"QAnon Shaman" Jacob Chansley will regain possession of the makeshift spear and horned helmet that he carried as he stormed the U.S. Capitol during the Jan. 6, 2021, riot with other Trump supporters, a federal judge ruled Monday. "Since the government has not established that it still needs these items as evidence and has not sought their forfeiture, the Court will GRANT Mr. Chansley's motion," Lamberth wrote. The DOJ last month said it wanted to hold on to Chansley's property, because despite having expressed remorse at his criminal sentencing, he has since challenged his conviction and sentence. "Even if the government may need to reprove Mr. Chansley's guilt, the government has not explained why it would need his property," the judge wrote in Monday's order. "He was like thousands of others that day," Lamberth wrote in Monday's order.

CNN —The Justice Department doesn’t want to return to Jacob Chansley the infamous horned helmet and flag-pole spear that he carried inside the US Capitol on January 6, 2021. Chansley pleaded guilty — without a trial — to the felony obstruction charge and was sentenced to 41 months in prison in 2021. He has finished serving his prison time but has two years left of court-supervised release. “The government would like to ensure finality in the appellate process in this and other cases,” prosecutors added. “The government’s request to continue to hold the property as evidence until such finality in the criminal prosecution is assured is thus appropriate.”The Justice Department also said it may consider keeping Chansley’s spear and helmet as part of a civil forfeiture.

A federal judge refused to toss "QAnon Shaman" Jacob Chansley's guilty plea. The judge pointed to "miles of footage" showing Chansley rioting at the Capitol. "Such an about-face casts serious doubt on the veracity of any of Mr. Chansley's claims, here or elsewhere." In media interviews after his release, he expressed regret for his guilty plea and tried to get it reversed. Carlson, the judge wrote, included "inflammatory characterizations of cherry-picked videos stripped of their proper context" that undermined faith in the criminal justice system.

Jacob Chansley, also known as Jake Angeli or the “QAnon Shaman”, is due to be released early from prison in the U.S. due to a combination of factors including good behavior, according to his attorney. Posts online, however, are saying he was released early due to footage of the Jan. 6 attack on the U.S. Capitol showing he was wrongly sentenced or that the event itself was a hoax. Chansley was not released as a result of the video footage released through Tucker Carlson.”In February 2023, TV host Tucker Carlson said he’d been given access to thousands of hours of video footage from the Capitol riot (here). Reuters has debunked multiple other claims alleging the Capitol storming was a hoax (here), (here) and (here). His new roommates told The New York Post on Sunday they had no idea who he was. A prison spokesperson told Insider's Natalie Musumeci that he was transferred from Arizona's Federal Correctional Institution Safford to "community confinement" overseen by the Federal Bureau of Prisons' Phoenix Residential Reentry Management Office last week. Chansley's projected release date from any kind of federal custody is May 25, the spokesperson added.

Elon Musk has been chit-chatting with a QAnon-linked influencer on Twitter, a Media Matters report says. According to a record of Musk's tweets compiled by Media Matters, Musk interacted with a Twitter user named KanekoaTheGreat at least 18 times since February 20. Media Matters said it tracked KanekoaTheGreat's online presence and found that they were part of a QAnon influencer group known as We The Media. Musk's question echoed a right-wing conspiracy theory about depleting testosterone levels pushed by shock jock Alex Jones and Fox News host Tucker Carlson. KanekoaTheGreat posted on their Telegram channel in December that they had obtained "the Elon Musk stamp of approval," and highlighted other occasions where Musk has responded to them.
Jimmy Kimmel made fun of Tucker Carlson and Fox News while hosting the Oscars on Sunday. He joked that good editing can even turn footage of a riot into a "sightseeing tour of the Capitol." Carlson appeared to use selectively edited clips to claim cops acted as "tour guides" on Jan. 6, 2021. "Edits can turn 44,000 hours of violent insurrection footage into a respectful sightseeing tour of the Capitol." Fox News and Carlson received bipartisan condemnation for their broadcast of previously unseen Capitol riot footage, with Republican Senate Minority Leader Mitch McConnell describing it as "offensive and misleading."
A Proud Boy wants to dismiss his seditious-conspiracy case based on Tucker Carlson's Jan. 6 footage. The DOJ responded on Sunday that all of the footage was already provided during discovery. Elon Musk previously suggested there was a miscarriage of justice by jailing the "QAnon Shaman." Chansley's former attorney, Albert Watkins, also said that he had not seen the footage aired on Carlson's show, The Washington Post reported. "In the weeks prior to the plea repeated requests were made to make sure we had all the video footage," Watkins wrote in an email.
Elon Musk called for the release of 'QAnon Shaman' Jacob Chansley, jailed over the Capitol riot. "Free Jacob Chansley," the Tesla CEO and Twitter owner tweeted on Friday while sharing a video of Chansley outside the Capitol telling protesters that Trump had told people to go home. And the other video shows him calmly walking in the Capitol building, being escorted by officers and then thanking the officers." The outlet added that the footage aired by Carlson left out important context. According to a timeline of events by the Department of Justice, Chansley was one of the first 30 people to enter the Capitol building on January 6, 2021.
Tucker Carlson's January 6 footage has been brought up in a January 6 seditious conspiracy trial. Lawyers representing a Proud Boys member asked a federal judge to dismiss his case. He and the co-defendants — Proud Boys Enrique Tarrio, Ethan Nordean, Joseph Biggs and Zachary Rehl — have pleaded not guilty. The lawyers cited the Washington Post's reporting that Albert Watkins, Chansley's lawyer, never saw that footage during his client's case. It's not the first time the Proud Boys members have asked for their case to be dismissed.
The White House lit into Tucker Carlson after he made misleading claims about January 6. The response shows the nerve Carlson has struck with his selectively edited footage of the riot. "Tucker Carlson is not credible," a White House spokesman said of the host. Bates then went after Carlson by name, poking fun at how the network has portrayed Carlson in past lawsuits. Outside of the White House, Carlson's comments and use of footage his show exclusively obtained from House Speaker Kevin McCarthy has set off a torrent of criticism in Washington.
Fox News received early access to the security footage shown in the segment. WASHINGTON—Democratic and Republican lawmakers criticized a Fox News segment that showed previously unaired footage of the Jan. 6, 2021, attack on the U.S. Capitol, saying it played down the severity of the riot, in which a pro-Donald Trump mob tried to stop Congress from certifying Joe Biden as the winner of the presidential election. On Monday night, Fox News host Tucker Carlson aired several clips of footage focused on central figures of the day, including Jacob Chansley, the self-described QAnon Shaman. Mr. Carlson said that lawmakers had intentionally overstated the violence and that members of the Jan. 6 committee established to investigate the attack “lied about what they saw” in the footage.
The family of Capitol Police officer Brian Sicknick criticized Fox News. Host Tucker Carlson sought to undermine claims the Jan. 6 riot helped cause Sicknick's death. In the wake of the riot, news organizations citing a Capitol Police statement reported that Sicknick died as a result of injuries sustained during the riot. A coroner in April, 2021, found that Sicknick died of natural causes, but said that "all that transpired (on January 6) played a role in his condition." Chansley was sentenced to 41 months in prison for his role in the riot in 2021.Insider has contacted Fox News for comment.
