FBI obtained to search former President Donald Trump’s Mar-a-Lago estate in the summer of 2022. Trump’s attorney Emil Bove had argued that the warrant was overly broad and unjustly allowed agents to search the entire Mar-a-Lago premises. Bove, like in other recent hearings in the classified documents case, wants the judge to hold even more hearings that could probe into the investigators’ work. “They purported to look for classified documents in a gym and a kitchen,” he added. Investigators say they found classified documents in various places at the resort, including a public ballroom, a bathroom and a bedroom.

Cannon did not seem inclined to approve the limitations on Trump’s speech but did not immediately issue a ruling. The judge also heard arguments on Trump’s long-shot motion alleging that the special counsel’s office is being improperly funded. He said that while Trump is welcome to campaign, there should be certain limits when it comes to the safety of FBI agents on the case. “Steve Bannon making a comment is potentially the kind of thing that could send President Trump to jail,” Blanche said. Republicans on Capitol Hill have also tried to buckle down on the DOJ’s use of the special counsel’s office and its funding.

Former President Donald J. Trump’s defense team tried on Friday to persuade the judge overseeing the national security documents case to dismiss the indictment, pushing a long-shot argument that the special counsel, Jack Smith, was not properly appointed. Such defense motions are routinely denied in federal cases involving special counsels. But the judge presiding over this case, Aileen M. Cannon, has given Mr. Trump’s request extra import by holding hearings and allowing three outside lawyers time in court to make additional arguments about whether there is a constitutional mechanism for naming special counsels. “The text of these statutes really matters,” said Emil Bove, one of Mr. Trump’s lawyers. He also argued that Mr. Smith should have been confirmed by the Senate because his position is so powerful.

Donald J. Trump’s lawyers on Tuesday asked the judge who oversaw the former president’s criminal trial to lift a gag order on their client as the presidential campaign intensifies. The lawyers said in a letter to the judge, Juan M. Merchan, that the end of the trial on Thursday nullified the need for the gag order, which bars the former president from attacking witnesses, the jury and others involved in the case. Mr. Trump was convicted of 34 felonies, with a jury determining that he had falsified documents related to a hush-money payment his former fixer made to a porn star in 2016. “Now that the trial is concluded, the concerns articulated by the government and the court do not justify continued restrictions on the First Amendment rights of President Trump,” the lawyers, Todd Blanche and Emil Bove, wrote in the letter.

Advertisement"The clerk of the court will give you instructions on how to go about scheduling that probation interview and getting that probation report," the judge said. But Trump won't do a penitent probation interview — or any at all, Kuby predicted. Advertisement"If he wants to show remorse, then certainly the probation report is a good place to start doing that," he added. During the first part of the interview, Trump would be asked for standard, so-called "pedigree" information — name, aliases, address, profession, marital status, that kind of thing. During the rest of the interview, Trump would be offered the chance to speak about his conviction and make a plea for leniency.

Editor's note: This is developing news and will be updated throughout the day. The 12-member jury also has asked to re-hear the instructions on the law it received Wednesday from Manhattan Supreme Court Judge Juan Merchan before they began their first day of deliberations. On its own, the crime of "falsifying business records" in New York is considered a misdemeanor crime. AdvertisementNew York Supreme Court Justice Juan Merchan explained it clearly in his hourlong instructions to the jury on Wednesday morning. "What you're asking me to do is change the law, and I'm not going to do that," Merchan told Trump's legal team. On Truth Social, Trump posted quotes from Fox News host Jesse Watters, falsely claiming "the jury can pick whatever crime they want." The defense did not call Mr. Weisselberg either, nor did Mr. Trump take the stand in his own defense. And for weeks, Mr. Weisselberg’s absence has loomed large over Mr. Trump’s case, the first criminal trial of an American president. And when Mr. Trump was sworn in as president in 2017, he entrusted Mr. Weisselberg, along with Donald Trump Jr. and Eric Trump, with running his company. Mr. Trump, Mr. Cohen told the jury, “approved” of the arrangement and knew that they would falsify records to cover it up. Read previewLawyers in the Donald Trump hush-money trial spent Tuesday afternoon in a spirited battle over this question: what will the judge tell jurors right before they begin their deliberations next week? The jury charge is so important, so sacrosanct, that Merchan will order the doors to his courtroom sealed for its duration, with no one in the well or audience allowed to enter or leave. CNN —The defense rested its case in Donald Trump’s criminal hush money trial on Tuesday after roughly 90 minutes of testimony – and without the former president taking the stand. Here are takeaways from the final day of testimony in the Trump hush money trial:Trump doesn’t take the standOver the last several months, Trump repeatedly teased that he would take the stand in his own defense. “That was a lie,” Blanche alleged of Cohen’s testimony he spoke to Trump about moving forward with the hush money deal. The witness, attorney Robert Costello, was called by the defense to attack the credibility of key prosecution witness Michael Cohen. Within minutes of taking the stand, Costello was in open conflict with New York Supreme Court Justice Juan Merchan, the judge presiding over the case. "If you don't like my ruling you don't say 'Jeez," you don't give me side eye, and you don't roll your eyes," the judge scolded. "You don't say 'strike it,'" the judge told the witness, adding that it's his job, not the witness' to strike testimony.
