Two associates of Chronis rushed to his aid after hearing his fall and screams, according to the complaint. The shower delivered water at an “extremely excessive temperature,” the complaint stated. The temperature was more than 150 degrees, according to Chronis’ family attorney, N. Jeffrey Blankenship. Most adults will suffer third-degree burns if exposed to 150-degree water for two seconds, according to the Consumer Product Safety Commission. Choice had made a $7.8 billion cash-and-stock acquisition offer worth $49.50 in cash and 0.324 shares of its common stock for each share of Wyndham. It said it first approached Wyndham in April with an $80 per share offer, which it later bumped up to $85 and then to $90 per share. A potential merger would have married Choice Hotels' brands such as Econo Lodge, Quality Inn and Clarion with Wyndham's Days Inn and Travelodge, offering inflation-hit customers a wide choice of affordable hotels.

For example, data from commercial real estate giant CBRE shows that about 25% of all New York's offices remain available for lease while other markets, like San Francisco and Boston, face similarly high vacancy rates. Silverstein's move also comes at a time when commercial real estate property values are declining. According to a November study from RentCafe, developers created more than 28,000 apartments through conversion projects in 2021, an increase of 25% when compared to 2020. Sage acquired Econo Lodge and a Travel Lodge in Tacoma, Washington for $14.2 million and plans to convert both buildings into apartments.

The company spent a total of $14.2 million to acquire the properties, which Hubbard described as "on the run-down side."
