CNN —A Democratic election official in Pennsylvania offered an impassioned apology Wednesday for claiming “precedent by a court doesn’t matter anymore in this country” to justify counting about 600 faulty ballots in defiance of state Supreme Court rulings. “I made a mistake, and because I am an elected official, I am held to a far higher standard than everybody else. Her prior comments about flouting court precedent took off on social media and were promoted widely by Trump allies like Elon Musk. In response to a lawsuit from the McCormick campaign, the Pennsylvania Supreme Court on Monday ordered counties to abide by its past rulings about the undated ballots. Patricia Poprik, chair of the Bucks County Republican Party, on Wednesday said the board’s actions overshadowed the hard work of county election workers.

Senate Democrats who pulled off victories even as President-elect Donald Trump won their states believe the Democratic Party can learn some lessons from their races as it grapples with losing control of Washington. Democrats still lost the Senate majority despite those victories, with Republicans flipping seats in Montana, Ohio and West Virginia. Democrats acknowledged Harris faced some headwinds in running a protracted campaign after taking over the ticket in late July. And while his party lost the White House, the House and the Senate, Schumer touted the Senate victories as more evidence that the party should be focused on the economy. Sometimes Democrats may be a little too solution-oriented, and people want to, first before you get to the solutions, hear empathy.

The Pennsylvania Supreme Court on Monday ordered election officials in the state to stop counting mail-in ballots marked with the wrong date or missing dates from their outer envelopes. The court order specifies that Bucks, Montgomery and Philadelphia counties, where Republicans argue that officials have opted to count mail-in ballots with errors on their outer envelopes, must adhere to the high court's earlier rulings, which said undated or misdated mail-in ballots should not be counted. “David McCormick and the national Republicans are working to throw out provisional ballots cast by eligible Pennsylvania voters and accepted by county boards. McCormick leads Casey by 17,408 votes with 99.7% of the vote in and 24,000 ballots still to be counted. Pennsylvania rules trigger a recount of ballots when the margin is less than 0.5 percentage points.

In the closing weeks of the presidential campaign season, Sen. John Fetterman did something different than other Democrats. NBC NEWS: What is your biggest concern moving forward, and what’s kind of the biggest thing that you think Democrats need to address? Pennsylvania’s Senate race is heading to a recount, which the narrow margin between Republican Dave McCormick and Democratic Sen. Bob Casey triggered automatically under state law. Secretary of the Commonwealth Al Schmidt announced Wednesday that the unofficial results showing a narrow race have led to a recount. Any margin under 0.5 percentage points triggers a recount in Pennsylvania. But the current vote count shows a sizable drop-off between Trump and McCormick, with Trump winning more than 100,000 more votes than McCormick. NBC News projected that Democratic Senate candidates in Arizona, Michigan, Nevada and Wisconsin won their races even as Trump carried the states.

Democrat Dave Min has defeated Republican Scott Baugh in the race for a congressional seat in Orange County, California, NBC News projects. The results come after a contentious election cycle in a swing district with rapidly shifting demographics. The number of registered Democrats is nearly identical to the number of registered Republicans in a district where unaffiliated voters largely decided the race. But Min previously told NBC News that his advocacy for the community makes him well-positioned to represent it. “Those of us who are Asian American end up representing not just our own districts but Asian Americans across the entire region, maybe across the entire U.S.”

Pennsylvania's hotly contested Senate race hangs in the balance nearly a week after Election Day, with Republicans declaring victory and Democrats holding out hope that the remaining batch of outstanding ballots will allow them to close the gap. A McCormick victory would further pad Republicans' newfound majority in the Senate, where they will hold at least 52 seats after the election. But even before the new Congress is sworn in next January, the outcome of the Pennsylvania race could have implications for the Senate leadership elections Wednesday. Pennsylvanians can cast provisional ballots when officials are unclear about their eligibility or there were issues with their returned mail-in ballots. McCormick’s campaign filed two lawsuits Friday challenging an estimated 15,000 to 20,000 provisional ballots in Philadelphia that may have issues, such as missing signatures.

CNN —Republicans flipped the Senate, but Democratic candidates often outran the top of the ticket, winning at least four battleground states that Vice President Kamala Harris lost. Harris lost all seven swing states to President-elect Donald Trump, while her party’s Senate candidates narrowly held Wisconsin, Nevada and open seats in Michigan and Arizona. In some races, the differences between the Senate candidates’ and Harris’ performances were more pronounced among subsections of the Democratic coalition. While Trump won independents by 2 points, Rosen won the group by 6. Overall, Democratic Senate candidates received more votes than Harris in about half of this year’s races, including in less competitive states such as Minnesota, Virginia and Missouri.

