The Supreme Court’s recent rescue of an important federal agency from the hands of a hostile lower court was an exercise in the evolving definition of originalism. A mechanism that the United States Court of Appeals for the Fifth Circuit deemed unconstitutional was clearly known to and accepted by the Constitution’s framers, Justice Thomas concluded. Justice Elena Kagan wrote a concurring opinion to say that while the old history was enlightening and adequate to support the agency’s constitutionality, modern practice supported it as well. “All the flexibility and diversity evident in the founding period,” she wrote, has “continued unabated” when it comes to financing government operations. Notably, two of the court’s conservatives, Justices Brett Kavanaugh and Amy Coney Barrett, in addition to Justice Sonia Sotomayor, joined Justice Kagan’s endorsement of the significance of later, even contemporary, practice when interpreting the Constitution.

The Hong Kong and Beijing governments have repeatedly denied the national security law is suppressing freedoms, arguing it has ended chaos and “restored stability” to the city. Since the national security law came into effect in 2020, civil groups have disbanded, and independent media outlets have been shut down. They are the first defendants to be acquitted in a national security law trial in Hong Kong. But that strategy is in doubt after another local national security law enacted earlier this year curtailed access to reduced sentences for guilty pleas. “It’s absolutely clear that the national security law reduced the independence and the autonomy of the judiciary.

The day after Hamas’s brazen Oct. 7 attack on military and civilian targets in Israel, the S.J.P. chapters co-signed an open letter declaring “full solidarity with Palestinian resistance.” The letter described the attacks as “an unprecedented historic moment for the Palestinians of Gaza” and a “counteroffensive against their settler-colonial oppressor.” It would be tantamount to “asking for quiet submission to systemic violence” for anyone to call for peace now, after years of Israeli violence and military campaigns against Palestinians. The groups issued a list of demands to the university — divestment from companies doing business with the Israeli government, the end of Columbia’s affiliation with Tel Aviv University and a recognition of Palestinian “existence and humanity” — and announced a demonstration on Oct. 12 on the steps of Low Library. “We got some pushback from the university,” recalled Cameron Jones, an organizer of the J.V.P. chapter, “but not insane pushback.”

Re “Dear Boomers, the Student Protesters Are Not Idiots,” by Elizabeth Spiers (Opinion guest essay,, May 17):Ms. Spiers’s characterization of the student protests misses the mark. As a recent college graduate myself, I don’t disagree that college students “are capable of having well thought-out principles,” but the principles underlying these protests are troubling. Ms. Spiers alludes to my generation possessing elevated moral sensibilities due to our experience with mass shootings. If these chants are part of well thought-out principles and not naïveté, then it behooves us to scrutinize the moral framework that informs these principles. Why is it that these protests project outrage toward Israel’s conduct in the war but conveniently elide the horrific details of Oct. 7?
