A judge on Thursday denied an effort by Donald Trump to dismiss his criminal election interference case in Georgia on grounds that the indictment violates his free speech rights. "Even core political speech addressing matters of public concern is not impenetrable from prosecution if allegedly used to further criminal activity," McAfee wrote. The defendants argued that their speech about Georgia's 2020 election results was political and that they cannot be prosecuted for making even false political statements. But the charges do not hinge solely on whether their election claims were true or false, McAfee wrote. "The allegations that the Defendants' speech or conduct was carried out with criminal intent are something only a jury can resolve."

Donald Trump on Wednesday offered to "exchange" his right to a speedy trial in his Georgia election-conspiracy case for an Atlanta judge ruling that would have the former president tried separately from 18 other defendants. Trump's co-defendant Mark Meadows, who served as his White House chief of staff, shortly afterward filed an identical offer waiving a speedy trial in exchange for his own case being tried separately. Fulton County Superior Court Judge Scott McAfee has yet to rule on the severance requests that Trump, Meadows and 10 other defendants have filed. It is by no means clear that McAfee would grant severances based on waivers of speedy trial. Trump and the other defendants have the absolute right to a speedy trial in the case.

The post Thursday raises the question of whether X will become an important channel for Trump's election efforts moving forward. Former President Donald Trump posted to X , formerly Twitter, for the first time since his suspension from the platform, returning to share his mugshot in the Georgia election interference case . He moved to his own social media platform, Truth Social, created by the Trump Media & Technology Group. When billionaire Elon Musk took over Twitter, and eventually reversed the permanent ban on Trump, the former president didn't even return to the service, sticking with Truth. Still, Trump posted on Truth after sharing the mugshot on X, "I LOVE TRUTH SOCIAL.

The White House disclosed Saturday that Biden's lawyers turned over new classified documents that were discovered at Biden's Delaware home. Last week the White House disclosed that classified government documents from the Obama administration were found in Biden's possession on four separate occasions. Though the documents were found on Nov. 2, the White House did not make the news public until last Monday. Other classified documents were found in Biden's possession at other locations in searches on Dec. 20, Jan. 12 and Jan. 14, according to the White House. Trump is the focus of a criminal probe by the DOJ for his removal of the records from the White House in January 2021.
