WASHINGTON — The Supreme Court on Monday rejected disbarred lawyer Michael Cohen’s last-ditch effort to revive a civil rights claim against his former boss Donald Trump. But constitutional claims against individual federal officials are notoriously difficult to bring as a result of a line of Supreme Court rulings. In a 2022 case called Egbert v. Boule, the Supreme Court effectively put “Bivens claims” on life support in a ruling that tossed out allegations against a Border Patrol agent. A federal judge in New York and the 2nd Circuit U.S. Court of Appeals both highlighted the Supreme Court’s recent ruling in throwing out Cohen’s claims. Unless Congress passes legislation to allow a form of Bivens claims, there are few legal avenues to seeking accountability when federal officials, including thousands of law enforcement officials, commit unlawful acts.

CNN —The Supreme Court on Tuesday revived the case of a citizen journalist who was arrested in 2017 for seeking information from a police department source in Laredo, Texas. The court threw out a decision against the journalist and ordered the appeals court to look at the case again. Nearly one-third of the cameras in the Border Patrol’s primary surveillance system along the southern U.S. border are not working, according to an internal agency memo sent in early October, depriving border agents of a crucial tool in combating illegal migrant crossings. WASHINGTON (AP) — The Biden administration said Monday it is making asylum restrictions at the southern border even tougher, as it’s increasingly eager to show voters uneasy over immigration that it is taking a hard stance on border security. The new rules, which toughen restrictions announced in June, bar migrants from being granted asylum when U.S. officials deem that the southern border is overwhelmed. But the administration has touted its asylum restrictions, saying they have led to serious drops in the number of migrants coming to the southern border. A senior administration official said Monday that the longer timeline was necessary to make sure that drops in immigration are sustained and not due to a one-time event. “It’s absolutely reasonable to want robust systems in place to know who is coming into our country, and certainly, the surges we’ve seen at the southern border have been unsustainable,” she said.

More than 13,000 immigrants convicted of homicide — either in the United States or abroad — are living freely in the U.S., outside of Immigration and Customs Enforcement detention, according to data ICE provided to Congress earlier this week. The 13,099 immigrants convicted of homicide living in the U.S. may have never had contact with ICE, the two law enforcement officials said. The two law enforcement officials said ICE prioritizes migrants who have been convicted of serious crimes, like homicide, for arrest. There are currently more than 7.5 million immigrants on ICE’s “non-detained” docket, meaning they have pending immigration cases but are not currently in detention. Agents explained that locating convicted criminals living at large takes an enormous amount of manpower, from locating them to the arrest.
