That's how one California prisoner's case failed before the District Court for the Eastern District of California. Cases against corrections officers run into another set of challenges under the doctrine of "qualified immunity." In prisons, BI has found, qualified immunity has also protected corrections officers who have been accused of excessive force. After losing at the district court level, McCoy appealed and got a rare finding from the judges of the 5th Circuit. AdvertisementOver the same five years in BI's sample, no federal judge found for the plaintiff in a single excessive-force claim filed by a California prisoner.

The wife of a California inmate will receive $5.6 million after being sexually violated during a strip search when she tried to visit her husband in prison, her attorneys said Monday. Of the $5.6 million settlement, the California Department of Corrections and Rehabilitation will pay $3.6 million and the rest will be paid by the other defendants, which include two correctional officers, a doctor, and the Adventist Health Tehachapi Valley hospital. Despite no contraband being found in any of her belongings or her body, Cardenas was denied her visit with her husband. California prisons have faced an ongoing problem of sexual abuse and misconduct, with the the U.S. Justice Department announcing it had opened an investigation into allegations that correctional officers systematically sexually abused incarcerated women at two state-run California prisons. Earlier this year the federal Bureau of Prisons announced it will close a women’s prison in Northern California known as the “rape club” after an Associated Press investigation exposed rampant sexual abuse by correctional officers.

Four men were able to escape from Tangipahoa Parish Jail in Louisiana this weekend because of an eight-inch gap and a lack of oversight at the facility, the authorities said. Jimmy Travis, the chief of operations for the Tangipahoa Parish Sheriff’s office, blamed structural issues and a lack of oversight by the jail staff in a news conference on Monday. The four men escaped after they evaded correction officers during recreation time in the yard and hid out until darkness, according to a Facebook statement from the Tangipahoa Parish sheriff, Daniel Edwards. The men escaped in pairs, Mr. Travis said. On Sunday, two other inmates — Omarion Hookfin, 19, and Jamarcus Cyprian, 20 — copied that route for their escape.

For instance, the U.S. has blocked shipments of cotton coming from China, a top manufacturer of popular clothing brands, because it was produced by forced or prison labor. While prison labor seeps into the supply chains of some companies through third-party suppliers without them knowing, others buy direct. Cargill acknowledged buying goods from prison farms in Tennessee, Arkansas and Ohio, saying they constituted only a small fraction of the company’s overall volume. For instance, about a dozen state prison farms, including operations in Texas, Virginia, Kentucky and Montana, have sold more than $60 million worth of cattle since 2018. “What for?”FOLLOWING THE MONEYThe business of prison labor is so vast and convoluted that tracing the money can be challenging.

An inmate was charged Friday with stabbing ex-Minneapolis police Officer Derek Chauvin. Chauvin was convicted of murdering George Floyd and was serving his sentence in a federal prison in Arizona. The inmate, who nearing the end of a 30-year sentence, was accused of planning the attack. CHARLESTON, W.Va. (AP) — Five former correctional officers in West Virginia were indicted by a federal grand jury Thursday in connection with the 2022 death of an incarcerated man who was beaten while handcuffed and restrained in an interview room and later a jail cell. The indictments in West Virginia's southern U.S. District Court come weeks after two different West Virginia corrections officers pleaded guilty to a felony conspiracy charge stemming from the fatal beating of the same inmate, 37-year-old Quantez Burks. The case has drawn scrutiny to conditions and deaths at the Southern Regional Jail. Earlier this month, West Virginia agreed to pay $4 million to settle a class-action lawsuit filed by inmates who described conditions at the jail as inhumane. Two other former corrections officers were indicted Thursday on a charge of failing to intervene in the unlawful assault, resulting in Burks' death.

One expert told CNN that many released prisoners are unaware that they lived through torture. His testimony was one of many used in a report released Friday from the NGO Korea Future, which detailed torture and abuse faced by detained North Koreans. "In the past, we had to crawl with both hands and knees when we were moving, but in 2017, we could stand up and walk," the man told CNN. So they just simply thought that they were bad people and for that reason, they were being punished," Kim told CNN. In February, the UN HRC released a report on human rights that backs up many of Korea Future's findings.
REUTERS/Karen Pulfer FochtMarch 17 (Reuters) - The family of a Black man who died while in a Memphis jail on Friday called on authorities to identify the correctional officers involved in the altercation that killed him and to hold them accountable. Gershun Freeman, 33, died on Oct. 2 at the Shelby County, Tennessee, jail after being beaten by guards and held prone on the ground with a knee on his back for more than five minutes while handcuffed. More than five months after his death, the family is still seeking answers and justice, his mother, Kimberly Freeman, said at a press conference outside the county jail where her son was held. The Tennessee Bureau of Investigation is investigating the incident, while the Shelby County District Attorney office handed the case over to the Nashville District Attorney Office to avoid a conflict of interest. Released earlier this month, 14 minutes of video show the violent altercation between jail guards and Freeman that ended with his death.
Feb 14 (Reuters) - A divided U.S. appeals court on Tuesday said federal workers are generally not entitled to extra pay for being exposed to COVID-19 through their jobs. In a 10-2 decision with potentially "far-reaching" ramifications, the U.S. Federal Circuit Court of Appeals ruled against 188 current and former correctional employees at a federal prison in Danbury, Connecticut. But the appeals court said the government's Office of Personnel Management, the human resources agency for more than 2.1 million federal workers, had no regulations affording extra pay for exposure in most settings to contagious diseases. Circuit Judge Jimmie Reyna dissented, saying the prison employees plausibly alleged they deserved extra pay for exposure to "unusually" hazardous conditions. The decision is Adams et al v U.S., U.S. Federal Circuit Court of Appeals, No.
Banning vaccine and mask mandatesDeSantis wants the Florida legislature to permanently ban COVID vaccine and mask mandates. It's not clear how much of a difference a new, permanent Florida law would make. DeSantis will ask the Florida legislature to permanently lift the state's 6% sales tax on baby necessities including on cribs, strollers, clothing, shoes, wipes, and diapers. But some analysts, such as Howard Gleckman at the Tax Policy Center, have warned that tax breaks could actually worsen inflation because people will spend and consume more at a time when supplies are limited. Currently, state law requires a vote be unanimous.