Donald Trump’s return to the presidency has done something no political opponent could: put an end date on his time atop the Republican Party. Trump single-handedly remade the Republican Party in his own image, not only becoming its unquestioned leader but also rewiring what the Grand Old Party stands for. “We are getting four more years of Trump and then eight years of JD Vance!” Trump Jr. said last week as he campaigned for Ohio Senate candidate Bernie Moreno. He had a shaky start, but he has steadied himself,” a veteran Republican operative said. “A Trump win means [the 2028] field will be slower to develop,” a longtime Republican operative said.

In today’s edition, we explore how Republicans are eyeing maintaining their current House majority and expanding their newfound Senate majority after Donald Trump's victory. But given Trump’s decisive victory over Vice President Kamala Harris, House Republicans are feeling bullish about their chances of preserving their slim majority. The party that will hold the majority in the House of Representatives in January 2025 has yet to be determined. Republican Tim Sheehy defeated Democratic Sen. Jon Tester in Montana, NBC News projected Wednesday morning, giving the GOP 52 Senate seats. And the races in Nevada between Democratic Sen. Jacky Rosen and Republican Sam Brown and in Pennsylvania between Democratic Sen. Bob Casey and GOP challenger Dave McCormick are too close to call.

CNN —Republicans will win the US Senate majority, CNN projects, shifting the balance of power in Washington. Should Harris prevail, she would face problems in confirming members of her Cabinet and judicial nominees, and the GOP Senate could thwart her domestic plans. As the battle for Congress comes to a close, here are five things to watch:1. Republicans have long been concerned about Democrats’ massive fundraising advantage in House and Senate races. Nearly $1.6 billion has been spent on ads in Senate races since Labor Day, with Democrats spending $803 million and Republicans spending $758 million, according to AdImpact. More than $1 billion has also been spent on ads in House races since Labor Day, with Democrats spending $615 million to Republicans’ $448 million, according to AdImpact. In the Maryland Senate race, Republicans have tried to pull off an upset by recruiting former GOP Gov.

Elon Musk and his political action committee are seeking to move the Philadelphia District Attorney's lawsuit targeting their $1 million swing state voter daily lottery to federal court from a state-level court. It is not clear what will happen at the hearing, given the notice of removal in federal court. As a rule, federal law bars a state court proceeding from taking place if a party in the case has filed a notice of removal to federal court and a copy of that notice is filed with the state court. The notice filed in federal court by lawyers for Musk and his America PAC argue that because that PAC is registered as a federal entity, it is not subject to state law. Krasner's lawsuit, which claims Musk's $1 million giveaway is an illegal, unregulated lottery, was filed in Court of Common Pleas on Monday.

They argue that Casey, a middle-of-the-road liberal, had previously not been at the forefront of the populist economic turn in both parties. Casey’s Senate website dedicates an entire page to “greedflation,” which he also discussed at length in his speech at the Democratic National Convention this summer. The core of Casey’s argument is the assertion that, from July 2020 to July 2022, corporate profits rose five times faster than overall inflation. I would concede the economy has gotten better,” said McCormick, who has run an ad to counter Casey on the topic. “If you’re living paycheck to paycheck, you’re still in the grind, and that’s what I think Bob Casey and Kamala Harris do not understand.

Democratic Rep. Colin Allred is giving the polarizing Republican Sen. Ted Cruz a run for his money, presenting him as a do-nothing extremist. There’s added intrigue as Cruz underperformed in his last Senate race in 2018, fending off former Democratic Rep. Beto O’Rourke by less than 3 points. Republican Larry Hogan won two races for governor of Maryland in 2014 and 2018, defying gravity in the deep-blue state. He’s favored in a red-leaning district previously held by centrist Democratic Rep. Ron Kind. Democratic Rep. Vicente Gonzalez is looking to hang on against Mayra Flores, a Mexican-born millennial who has promoted far-right rhetoric and is seeking to channel a resistance to transgender rights.

Former hedge funder David McCormick has narrowed the gap in a closely watched US Senate race. McCormick's Wall Street allies are among the biggest donors to a pro-McCormick super PAC. Jeff Yass is among the big names making a final splash before Election Day. According to a pro-McCormick super PAC's final pre-election filing, Yass donated $1 million over the course of two donations earlier this month. He's not the biggest megadonor with Wall Street ties.

PITTSBURGH — Inside Acrisure Stadium, home of the Pittsburgh Steelers, Minnesota Gov. “The Steelers are largely a cultural identity for the whole region,” said state Rep. Nick Pisciottano, a Democrat from Allegheny County. “I mean, Brown is the Pittsburgh Steelers’ [second] all-time leading receiver. “Former Pittsburgh Steelers are split on the Presidential election,” Ryan Clark, an ESPN personality and former Steelers safety, posted on X. For Pisciottano, the difference between Trump’s and Harris’ Steelers backers is that Harris’ have much more substantial ties to Pittsburgh and the region than Trump’s do.
