CNN —New York’s highest court on Thursday rejected President-elect Donald Trump’s bid to postpone his sentencing in the hush money case, leaving the US Supreme Court as his last chance to delay Friday’s scheduled hearing. Trump appealed to both the Supreme Court and the New York Court of Appeals to try to block state Judge Juan Merchan from imposing a sentence in the hush money case, where Trump was convicted in May on 34 counts of falsifying business records. In a two-sentence letter Thursday from the Court of Appeals, Trump’s attorneys were notified that Judge Jenny Rivera denied Trump’s request. The US Supreme Court can act at any time on Trump’s attempt to intervene and stop the sentencing, which was filed Wednesday after the New York Appellate Court, First Division, also denied Trump’s request to stay the sentencing. Trump’s “extraordinary immunity claim is unsupported by any decision from any court,” Bragg, a Democrat, told the Supreme Court.

CNN —Jimmy Carter, who served a single full presidential term without the chance to appoint a Supreme Court justice, nonetheless left behind an incomparable judicial legacy. Carter named Ginsburg to an important Washington-based US Court of Appeals in 1980, which positioned her for eventual elevation to the Supreme Court. Women made up 12 of his 59 circuit court appointees and 29 of his total 203 district court appointees. CNN —A California appellate court has overturned the rape conviction of former San Francisco 49ers defensive tackle Dana Stubblefield – finding it “legally invalid” – on the grounds of racial bias. During the trial, the prosecution had alleged that Stubblefield had threatened the woman with a handgun. All saw their federal sentences commuted by President Joe Biden on Thursday in the largest single-day act of clemency in modern history. Many of those who received pardons had long ago completed their sentences but the crime will now be wiped from their record. He was sentenced to 15 years in prison in 2014 before Biden commuted his sentence. The $26 million scheme involved billing Medicare for services that were never provided and efforts to bypass the government’s probe. Lovett was given a ten-year prison sentence and ordered by the U.S. District judge in the case to pay more than $9 million in restitution.

SPRINGFIELD, Ill. AP —The Illinois Supreme Court on Thursday overturned actor Jussie Smollett’s conviction on charges that he staged a racist and homophobic attack against himself in downtown Chicago in 2019 and lied to police. Emailed messages seeking comment were sent Thursday to Foxx’s office and to Smollett’s attorney, who have argued that Smollett has been victimized by a racist and politicized justice system. Testimony at his trial indicated Smollett paid $3,500 to two men whom he knew from “Empire” to carry out the attack. A state appellate court ruling upheld Smollett’s conviction, declaring that no one promised Smollett he wouldn’t face a fresh prosecution after accepting the original deal. President-elect Donald Trump said Thursday he will nominate Todd Blanche, one of his criminal defense lawyers, to be deputy attorney general. The statement noted that Blanche has experience working for the Justice Department — something former Rep. Matt Gaetz, R-Fla., Trump's choice for attorney general, does not have. Blanche was Trump's lead lawyer when he stood trial on charges of falsifying business records related to a hush money payment this year. If Trump loses on immunity, his lawyers are expected to ask Merchan to delay Trump’s sentencing so they can appeal. Trump’s attorneys attempted this in 2023, and District Judge Alvin Hellerstein denied it. But following the Supreme Court ruling, Trump’s attorneys made a second attempt this summer. Together, Pennsylvania’s mail ballot rules have generated an entire vocabulary for rejected mail ballots — ballots that are unsigned, undated or misdated, or even “naked,” if they are not clothed in a secrecy envelope. The latest update from Oct. 31 — after the general statewide deadline to request a mail ballot — shows there were 2,193,578 mail ballot applications ever approved. Combined with the deficient returned ballots that we already know about referenced above, that comes to about 8,000 deficient mail ballots that have been returned to date. Although this general election will likely see more mail ballots returned than the previous midterm, the trend so far suggests we might have fewer mail ballots rejected. Moreover, the experience in 2022 suggests there will also be thousands of provisional ballots cast by voters who return deficient mail ballots.
