Prosecutors have already charged Ryan Wesley Routh with two firearms offenses, and a federal magistrate judge on Monday ordered him detained pending further court proceedings. The attempted assassination charge is “pretty rare,” according to former FBI Deputy Director Andrew McCabe, a CNN senior law enforcement analyst. But it has been used in other high-profile attempted assassination cases, such as that of a man charged with traveling to Brett Kavanaugh’s Maryland home with a gun, burglary tools and other equipment in an apparent attempt on the Supreme Court justice’s life. To prove their case, prosecutors would have to convince a jury that Routh took affirmative steps to carry out a plot to kill the former president. Ron DeSantis said last week that the state “will be conducting its own investigation regarding the attempted assassination at Trump International Golf Club.” Routh has not been charged in state court.

The case returns to Judge Tanya Chutkan one month after the Supreme Court issued a game-changing ruling on presidential power. But the Supreme Court interceded earlier this year and put the case on pause to consider Trump’s claims of presidential immunity. Attorneys working on the case believe that Chutkan will move quickly with the case back in her jurisdiction, according to sources familiar with their thinking. Any move she makes will be under extreme scrutiny, given that it’s the only remining federal case against Trump after the Florida federal judge overseeing his classified documents case, Aileen Cannon, dismissed those criminal charges against Trump and his two co-defendants. Cannon appeared to hold hearings on nearly every motion in the Trump case before her, but Chutkan often rules without hearing from the parties in person.

CNN —Special counsel Jack Smith told the judge in the classified documents case in Florida that Supreme Court Justice Clarence Thomas’ criticism of his appointment should have no bearing on the criminal case against former President Donald Trump. In a brief filing Friday, Smith said that Thomas’ writing in the presidential immunity case – in a concurrence that no other justice joined – isn’t binding on US District Judge Aileen Cannon. In a filing last week, Trump’s lawyers brought to Cannon’s attention both the Supreme Court’s immunity ruling and the concurrence that Thomas wrote in that dispute. In response on Friday, Smith said that he agreed with Trump that both sides should file more briefing on how the high court’s immunity ruling affects the documents case. Cannon has not signaled yet how she’ll weigh the Supreme Court’s new ruling in the case before her.

CNN —Attorneys for former President Donald Trump are now seeking to use the Supreme Court’s presidential immunity decision to help him in his criminal case in Florida over the mishandling of classified documents. In a new court filing Friday, Trump’s team said they want an updated schedule in the federal classified documents case so they can argue points related to the Supreme Court decision. The decision “guts the Office’s position that President Trump has ‘no immunity’ and further demonstrates the politically-motivated nature of their contention that the motion is ‘frivolous,’” Trump’s attorneys wrote. The Supreme Court’s decision directly applies to the federal case over 2020 election subversion efforts in Washington, DC, but it could impact all four of the criminal cases against the former president. Trump’s attorneys argue the concurrence “adds force” to motions Trump has filed against how Smith was appointed and funded.

CNN —A pro-Trump lawyer who tried to overturn the 2020 election was arrested Monday after a court hearing about her recent leak of internal emails belonging to Dominion Voting Systems. In the last 24 hours, Leaf has posted more than 2,000 internal Dominion documents on his social media account. The marshals declined to say whether they arrested her, and she didn’t answer messages seeking comment after the hearing. During the at-times testy hearing Monday, Magistrate Judge Moxila Upadhyaya peppered Lambert with sharp questions about the disputed Dominion materials. Dominion wants Lambert removed from the case and suggested in court Monday that she might have committed a crime by disseminating the files to Leaf.

Washington CNN —Vice President Kamala Harris said Friday that it is “absurd” and “patently unfair” that marijuana is treated the same as heroin and other Schedule I drugs – and more seriously than fentanyl – under federal law. “Marijuana is considered as dangerous as heroin and more dangerous than fentanyl, which is absurd, not to mention patently unfair,” Harris said during a roundtable on the administration’s plans for cannabis reform. CNN —The former FBI informant charged with lying about the Bidens’ dealings in Ukraine told investigators after his arrest that Russian intelligence officials were involved in passing information to him about Hunter Biden, prosecutors said Tuesday in a new court filing, noting that the information was false. They said he previously told the FBI that he has longstanding and extensive contacts with Russian spies, including individuals he said were high-level intelligence officers or command Russian assassins abroad. CNN —Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency to reverse the 2020 election results, a federal appeals court said Tuesday. The ruling is a major blow to Trump’s key defense thus far in the federal election subversion case brought against him by special counsel Jack Smith. “For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant. But any executive immunity that may have protected him while he served as President no longer protects him against this prosecution,” the court wrote. CNN —The House Judiciary Committee has subpoenaed an assistant US attorney on the Hunter Biden criminal case, according to a copy of the subpoena reviewed by CNN. House Judiciary Chairman Jim Jordan initially requested testimony from Assistant US Attorney Lesley Wolf in June along with a number of Justice Department officials involved in the Hunter Biden criminal investigation. The Department of Justice has made six high-level officials, including special counsel David Weiss, available to testify, but has not allowed the panel to interview Wolf. In the subpoena letter, Jordan called the DOJ’s reasons for withholding Wolf’s testimony “unpersuasive.” DOJ declined to comment to CNN on the subpoena. During his closed-door interview with Congress earlier this month, Weiss defended Wolf.
