House Speaker Mike Johnson on Sunday did not commit to calling Congress back into session before the election after President Joe Biden pressed congressional leaders about potential funding shortfalls in the aftermath of Hurricane Helene. In his letter, the president urged Congress to restore funding to the Small Business Administration’s disaster loan program, which was facing potential funding shortfalls even before Hurricane Helene devastated parts of the Southeast. The president noted that the White House requested more funding for the program as Congress prepared a short-term funding bill that passed last month to avert a government shutdown. Pressed on whether he would call Congress back into session before the election, Johnson replied, “We’ll be back in session immediately after the election.”“That’s 30 days from now. “The American people are disgusted by this, up with it, and so are Republicans in Congress,” he said.

CNN —The US Secret Service is scrambling to increase security ahead of former President Donald Trump’s first campaign rally since the failed assassination attempt on his life last week, sources familiar with the planning told CNN. “We assist the Secret Service,” a spokesperson for the sheriff’s office told CNN, adding that the Secret Service was leading all security planning for the rally. The source said the lack of these exercises have resulted in security gaps, including communication breakdowns between law enforcement partners. “The Secret Service is responsible for the security planning for presidential visits, but we stand ready to assist them with whatever they need,” Banner wrote in an email. The Secret Service would not comment on security planning for the rally or Trump.

CNN —The Justice Department doesn’t want to return to Jacob Chansley the infamous horned helmet and flag-pole spear that he carried inside the US Capitol on January 6, 2021. Chansley pleaded guilty — without a trial — to the felony obstruction charge and was sentenced to 41 months in prison in 2021. He has finished serving his prison time but has two years left of court-supervised release. “The government would like to ensure finality in the appellate process in this and other cases,” prosecutors added. “The government’s request to continue to hold the property as evidence until such finality in the criminal prosecution is assured is thus appropriate.”The Justice Department also said it may consider keeping Chansley’s spear and helmet as part of a civil forfeiture.

The chairman of the House Jan. 6 committee, Rep. Bennie Thompson, D-Miss., expects the panel to make criminal referrals to the Department of Justice, he told reporters Tuesday. “We have made decisions on criminal referrals,” Thompson said. Thompson later told reporters that he thinks there is “general agreement” on the panel that referrals will be issued. The panel has been conflicted over whether to issue refer its findings to the Justice Department. Thompson told reporters in June that "we do not have authority" when asked whether the panel ruled out potential criminal charges for the former president.

The sources say Justice Department officials are looking carefully at a cross section of past cases involving the mishandling of classified material. Though his comments were about the separate Jan. 6 investigation, Justice Department officials said they apply broadly. Experts say the public evidence in the Mar-a-Lago case seems unambiguous. Less clear is whether there are aggravating factors — such as whether the Justice Department can prove Trump obstructed justice by failing to turn over documents despite a grand jury subpoena. Martin’s lawyers said he was a hoarder, and prosecutors concluded that he had not given classified information to anyone.

Analyzing past securities filings, researchers from the University of North Carolina’s Tax Center found that fewer than 80 publicly traded U.S. companies would have paid any corporate minimum tax in 2021 had the tax been in effect. Businesses, including media company Liberty Media Corp., in recent weeks have pressed for additional information from the Treasury Department and the Internal Revenue Service on the implications of the tax. “It’s casting a very wide net,” David Rievman, a partner at law firm Skadden, Arps, Slate, Meagher & Flom LLP, said of the minimum tax. Among the concerns from businesses is that reorganizations could cause a company to become subject to minimum tax, or increase their tax liability. Without the deduction, the company would pay another level of corporate tax on that dividend.

In a letter Friday morning to the committee, Trump didn’t say whether he planned to comply in this case. The Jan. 6 committee is a select committee, not a standing committee or subcommittee of the House. When it comes to the Jan. 6 committee specifically, Trump has pushed former aides from his inner circle to take his approach. Even when the Justice Department does act, that doesn’t always guarantee the result.
